HomeMy WebLinkAboutReso 2021-3250RESOLUTION NO. 2021- J`�o A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, EXPRESSING SUPPORT FOR SENATE BILL 224 AND HOUSE BILL 105 WHICH WOULD ALLOW LOCAL GOVERNMENTS TO REGULATE SMOKING IN PARKS AND ON BEACHES; URGING THE FLORIDA LEGISLATURE AND GOVERNOR RON DESANTIS TO SUPPORT AND APPROVE THE LEGISLATION; DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, during the 2021 Legislative Session of the State of Florida, Senator Gruters and Representatives Altman, Fine, LaMarca, and Tant sponsored Senate Bill 224 and House Bill 105, respectively, which would allow local governments to regulate smoking in parks and on beaches; and WHEREAS, according to United States Center for Disease Control ("CDC"), the combination of smoke from the burning of tobacco products and the smoked exhaled from the smoker, referred to as secondhand smoke, exposes nonsmokers to thousands of chemicals, hundreds of which are toxic and 70 known to cause cancer; and WHEREAS, as of 2018, nearly 14 of every 100 (14.0%) U.S. adults aged 18 years or older currently smoke cigarettes; and WHEREAS, according to the CDC, there is no risk-free level of secondhand smoke exposure, as even brief exposure can be harmful to one's health; and WHEREAS, approximately 2.5 million nonsmokers have died from health-related illnesses caused by exposure to secondhand smoke since 1964; and WHEREAS, prohibiting tobacco products that cause harmful smoke prevents potential exposure to toxic and cancerous chemicals, as detailed here; and WHEREAS, according to the Ocean Conservancy, cigarette butts and food wrappers are the most common waste items on beaches; and WHEREAS, the City of Sunny Isles Beach ("City") affirms its belief that the decision of whether smoking should be allowed in city parks and beaches is most appropriately determined at the local level; and WHEREAS, the City Commission of the City of Sunny Isles Beach finds that the passage of the aforementioned bills is in the best interest of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: @BCL@700CF432.docx Page 1 of 2 Section 1. Support of Senate Bill 224 and House Bill 105. The City Commission hereby expresses support for Senate Bill 224 and House Bill 105, and urges the Florida Legislature to adopt, and Governor Ron DeSantis to support and approve, the bills. Section 2. Directions to the City Clerk. The City Clerk is hereby directed to distribute copies of this Resolution to Senator Gruters, Representatives Altman, Fine, LaMarca, and Tant, Governor Ron DeSantis, the Speaker of the Florida House of Representatives, the President of the Florida Senate, the Florida League of Cities, and the Miami -Dade League of Cities. Section 3. Effective Date. This Resolution shall become effective upon adoption. PASSED AND ADOPTED on this 211t day of cto r 2021. REASONS: Florida Senator Joe Gruters and House Representative Thad Altman have filed Senate Bill 224 an, House Bill 105, respectively, for consideration by the Florida Legislature which would allow local governments to regulate smoking in public parks and beaches. As a local government, we believe that the decision of whether smoking should be allowed in city parks and beaches is most appropriately determined at the local level.
