2. PLEDGE OF ALLEGIANCE /INVOCATION
Action: Dana Goldman,Esq. led the Pledge of Allegiance to the flag,and Robin Hynes gave
the invocation in honor of her father, Richard C. Schulman who recently passed away.
Mayor Edelcup thanked Robin and said how deeply we all miss Richard, and offered our
deepest condolences to Robin and the other members of her family.
Mayor Edelcup gave opening remarks of decorum.
3. APPROVAL OF MINUTES
3A. Regular City Commission Meeting—April 17, 2014.
Action:Vice Mayor Aelion moved and Commissioner Gatto seconded a motion to approve
the above mentioned Summary Minutes. The motion was approved by a voice vote of 4-
0-1 (Commissioner Scholl absent) in favor.

4. ORDER OF BUSINESS (Additions/Deletions/Amendments)
4A. Request to Hear Items; Change Order of Agenda: Hear Item 1011 after Item 3A. Name
Park Bench in Honor of Richard C. Schulman; Revisions: Item 10F.Resolution Approving
Purchase from GraphPlex; Add-On: Item 5D. Presentation by K-8 Students; Item 5E.
Presentation by Fortune International.
Action: Mayor Edelcup noted the above changes to the agenda. Vice Mayor Aelion moved
and Commissioner Gatto seconded a motion to approve the above changes to the agenda.
The motion was approved by a voice vote of 4-0-1 (Commissioner Scholl absent) in
favor.

5. SPECIAL PRESENTATIONS
5A. City Commission Employee Recognition Award Program: Certificates of Appreciation to
be Presented to the Following City Employees: Brayan Pagan, Senior Code and Parking
Enforcement Officer; and Rob Williamson, Public Works Foreman.
Action: Mayor Edelcup reported that Brayan Pagan, Senior Code and Parking Enforcement
Officer,and Rob Williamson,Public Works Foreman went above and beyond the call of duty
in the performance of their duties. Mayor Edelcup and the City Commission presented them
each with a Certificate of Appreciation and noted that each recipient will receive a $100
check. City Manager Russo noted that Assistant City Manager Bill Evans accepted on behalf
of Rob Williamson who is out of the country on vacation.
5B. A Proclamation Declaring May 25,2014,as"National Missing Children's Day"in the City
of Sunny Isles Beach.
Action: Mayor Edelcup reported,and noted that the City Clerk will mail the Proclamation to
representatives of"National Missing Children's Day".
5C. A Presentation of the Status Report of the City Advisory Committee.
Action: Dana Goldman, Esq. Chairperson of the City Advisory Committee, presented a
Status Report on the activities of the Committee. When they first ushered in the composition
of the new Committee the two broad areas of focus and inquiry were: 1) how to foster or
improve communications amongst the residents and the City Government; and 2)
condominium development of interest to condominium owners, boards, management, etc.
We are pleased to report the progress that we have made in terms of providing input,
receiving input from the residents, providing input to the Commission, and the adoption of
resolutions and ordinances in that regard. The first area is communication and we are
pleased to report that the Resolution on Social Media is now a reality. Sunny Isles Beach
now has Facebook and Twitter, and other social media, another platform to improve
communications among the residents which was a recommendation that came out of the
Committee. The second initiative that the Committee has fostered has been about electronic
signs. After a very lively debate and discussion at a Committee meeting, that
recommendation is now going through on second reading and adoption of the Ordinance. A
great compromise was reached in terms of putting together electronic signs in government
areas, and that is for the benefit of not only disseminating information about special events
but also for public safety and public awareness in the event of an emergency. And so the
signs do have another ancillary benefit.
Chairperson Goldman said the Committee is also pleased to report the progress they have
made in terms of their introduction of the Condominium Workshop Series. We have now
had two(2)of the Workshop Series: 1)Permitting and Code Enforcement that was provided
by Building Official Clay Parker and Paola Villa, Building Department Manager about
permitting, etc., and 2) 40-Year Recertification Process which was well attended and we
were pleased to see the interest that many of the Condominium Boards and Management had.
Based on the success of the Series so far, we are pleased to report that we will be working

together with the City Attorney and the Deputy City Attorney putting together our next
Workshop Series. We have a couple of ideas and we are hoping to get that formalized at our
next meeting, and then have one or two over the Summer into Fall.
Chairperson Goldman said we would like to talk about a little progress that we are making in
terms of being a conduit or a platform for residents discussing issues of quality of life. We
have talked about some issues such as skateboards which is something that is going to be
discussed here this evening. At least we know now that through this process the Committee
can serve as a venue and platform for having the residents come out and voice their concerns
and issues about quality of life issues. We are happy that our meetings have been
increasingly well attended. She thanked the City Commission for this opportunity.
Mayor Edelcup thanked her for a very comprehensive report and it looks like the City
Advisory Committee is working very hard and we look forward to the next report. Whatever
we can do to work together, he is sure we have the mutual desire of making Sunny Isles
Beach a better place then it was last year,or the year before,or ten years ago. He thanked her
again for all the hard effort that she has put forth as well as the members of the Committee.
5D. Add-On:
Presentation by Civics Teacher Rosa Carvajal and her Students from Norman S. Edelcup
Sunny Isles Beach K-8 regarding the Law Day Event on May 1, 2014.
Action: Commissioner Levin introduced Rosa Carvajal and her students who she has been
working with through the "Justice Teaching Program" which was created by the Florida
Supreme Court Justice. Fred Lewis who used to be the Chief created the"Justice Teaching
Program". We received an email that May 1 was Law Day. She went to Rosa about doing
something and she was greatly excited and they held an event. On Thursday, May 1, 2014,
about 155 students, which is most of the 7th grade, came over to Government Center. The
students had come up with ten (10) questions that they presented to the Mayor and City
Commission,City Manager Russo,City Attorney Ottinot,and Assistant City Clerk Mauricio
Betancur,as the City Clerk was away at the time. The students put together a presentation as
thanks for putting on this program,they wrote us a lovely letter and prepared this plaque for
us and gave it to us at the Workshop but they are here to represent it to us tonight. Ms.
Carvajal and two (2) of her students made the presentation to the Mayor and City
Commission of a framed Picture and Letter regarding the Law Day Event.
Mayor Edelcup thanked Ms.Carvajal and the students,and commended Commissioner Levin
for putting together this wonderful program that joins our school,a County facility with the
municipality of Sunny Isles Beach to government all agencies that we represent have worked
very closely together to create the most wonderful school in all of South Florida and it has
been one of the instrumental factors of making Sunny Isles Beach the highest quality of life
location that people would want to be living in and taking part in. He thanked Commissioner
Levin again and hopes that this event is the first of many yet to come and we continue on
with this program to work together with the School Board, the students in our school, and
introduce them to the workings of government and encourage them to take part in
government as they go on with their life.

Commissioner Levin noted that she had notified Justice Teaching about the Program as she
thought they might want to use it as a model. Justice Lewis was so impressed that he is
going to be doing an article in the Florida Bar News, and she is requesting permission to
reprint it in our Community Newspaper.
5E. Add-On:
Presentation by Fortune International regarding the Beach Renourishment Project.
Action: Ron Choron of Fortune International presented a plaque to the City regarding the
Beach Renourishment Project that was performed at the beginning of the year. This was
38,000 cubic yards of sand spread from Jade Beach up to Golden Corral in a two-month
process with no cost to the taxpayers of Sunny Isles Beach or to the City. It was done
without incident and without complaints. He introduced the Project Manager of Suffix
Construction who was responsible for the project.
City Manager Russo said this was one of the smoothest and safest efforts he has seen by a
construction company and developer in this City. We had a lot of concerns about spreading
sand by truck and excavating between the team of our Police Department,their Construction
Company, the Developer and the people they hired, and Ocean Rescue but it was just an
unbelievably smooth process where the safety of the people on that beach was the main
concern. He has never seen an operation like this work as smooth as this one went and
38,000 cubic yards is quite a bit of sand, and Mr. Choron said it was 3/4's of a mile.
Mayor Edelcup said this was a fine example of what you can do when City government puts
its mind to working partnerships, not only with other governmental agencies, but with the
private enterprise that has been so successful in making Sunny Isles Beach what it is. The
developers in our community have stepped up more than anyone had ever anticipated. It is
so heartening to see when you work together you can accomplish so much more. We
certainly want to thank the people of Jade for thinking of the City and giving us all this
additional sand to make our beach even more pristine and beautiful for us to use. Mr.
Choron noted that the sand came from Lake Okeechobee.
6. ZONING: ZONING HEARINGS ARE QUASI-JUDICIAL PUBLIC HEARINGS.
6A. Request of Jade Signature for the Property Located at 16875 & 16901 Collins Avenue,
for the Following: (Hearing #Z2014-04)
The Applicant is requesting Site Plan Modification of the approved Site Plan to decrease the
number of residential units and the Floor Area Ratio and a modification of the approved front
and side (South) setbacks.
1. Pursuant to Section 265-18 of the City of Sunny Isles Beach Land Development
Regulations, the Applicant is requesting a Site Plan Modification of an approved Site
Plan pursuant to Resolution 13-Z-136 adopted on January 8, 2013. The modified Site
Plan reduces the number of residential units from 223 to 192 units and the overall Floor
Area Ratio from 647,736 square feet to 645,597 square feet.

Action: Mayor Edelcup gave opening remarks on zoning procedures/decorum. City Clerk
Hines read a disclaimer for the Zoning hearing,and administered the oath to witnesses. City
Planner Claudia Hasbun reported that this request includes a decrease in density from 223 to
192 dwelling units. Also it includes a slightly decreased FAR from 647,736 square feet to
645,597 square. They are also decreasing parking spaces from 429 to 422,and an increase of
the front pedestal setback from 49 feet 11 inches to 51 feet 3 inches,as well as a side pedestal
setback from the south side, from 27 feet 8 inches to 42 feet 1 inch. There were also some
minor modifications submitted in the Plans that will not affect the overall design and layout
of the project. All of these modifications are in compliance with the Land Development
Regulations and with the Comprehensive Plan. All the conditions stipulated under the
previous approved site plan will remain in effect if the site plan modification is approved.
Public Speakers: Cliff Schulman, Esq.; Alan E. Krinzman, Esq.
Cliff Schulman,Esq. representing Fortune Development Group, said this is unusual because
he is not asking for anything except to allow him to do less development. When we opened
our sales office we found a phenomenon that the size of units that were built before the 2008
bust were smaller and more numerous in these buildings averaging probably about 1,400 —
1,500 square feet. In the project that you approved in January, we had units averaging 2,750
square feet. Our purchaser said they wanted more, and so we increased the size of our units
with prices running $1,700 to $1,900 a square foot. The units went from an average of 2,750
to about 3,400 square feet. This resulted in a reduction in the number of units, and the
parking spaces for those units also went down. But we still have in excess of 38 spaces an
excess of what the Code requires even with the down zoning of the parking. We increased
our setbacks, and we believe we can even qualify as a minor modification which could have
been administratively approved because under the Code they did not change lot coverage in
setback, height increase or decrease as well as density and intensity. We didn't alter our
request to variance,there is no change in the location of the building itself,there is no increase
in the number of average daily trips. The change does not alter any ingress or egress to the
site, it doesn't substantially decrease the value point of fact increasing the value of the
property. And the change does not result in a material modification or cancellation of any
condition that is not in our approval.
Mr. Schulman presented renderings of the project. He said outlined in deep purple was the
old footprint of the building,and what is in between it now in gray or blue is the new footprint
of the building showing how it was basically brought in. The building is still going to look
the same and he presented that rendering. It is going to be a truly signature building in Sunny
Isles Beach.
Alan Krinzman, Esq. on behalf of the Sands Pointe Condominium Association, said the
Condo Association is not here to take issue with the requested modifications rather it seeks
understanding of the requested modifications and suggested this item be deferred for 30 days.
Mayor Edelcup asked Mr. Krinzman if he had met with the developers and he said no. Mayor
Edelcup said what he is bringing up could be discussed with the developer. We had an
original site plan approved back in January where all these particular issues presumably could
have been brought up, and to bring them up now while we are talking about modifying

something that was already approved and we are modifying it in a smaller capacity, suggests
to him that he has a lot of valid points but at the same time he thinks those are the things that
he should be bringing up with the developer as well as our City Building Official. Certainly
our Building Official is not going to give them a permit to proceed unless he is satisfied with
the engineering drawings and all the technical aspects of building it and so the safeguard is the
City Official. City Attorney Ottinot said prior to meeting tonight, he introduced Mr.
Krinzman to Cliff Schulman in order for him to meet with Mr. Schulman to address some of
his concerns. Additionally he is welcome to meet with him or City Manager Russo or the
Building Official to address his concerns. Mr. Krinsman said this information should be a
matter of public record, and City Attorney Ottinot said anything that is filed with the City is
subject to Florida Public Records Law.
Mayor Edelcup said right now we are approving a concept,and then the developer goes back
and submits all the technical and engineering drawings to the City, and at that time the City
Building Officials get together and either approve or reject the items they see on that technical
plan. City Attorney Ottinot said we can address all these concerns at the appropriate time.
From a zoning perspective, the Commission jurisdiction is whether or not these submitted
plans are consistent with the City's Zoning Code.
Vice Mayor Aelion said as a point of disclosure,he is a resident of Sands Point, the subject
property that has the concerns and was presented before us tonight. It is a matter of public
record that there was an incident many months ago that created a situation where the
construction site was a reason for concern by the Association at Sands Point. To that end he
understands the position of the attorney presenting those concerns before us tonight. He
believes they are valid and should be followed through.
Commissioner Gatto moved and Commissioner Levin seconded a motion for approval,
subject to staff conditions. Resolution No. 14-Z-139 was adopted by a roll call vote of 3-
1-1 [Vice Mayor Aelion against; Commissioner Scholl absent] in favor.

7. ORDINANCES FOR FIRST READING
7A. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending
Chapter 62 of the Code of Ordinances to Clarify that Purchases in Excess of$25,000.00
for Utilities Shall be Administratively Approved in the Adopted Fiscal Year Budget and
Are Not Subject to the Requirements of Chapter 62 Unless Required by the City
Commission; Providing for Severability; Providing for Inclusion in the Code;Providing for
Repeal of Conflicting Provisions; Providing for an Effective Date.
Action: City Clerk Hines read the title, and Deputy City Attorney Amuchastegui reported
that currently all purchases in excess of$25,000 require City Commission approval,and the
intent of this Ordinance is to clarify utility purchases in excess of $25,000 shall be

administratively approved in the adopted fiscal year budget. This Ordinance also expands
the definition of utilities to include electrical, water, natural gas, and telecommunication
services.

7B. An Ordinance of the City Commission of the City of Sunny Isles Beach, Florida,Amending
Chapter 256 of the Code of Ordinances to Prohibit the Use of Skateboards Along Collins
Avenue and Sunny Isles Boulevard; Providing for Legislative Intent; Providing for
Severability; Providing for Inclusion in the Code; Providing for Repealer; Providing for an
Effective Date.
Action:City Clerk Hines read the title,and City Attorney Ottinot reported that he conducted
research on this item,and the first thing he did was to check with former City Commissioner
Danny Iglesias of FDOT to determine if we had authority to ban skateboarding on Collins
Avenue as it is a State road. Former Commissioner Iglesias said it was okay. He also
checked with the General Counsel of DERM who also said it was okay. After that he
conducted a research of other municipalities to see if they have done a similar Ordinance
banning skateboarding, and they had.

Mayor Edelcup said this issue came up at the last Commission meeting because some
residents were injured as a result of skateboarders on the main thoroughfares. At the end of
that Commission meeting it was the consensus of the Commission to put together an
ordinance that would try to balance the needs of our youth as well as our elderly people in
our City and create a minimal invasion where skateboarding could no longer take place. It
was decided by the Management and Commission to concentrate primarily on Sunny Isles
Boulevard and Collins Avenue which are the only two (2) streets we are proposing in this
Ordinance to be banned from skateboarding which leaves the rest of the side streets of the
City for skateboarding. There have also been some suggestions to change the monetary fines
that this Ordinance is proposing and limit it strictly to a public service contribution on behalf
of anyone charged with skating in the wrong location. Basically he knows this is a hot topic
with many of our residents, and he knows many young residents are here who are
skateboarders. He noted that we do have a Skateboard Park, and we do have all the other
streets besides Collins Avenue and Sunny Isles Boulevard that would permit the continuation
of skateboarding including getting to the Skateboard Park. He asked City Manager Russo to
expand on the revisions of the Ordinance.

City Manager Russo said we have gone over the whole gambit of possible penalties and as
the City Attorney pointed out that is the policy decision aspect of this that we have to work
with. In the final analysis and in checking with one of the communities that have this,and it
seemed to him if we were going to have any kind of penalty it should be one that is: 1)
manageable; and 2) has some nexus to our streets in our community and keeping them in
order. Therefore if we are going to do any level of community service he would limit it to
community service in the Public Works area which is more of a meaningful penalty and it is
community service work which is a positive aspect of a penalty for something that pretty
much effects the youth in our community,for things like pick up litter,getting chewing gum
off the sidewalk, etc. Mayor Edelcup said that is a good revision because he doesn't think
any of us wanted to monetarily impact any child or student who is skateboarding where they
should not be. But on the same token there has to be some sort of penalty and community
service working for Public Works may be the right solution. He suggested that this
Ordinance be modified to reflect that, and that the deletion take place for any monetary. He
also would suggest that we have a section in the Ordinance that requires the City to have an
educational program take place before the Ordinance becomes effective. That educational
program could take place at the Sunny Isles Beach Norman S. Edelcup K-8 School where all
the students would have the opportunity to have this explained to them so that everyone
understands before the Ordinance goes into effect. Mayor Edelcup opened the public
hearing for speakers.
Police Chief Fred Maas said he wants to ensure that the students that are here tonight and
who live in the City, he wants them to be fully aware that the Police Department is tasked
with the safety of all people in the City. The Police Department does not make the laws,it is
their job to enforce the laws that are made by the Legislative branch or in this case, the
municipalities. We may or may not agree with a particular piece of legislation but we are
tasked with carrying it out,however,a police officer does maintain the discretion as to when
they have someone stopped for a violation as to whether they enforce it,give them a break,or
choose some other alternative measure of enforcement. There are inherent difficulties with
the intended enforcement of this particular piece of legislation or municipal ordinance. It is
our goal to work with you on that and to iron out some of these differences yet with safety in
mind. He strongly suggested that the Police Department in conjunction with members of the
Student Government, as well as many of you who are skateboarders, to sit down in a round
table discussion and come up with alternative methods as opposed to direct enforcement
including an educational awareness campaign,presentation of flyers,getting others to do the
right thing because in many cases he thinks it is a matter of courtesy vs. discourtesy that
results in these safety situations. You know yourselves that people on bicycles or on
skateboards when they are approaching or overtaking someone from behind are often times
startled regardless of their age but especially with the elderly when someone goes flying by
them at break neck speed. Once again he wants to remind you that the Police Department's
position and every officer here is to protect the safety of everyone regardless of their age,the
elderly, the middle aged, the children, and the youngest ones who are in strollers or maybe
walking as toddlers along with their parents. He really thinks we can do more than to jump
to an enforcement program that does not serve to benefit the officers who will be unpopular,
who really don't want to write these pieces of legislation because he believes that would be
selective enforcement when we stop to write one skateboarder a violation and six more

happen to go by on their skateboards and cannot be stopped by the police officer. He really
urges that we sit down in a round table discussion and work together and come up with a
program that is designed for safety as opposed to penalty and it is his belief that we can do
this. He will be the first one in leading the charge in making the contacts and bringing us all
together to promote a safe resolution to this issue.
Vice Mayor Aelion said based on what was discussed at the Workshop and he was impressed
with what we just heard from our youth, he thinks that limiting the use of skateboards is
something that becomes an opinion of how to use our sidewalks for the comfort of all
concerned. Instruments like skateboards and bicycles, etc. have intended venues. The City
built the Skateboard Park for that particular reason and so that should be the use and the
place for such purposes. Ironically since the Skateboard Park was built he believes there was
an increase not only was there a store opened at the RK Center as a result of this because of
the increase of youth. He is more concerned with the education of our children, in other
words, the awareness has to be self disciplined and practicing whatever they do especially
skateboarding on our streets. To impose an ordinance for no skateboarding on our streets
may be, first it may not be enforceable, and if it is, it would only create, like the Chief said,
they would catch one and six others will pass by. Instead of concentrating on passing this
ordinance preventing the youth,he thinks a regular awareness like we do for drug prevention
awareness that we have in the schools, to have programs perhaps in the City's Cultural and
Community Services program,basically programs to make our children aware of the dangers
of using skateboards. So he is not on board passing this ordinance.
Commissioner Gatto said she wishes some of the skaters could have attended last month's
Commission meeting when a elderly woman got up and described how she got hit and had
black and blue on her leg for a lengthy time, and another woman came up who also
experienced something with a bicycle which is not the issue tonight. Collins Avenue is very
skinny to begin with and so it is an issue that we have to deal with. The reason we are even
having this conversation is for the reason she got hit and she thinks that skateboarding is an
exciting sport and we built the Park specifically for kids to skate in the Park and keep them
off the streets. It seems now that she is hearing that you are using them to go shopping and
as transportation across the City. It has kind of morphed into this gigantic thing that is out of
control. That being said, she does not know what the happy medium is. She is somewhat
leaning towards the ban on Collins Avenue and on Sunny Isles Boulevard. She thinks
enforcing any kind of fine or community service,etc.,is going to be difficult. She wishes the
skaters would be more cautious in their activities when you see people in front of you or
behind you and you are shooting by because they can have all that fun in the Skate Park
which is the reason it was built to begin with.
Commissioner Levin said the sidewalks are there for people to walk on, and so we have to
put the pedestrians first. Then the sidewalks have to be shared with the bicyclists, the
bicyclists can ride in the street, but then putting them on Collins Avenue, there is really no
where for them to go if a car is coming along because you have the curb along the right side
of the street and they are supposed to ride in the right lane. Then you have the skateboarders
and so she thinks if you are going to regulate any of the three,the safest way to regulate it is
by regulating the skateboarders. It hasn't happened yet, if you are on a skateboard,you could
very easily lose control under your own power or by running into somebody and you could

end up in the middle of Collins Avenue on your skateboard. In regard to enforcing the
Ordinance, she agrees that it would be difficult to do but she thinks if we do lean towards
community service,that it should be something that is educational and that you are going to
learn from about volunteering and giving back. By giving up your time or being forced to
give up your time to do something for some is penalty enough without having to work in the
Public Works domain. She will challenge you to think of other routes because the truth of
the matter is you can skate all behind Collins Avenue and there is only a couple of places
where you would have to pick up your skateboard and walk along Collins Avenue down by
Town Center Park and Walgreens,you can't go through because of the canal,and maybe by
the Publix because North Bay Road doesn't go all the way through. It is basically a
challenge to reroute yourself and you can still get around on your skateboards and do what
you need to do.
Mayor Edelcup said with that he would mention that with the building of the emergency
bridge along North Bay Road you would be able to get to 172nd Street and come up 172nd
Street without ever having to go on Collins Avenue. As you can tell,this is a difficult topic
for the Commission to handle because we are trying to balance the fairness for all of our
residents and tourists,young and old. At the same time make sure that the health and safety
of all of our people are well protected. We all recognize that it is difficult to enforce but
being difficult doesn't necessarily mean it can't be, and if we always chose not to do the
difficult things we wouldn't be here today. It was difficult to build the City but we decided
to go ahead and do that and it changed a lot of the ordinances and it changed the complexion
of this City from a retirement community to a community that we have here today with a lot
of children. In fact when we became a City there were 1/10`11 the number of children that are
there today, and so we had a lot of difficult situations there to overcome.
Mayor Edelcup said he heard the Vice Mayor talk about awareness but awareness doesn't
necessarily resolve the issue because you can teach all you want about being careful in
skateboarding but that doesn't take care of the problem that a skateboard is a difficult
instrument to control when people are walking down busy streets like Collins Avenue or
Sunny Isles Boulevard. And so he believes our Ordinance should have the awareness and
teaching program because that is true on the side streets as well because we don't want
people hit on the side streets either. But at the same token, there is less pedestrian traffic on
those streets, more room and less opportunity for a significant accident to occur. It is
unfortunate that we don't have the same people here tonight that were here last month as
Commissioner Gatto mentioned to talk about the serious incidents that did occur. The way
this Ordinance is being proposed is that it is compromise,it doesn't ban skateboarding in the
City, it bans skateboarding on two streets of the City which probably represents less than
10% of all the streets in our City if you were to measure the length of all of our streets, and
we do have a Skateboard Park for you to use your skateboards in.
Mayor Edelcup said with all of that said he would still lean towards passing an Ordinance
that provides for an educational program to take place sometime after second reading of the
Ordinance. Once the Ordinance is passed, there would be a quiet period before the
Ordinance went into effect 60 or 90 days to give opportunity for the educational process to
take place. Also to give an opportunity for the City Manager to target in what the penalties
would be,who is going to monitor this situation,find that there is an offense that needs to be

stopped, and if you don't have a penalty, there is no way to stop that offense. And so he
thinks that you have got to have some kind of penalty no matter what. What we are trying to
propose here is a penalty that is not a hardship, it is a penalty that benefits the person, that
benefits the City, and is not an out-of-pocket cost to anyone.
Vice Mayor Aelion said he thinks it is imputative on our youth to encourage them through
the educational program. Chief Maas said the preponderance on those that we would stop
would be juveniles and without parental approval of any penalty of that moving forward,you
would be dealing with the parents because if there is a challenge on any part there is going to
have to be the parents that appear at a custodial meeting and so you may have a punishment
meted out to any juvenile without parental approval. Mayor Edelcup said if a juvenile was
acting in a reckless manner and not on a skateboard, you would have the same problem,
would you not? Chief Maas said absolutely through the court system. If there is a challenge
to the penalty that goes before the Hearing Master the parents would appear.
Commissioner Levin added that we must do the educational program. She did suggest
previously that maybe we should put together a brochure in 3 or 4 different languages to give
to the parents to get them involved in talking to their children about it. Commissioner Gatto
said she would like to propose deferring this to give the Chief an opportunity to think this
through because it seems problematic on his end. Realistically whatever we vote on today
falls on the shoulders of the Police Department and maybe we need to collaborate on it a
little bit more.
Mayor Edelcup said this is first readin g, rather than defer we can pass it on first reading and
this still gives 30 days for the Chief to come back so we really have not lost the time, and
Commissioner Gatto agreed. Commissioner Levin said we can pass this Ordinance and we
can always un-pass the Ordinance later on if we find that it is not working.
City Attorney Ottinot said there were some friendly amendments made: 1) the education
requirement; 2) it won't take effect until 90 days after it is adopted; 3) take away the
monetary penalty; and 4) the penalty would be community service. For clarification
purposes, leave it up to the City Manager as to what form the community service will be.
Commissioner Levin moved and Commissioner Gatto seconded a motion to approve the
proposed Ordinance on first reading,as amended. The motion was approved by a roll
call vote of 3-1-1 (Vice Mayor Aelion against; Commissioner Scholl absent) in favor.

Action: City Clerk Hines read the title,and Assistant City Manager Bill Evans reported that
in 2010 the City pulled out of the contract and direct purchased Safetron Railing. It is unable
to meet the Florida Building Code at this time without additional testing being done. This is
the compressed time testing that it needs to be subjected to UP Light. This testing will
provide us the answer whether it needs it or not, but more importantly it determines the
useful life of this railing. Our Chief Engineer has determined there is no likelihood of failure
in the short term but we want to determine how long this railing system may last. We also
need to close out the Permit and part of that is getting this testing done.

Mayor Edelcup said this is an expensive test. If it doesn't pass the test what is it going to
cost to reclad it? Assistant City Manager Evans said there would not be a need to take it
down and hopefully we would have a four to five year window. And so at that point in time
the opportunity to create a sinking fund for that may potentially be there. The cost of the
railing to install on the Pier was about$247,000. Mayor Edelcup said then that we would be
looking at numbers similar to that to replace it? City Manager Russo said he would suspect
that we would do it differently if we were to replace that railing, it would probably be more.
That would be the worse scenario, once we know what the useful life is, then we would
know. Mayor Edelcup said we are spending$28,000 to find out if the current railing works,
and if it doesn't work then we are looking at something at about a quarter of a million
dollars. City Manager Russo said we have to know if it meets the Code or meets it for only
so many years. Vice Mayor Aelion said he asked at the Workshop as to why this wasn't
done before,placing the clad on,and Assistant City Manager Evans said it was sole sourced,
and he can't answer the question why this type of railing system was chosen,all he can say is
that at this point it meets many of the Building Code requirements for railing systems but this
one bending type of railing test that needs to be done, it does not and there is no backup

testing to support it, and so the test has to be run from a safety standpoint and from a useful
life standpoint. He doesn't see any other way around it.

13A. Discussion by Steven Breakstone regarding Fishing Facilities at the Intracoastal Parks.
Action: Steven Breakstone said he wanted to bring up the possibility of fishing at the two
new parks in Intracoastal Parks. It would be a great enhancement to the City and the cost
would be minimal. He suggested refurbishing the current cement docks that are there,and it
would give the residents the opportunity to fish the Intracoastal rather than the Pier. He said
he was at the Pier last weekend which is well attended by many fishermen who have not
really caught a lot of fish. He has personally fished in the Intracoastal and has caught more
fish in the Intracoastal than those who fish from the Pier.
Mayor Edelcup said it is certainly an interesting concept and something that the Commission
can think about while we are doing our Capital Budget this summer and see what kind of
thoughts we can come up with. Another suggestion has been to perhaps permit sailboats to
dock there on the Intracoastal side, and so we have a couple of things to look at. But he
thinks it is another great idea that we can put in the hopper for the Commission to consider.
Mayor Edelcup said there is no parking at that Park. Mr. Breakstone said there is an existing
wood dock on the north side of the Intracoastal Park. That dock can be refurbished at
minimal costs. It would be a cost effective way to give our residents more activities in the
City. Mayor Edelcup thanked him for the idea and he is sure that the City Manager will work
on it and present them with something.

Vice Mayor Aelion said there was an article forwarded by Commissioner Gatto regarding the
catch of the fish at Pier Park as one of the best in South Florida. Regardless of what that
said, he does support the fishing at Intracoastal Parks idea.
Mayor Edelcup said one last item and that is to wish Jane Hines a very happy birthday!
