HomeMy WebLinkAboutReso 2014-2253RESOLUTION NO. 2014- ���j 3 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RANKING THE SUBMITTALS FOR THE DESIGN, BUILD OUT, OPERATION, AND LEASE OF A RESTAURANT FACILITY AT GATEWAY PARK (RFP NO. 14- 02 -02) AND AUTHORIZING THE CITY MANAGER TO BEGIN NEGOTIATIONS WITH PASSION RESTAURANT GROUP — "FLY ME TO THE MOON ", THE 1st RANKED PROPOSER; AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City issued Request for Proposal No. 14- 02 -02, Design, Build Out, Operation, and Lease of a Restaurant Facility at Gateway Park, of which two (2) responses were received; and WHEREAS, with the assistance of the Finance Department, and the Cultural & Community Services Division. the City Manager has evaluated both proposals and met with the proposers in order to obtain a clear understanding of each proposal; and WHEREAS, in reviewing the proposals, City staff and the City Manager carefully reviewed the evaluation criteria outlined in Section 4 ( "Evaluation Process ") of RFP No. 14 -02- 02 as well as Section 62 -8 ( "Award ") of the City Code in evaluating the proposals; and WHEREAS, the general factors to be considered under Section 62 -8 of the City Code include, but are not limited to, 1) the capacity, ability and skill of provider to perform the contract; 2) the character, integrity, reputation, judgment, experience and efficiency of the provider; and 3) the quality of performance of their previous contracts, among other factors to be considered; and WHEREAS, under Section 4 of RFP No. 14- 02 -02, the specific evaluation criteria include 1) the proposer's financial capacity and ability to build out the facility space and equip it properly to operate a restaurant; 2) relevant experience and qualifications and past performance; 3) relevant experience and qualifications of key personnel; 4) proposer's approach and methodology to provide the services; and 5) the proposed solution functionality, implementation, and other objectives; and WHEREAS, the above review criteria were considered in this evaluation process, including proposed rent, conceptual design, financial viability of the proposers, and foodservice /parking operations; and R2014- Gateway Park Restaurant Authority To Negotiate With Passion Restaurant Group Pagel of 3 WHEREAS, based on these factors as presented in the proposals, the City Manager has ranked the proposers in the following manner: 1) Passion Restaurant Group — "Fly Me To The Moon ". 2) YES Hospitality Group — "The Hurricane Club "; and WHEREAS, pursuant to Section 4.4 of RFP No. 14 -02 -02 the City is authorized to begin negotiating with the 1St ranked Proposer, Passion Restaurant Group — "Fly Me To The Moon ", and if the City and the 1St ranked Proposer cannot reach agreement on a contract, the City reserves the right to terminate negotiations with Passion Restaurant Group and begin negotiating with the 2nd ranked Proposer, YES Hospitality Group — "The Hurricane Club ", until a contract acceptable to the City has been executed and approved by the City Commission. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Authority to begin negotiations with Passion Restaurant Group. The City Commission hereby authorizes the City Manager or his designee to begin negotiations for RFP 14- 02 -02, "Design, Build Out, Operation, and Lease of a Restaurant Facility at Gateway Park ", with the 1St ranked Proposer, Passion Restaurant Group — "Fly Me To The Moon ", and if the City and the 1St ranked Proposer cannot reach agreement on a contract, the City reserves the right to terminate negotiations with Passion Restaurant Group and begin negotiating with the 2nd ranked Proposer, YES Hospitality Group — "The Hurricane Club ", until a contract acceptable to the City has been executed and approved by the City Commission. Section 2. Authorization of City Manager and City Attorney. The City Manager and the City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 3. Russo, City Manager DATE: 6/19/2014 RE: Resolution authorizing the City to begin negotiations with the 1st ranked Proposer for RFP No. 14 -02 -02 ( "The Design, Build Out, Operation and Lease of a Restaurant Facility at Gateway Park ") RECOMMENDATION: It is recommended that the City Commission authorize the City Manager to begin negotiations with the 11t ranked proposer for RFP No. 14 -02 -02 ( "The Design, Build Out, Operation and Lease of a Restaurant Facility at Gateway Park "). REASONS: The City advertised RFP No. 14 -02 -02 for "The Design, Build Out, Operation and Lease of a Restaurant Facility at Gateway Park ". The City received two responses from proposers in response thereto. With the assistance of the Finance Department and the Cultural & Community Services Division, I have evaluated both proposals and met with the proposers in order to obtain a clear understanding of each.
