A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, APPROVING THE APPLICATION FOR VARIANCE (APPLICATION NO.
PZ2021-20) SUBMITTED BY LE MAISONNEUVE CONDOMINIUM ASSOCIATION
(THE "APPLICANT") TO ALLOW TWO (2) MONUMENT SIGNS, WHERE ONLY ONE
(1) IS ALLOWED PER SECTION §265-55(A); PROVIDING THE CITY MANAGER WITH
THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Le Maisonneuve Condominium Association (the "Applicant") submitted a
zoning variance application, numbered PZ2021-20 (the "Application"), to the City of Sunny Isles
Beach, Florida ("City") requesting the following:
Pursuant to Section §265.63.1 of the City of Sunny Isles Beach Land Development
Regulations, the Applicant is requesting a sign variance approval for an increase in
the maximum number of monument signs to allow two (2) monument signs on
the same street frontage, where only one (1) is allowed per Section §265-55(A).
LEGAL: Tract "A", LE MAISONNEUVE , according to the plat thereof, recorded in
Plat Book 143, Page 10, of the Public Records of Miami -Dade County,
Florida.
ADDRESS: 17700 North Bay Road
WHEREAS, the public hearing of the City Commission was advertised and held as
required by law, all interested parties concerned in the matter were heard, and due and proper
consideration was given to the matter and to the information contained in the City's
Development Services Department Development Review Report; and
WHEREAS, notice was provided to all interested parties regarding the Application; and
WHEREAS, on January 20, 2022, the City Commission conducted a public hearing on the
Application; and
WHEREAS, the City Commission reviewed the Application, the written and oral
recommendations of the Development Services Department and finds that the Application does
meet the criteria for variance under the Land Development Regulations and the Comprehensive
Master Plan of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and
confirmed as being true and the same are hereby made part of this Resolution.

Section 2. Findings and Conclusions. Based upon an analysis of the application and the
standards for approval for a variance under the Land Development Regulations and the
Comprehensive Master Plan of the City, the City Commission makes the following findings and
conclusions:
The application for the following:
a sign variance approval for an increase in the maximum number of monument
signs to allow two (2) monument signs on the same street frontage, where only
one (1) is allowed per Section §265-55(A)
is consistent with the City's Land Development Regulations, and the Applicant did present
competent and substantial evidence that all of the criteria set forth in Section 265-63.1of
the City's Land Development Regulations were met.
Section 3. Approval. The Applicant's request for approval of the following:
a sign variance to increase the maximum number of monument signs allowed to
two (2) monument signs on the same street frontage, where only one (1) is
allowed per Section §265-55(A)
is hereby APPROVED.
Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this
Resolution is, for any reason, held invalid or unconstitutional by any Court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provisions and
such holding shall not affect the validity of the remaining potions of this Resolution.
Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and
are hereby repealed.
Section 7. Effective Date. This Resolution shall become effective upon adoption.

Land Use: Medium to High Density Residential
This category is generally characterized by mid to high-rise multifamily
developments (apartments), ancillary convenience retail services
serving the principal residential use, utilities, communications,
community and recreation facilities and schools serving the
surrounding residential area. The height of buildings, and, therefore,
the attainment of densities approaching the maximum, depends to a
great extent on the dimensions of the site conditions such as location
and availability of services, ability to provide sufficient off-street
parking, and the compatibility with and impact of the development on
surrounding areas.
Zoning: Medium- High Density Multifamily
The Medium - High Density Multifamily Residential (RMF -2) District
provides for single-family, duplex, townhouse, medium -density and
high-density residential development of multifamily dwellings at a
maximum density of 60 dwelling units per net acre consistent with the
City's Comprehensive Plan Land Use Element and the corresponding
Medium - High Density Residential land use category. The uses within
this district shall be consistent with but may be more restrictive than
the Medium - High Density Residential Land Use category permitted
uses.
Background: According to Miami -Dade County records, the property was built in
1994 with 76 condominium units. In addition, the address assigned to
the building (17700 N Bay Rd) since its construction is lower than the
property to the south (17720 N Bay Rd).

IV. PLANNING REVIEW:
1. Comprehensive Plan
The proposed application is consistent with the City of Sunny Isles Beach
Comprehensive Plan.
V. ZONING REVIEW
The plans reviewed are on file and may be examined in the City Clerk's Office. The plans
are entitled "Drawings", prepared by Adwave Graphics Inc, stamped received November
30th, 2021, consisting of 1 sheet and "Sketch of Boundary Survey" prepared by ECS Land
Surveyors, Inc. stamped received November 30th, 2021, consisting of 1 sheet. Plans are
subject to revisions -based on comments provided by zoning staff of the City of Sunny Isles
Beach.
1. §265-55 — Residential permanent signs.
§265-56 (A) — Development identification sign. Variance requested*
1. §265-56 (A)(3) — Maximum Number. Does not comply (*)
Allowed: One monument sign per street frontage, indicating the
name and address of complex. Notwithstanding the
foregoing, a wall sign is permitted in lieu of a monument
sign.
Proposed: Two signs on existing monument wall structures, on the
same street frontage, indicating the name of the
complex.
2. §265-56 (A)(4) — Maximum sign area. Does not comply (*)
Allowed: 48 square feet
Proposed: Two 36 square foot back -lit channel letter signs on
existing wall structures.

EXTERNALLY ILLUMINATED SIGN —Any sign illuminated by
shielded electric lights (including reverse channel lighting and back-
lighting), which are not part of the sign. All externally illuminated
signs shall have the illumination device fully screened from view.
Proposed: Back -lit channel letter signs on existing wall structures.
2. § 265-63.1 Sign Ordinance Variance
§ 265-63.1(C) Review by the City Commission. The application for a variance
may be granted if the City Commission finds:
(1) The variance is not contrary to the public interest;
(2) Special conditions and circumstances do not result from actions of the applicant;
(3) A literal enforcement of the provisions of this chapter may result in unnecessary
hardship.
Comments: See attached Letter of Intent date stamped October 27th, 2021 and
addendum letter date stamp received November 22nd, 2021 for responses.
VI. STAFF FINAL ANALYSIS
Based on the above review, the application is complete and consistent with the City's
Comprehensive Plan and generally consistent with the City's Land Development
Regulations. The variance standards pursuant to Section 265-63.1(C) of the City Code
have been met and the proposed signage is minimal.
Staff has reviewed the variance application and is submitting this application for your
review with the following conditions stipulated below.
VII. CONDITIONS
If the City Commission approves this application, the application will be subject to the
following conditions.
Conditions to be completed before demolition, below grade or building permits are
issued:
(1) That the plans in the approval be substantially in accordance with that submitted for
public hearing, which are entitled "Drawings", prepared by Adwave Graphics Inc,
stamped received November 30th, 2021, consisting of 1 sheet and "Sketch of Boundary
Survey" prepared by ECS Land Surveyors, Inc. stamped received November 30th, 2021,

consisting of 1 sheet. Plans are subject to revisions -based comments provided by zoning
staff of the City of Sunny Isles Beach. Plans may be modified at public hearing.
(2) Upon the submittal of an application for a building permit, the plans submitted shall be
approved by the Development Services Department and be consistent with the specific
plan approved by the City Commission. Plans shall include all the required elements of
the site plan pursuant to the City's Land Development Regulations and
recommendations. Should compliance with recommendations result in a change that
would not be considered "minor" in accordance with Section 265-18 of the City Code, the
Applicant shall be required to obtain another approval by the City Commission.
(3) That the approved plan shall remain valid for a period of 24 -months from the date of the
site plan modification approval. If no building permit is issued within the 24 -month time
period, the site plan shall be considered null and void and of no force and effect.
(4) That the Applicant complies with all City Ordinances, County, State and Federal Laws
and Regulations applicable to development and permit approvals.

RESPONSIBILITIES OF THE APPLICANT
PLEASE READ CAREFULLY BEFORE SIGNING
1 hereby acknowledge that I am aware of the preliminary review of plans of the proposed project by
the Department of Environmental Protection (DEP), and/or the Department of Environmental
Resources Management (DERM), the Florida Department of Transportation (FDOT). In addition,
the Miami -Dade County Fire Department (MDFD) for the staging area of the proposed project along
with the Miami -Dade County Biscayne Bay Shoreline Development Review Committee will review
and comment for approval all development applications. These comments sometimes include
requirements for an additional public hearing before (DERM) and the Environmental Quality
Control Board, (EQCB) in the preparation and execution of agreements to run with the land, which
are recorded, prior to obtaining a building permit.
I understand that is my responsibilities as the applicant or applicants representative to promptly
follow through with the compliance of DEP, DERM, MDFD, and /or Florida Department of
Transportation FDOT requirements or to advise this office in writing if the application will not go
forward and may be considered withdrawn. Contact with the above-mentioned agencies is advised
during the hearing process.
Permit requirements: I also understand that the Florida Building Code, DEP, DERM, MDFD, and
/or Florida Department of Transportation FDOT may contain requirements that affect my ability to
obtain a required building permit for my project, even if the zoning application is approved at public
hearing. I am aware that a Building Permit is required for all construction and that I am responsible
for obtaining the required permit, all required inspections, the Certificate of Use and Occupancy or
Certificate of Completion for any and all structures and additions whether proposed or existing
without permits. Additionally 1 am aware a Certificate of Use and Occupancy must be obtained for

My name is Joel Guerin I am the general manager and maintenance manager of le Maisonneuve
we are presently under going the restoration and painting of our building in which we hired S & D
engineers and Mayga construction to do the restoration and painting we also hired Frangois Maclellan
from elite American builders as advisors for the work we now hired Adwave Graphics Inc for our new
signage , the plan we're issued and denied by zoning due to new building code, only allowing 48 square
feet of signage only.
This letter is for a request of allowing us to allow us to have 72 square feet of signage which is in 2
sections of 36 square feet per signage for our 2 wall that are at the entrance of our driveway one facing
north and the other facing south Le Maisonneuve has been painted on both walls with a spot light on
the ground facing the signage, this variance is for 2"raise letter and led light as per plan attached we
feel that it will be better looking and also safer, electrical wise we won't need electric on the ground in
which when heavy rain we have our spot light under water and also our address is 17700 and south of
us is 17720 when we give our address to anyone they are looking south of 17720 in which it should be
north of us but it is youth of us and make it difficult for someone new to find us especially when our
number are at our canopy level, so the new signage will make easier for anyone to come if you arrive
from the north the signage Will be visible on the south wall and coming from the south it will be visible
on the north wall in which does create a safer drive coming into our property, it will be a better
appearance also.
As with respect to you we are asking to consider our variance request and allow the signage to be done
on both walls so that we may finalize this and continue on future restoration. On behalf of myself and

Addendum #1
Le Maisonneuve condominium has have 2 walls for our signage in painting and spot light since the
construction in 1994, we rely on the 2 walls for visitors and delivering on how easy to locate us, so
having 1 wall with signage would not be ecstatically nice, for this reason we are requesting both walls
done, we believe that the public would actually give a positive attitude knowing that both walls are
done, but having 1 wall would give them a negative outlook knowing that we have 2 walls we probably
would be known as cheap, but would not be the reason because our intention is to improve our look
and keep our property attractive.
Addendum #2
Le Maisonneuve Condominium home number is 17700 and because of our address number which is not
visible from the street because it's up by our overhang at the entrance many delivery and visitors can't
find us due to 17720 is south of us in which it should actually be north of us, also our number are not
visible from the street unless you would literally stop and look in which create traffic congestion so
having the signage especially at night with the led lighting would make it much easier to read. Putting
regular spot light in this area is an issue because this area is frequently flooded when we have strong
rain and cause electrical problem.

The condominium association recommended the owner that when receiving delivery or having guests
come over by giving them not only the address but especially the name Le Maisonneuve it is much
easier to find us especially when coming from the north on North Bay Road and if our signage would be
on the north wall they would actually pass us especially when our number are not visible from North Bay
Road, but if on the south wall they would see our signage during the day and night because of our led
lights and the same would happen coming from the south on north bay road if we would put our
signage on the south wall only they would pass us so by having the signage on both walls it would make
easier and also ecstatically look beautiful and much safer for anyone coming by not making sudden stop
if they would happen to see our condominium number. As you know that le Maisonneuve
condominiums has presently restored the building prior to 40 years inspection in order to keep the
building well maintained and energy efficiency by changing our lighting to led and beautifying the area
by upgrading our colors to make it more attractive so we ask that by allowing us to have our 2 walls
signage would be a great improvement driving on north bay road north or south again thank for your
time and concern over this variance

NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Commission of the City of Sunny
Isles Beach, Florida, in the David P. Samson Commission Chambers, Sunny Isles Beach Government Center, 18070
Collins Avenue, Sunny Isles Beach, Florida on Thursday, January 20", 2022, at 6:30 p.m., to consider the
following Zoning application:
Application: Signage Variance for Le Maisonneuve- Le Maisonneuve Condominium Association
("Applicant")

Summary: The Applicant is seeking a sign variance pursuant to Section §265-63.1 of the City of Sunny Isles Beach
Code of Ordinances to increase the number of monument signs, to allow two (2) monument signs, where only one
(1) is allowed per Section §265-55(A). Specifically, the Applicant is requesting two 36 square foot back -lit channel
letter signs on existing wall structures.
Requests:
1. Pursuant to Section §265.63.1 of the City of Sunny Isles Beach Land Development Regulations, the
Applicant is requesting a sign variance approval for an increase in the maximum number of
monument signs to allow two (2) monument signs on the same street frontage, where only one (1) is
allowed per Section §265-55(A).
The plans reviewed are on file, and may be examined, in the City Clerk's Office and are entitled "Drawings",
prepared by Adwave Graphics Inc,. stamped received November 30", 2021, consisting of 1 sheet and "Sketch of
Boundary Survey" prepared by ECS Land Surveyors, Inc. stamped received November 30', 2021, consisting of 1
sheet. Plans are subject to revisions based on comments provided by zoning staff of the City of Sunny Isles Beach.
Plans are subject to modification.
Legal: Tract "A", LE MAISONNEUVE , according to the plat thereof, recorded in Plat Book 143, Page 10, of the
Public Records of Miami -Dade County, Florida.
