AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AMENDING CHAPTER 265,
ARTICLE IX, "SIGN REGULATIONS" TO CLARIFY THAT
ELECTRONIC SIGNS ARE PERMITTED IN GOVERNMENT
FACILITIES LOCATED IN THE CITY; PROVIDING FOR
SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE;
PROVIDING FOR REPEAL OF CONFLICTING PROVISIONS; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the purpose of Chapter 265, Article IX, "Sign Regulations" is to regulate all
exterior and interior signs placed for exterior observations so as to protect property values,
promote the attractive character of the community, reduce visual pollution and protect the public
safety in travel and transportation; and
WHEREAS, these sign regulations balance the need to protect the public health, safety,
convenience and general welfare against the need for adequate identification, communication
and advertising; and
WHEREAS, these sign regulations do not specifically authorize the placement of
electronic copy signs at the City's Government Center or at any of the City's parks; and
WHEREAS, after reviewing the proposed recommendations, the City Commission
wishes to amend Chapter 265, Article IX, "Sign Regulations", and allow for electronic signs in
the City's Government Center and certain parks located in the City, in order to facilitate
advertising of City sponsored events and activities, emergency messages, and other
governmental purposes, subject to the following regulations.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific part by this
Ordinance upon adoption hereof
Section 2. Amendment. Chapter 265, Article IX, "Sign Regulations", of the City Code is
amended to read as follows:
§265-58. Supplemental regulations.
B. Changeable copy signs.
4) Notwithstanding any other provisions in Chapter 265 to the contrary,
changeable copy signs shall be permitted in government facilities for the sole
purpose of providing information to the public. The maximum allowable
signage area for each changeable copy sign permitted in this subsection (4) shall
not exceed forty eight(48) square feet in area and shall be wall mounted.
Section 3. Severability. The provisions of this Ordinance are declared to be severable and
if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the validity of the remaining sections,
sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part.
Section 4. Inclusion In The Code. It is the intention of the City Commission, and it is hereby
ordained that the provisions of this Ordinance shall become and made a part of the City of Sunny
Isles Beach Code; that the sections of this Ordinance may be renumbered or re-lettered to
accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other
appropriate word, as required.
Section 5. Repealer. All ordinances or part of ordinances in conflict herewith be and the
same are hereby repealed.
Section 6. Effective Date. This Ordinance shall become effective upon adoption on second
reading.

RE: Ordinance Amending Chapter 265 Article IX, "Sign Regulations"
RECOMMENDATION:
This Ordinance is presented for your consideration.
REASONS:
The purpose of this Ordinance is to permit electronic-signs in government
facilities located in the City. Currently, the City's sign regulations do not
specifically authorize the placement of electronic copy signs in government
facilities.
The City wishes to amend Chapter 265, Article IX, "Sign Regulations", and allow
for electronic signs in the City Facilities located in the City, in order to facilitate
advertising of City sponsored events and activities, emergency messages, and
other governmental purposes.
ADDITIONAL INFORMATION:
This Ordinance was requested by the City Manager's Office.
