A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE
FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF A
MARINE PATROL VESSEL, AND POLICE TRAINING, EQUIPMENT, AND COMMUNITY
EVENTS, IN AN AMOUNT NOT TO EXCEED THREE HUNDRED FIFTY-NINE
THOUSAND SIX HUNDRED SIXTY-NINE DOLLARS AND NINE CENTS ($359,669.09),
ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of
Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds
from the established Department of Justice ("DOJ") federal forfeiture account, for the approved
programs or purchases intended to enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification
that the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in
compliance with the aforementioned legal requirements for the purchase of a marine patrol
vessel, and police training, equipment, and community events, in an amount not to exceed Three
Hundred Fifty -Nine Thousand Six Hundred Sixty -Nine Dollars and Nine Cents ($359,669.09),
attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached
certification, the Chief of Police is hereby authorized to spend up to Three Hundred Fifty -Nine
Thousand Six Hundred Sixty -Nine Dollars and Nine Cents ($359,669.09), attached hereto as Exhibit
"A", from the established Department of Justice federal forfeitures account for the purchase of a
marine patrol vessel, and police training, equipment, and community events.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

RE: Approval to Expend Partial Forfeiture Funds on Deposit from the
Department of Justice

It is recommended that the City Commission approve the expenditure of partial forfeiture funds (DOJ
previously awarded to the Police Department as the result of investigative participation in forfeiture
and seizure cases.
REASONS:
The use of these funds will allow the police department to purchase equipment that will assist in
operations. The marine patrol vessel was purchased in 2007 and due to high repair costs and
antiquated technology is in need of replacement. We are seeking approval to purchase a new vessel
from Metal Shark for an amount not to exceed $311,330.09 which will allow our marine patrol unit to
more effectively patrol our waterways. The police department is also seeking approval to purchase six
tactical ballistic shields for use by our Police Supervisors in an amount not to exceed $18,720.00. The
shields can be used to safeguard officers who are exposed in dangerous situations. The purchase of
these six shields will supplement our current stock and give every uniform patrol supervisor a ballistic
shield. In an effort to modernize police operations the police department is seeking approval to
purchase Apple iPads and relevant accessories for police supervisors and detectives in an amount not
to exceed $16,119.00. The iPads will allow the supervisors and detectives to work more efficiently and
provide a host of benefits to include evidence collection, improved communication, optimizing the
dissemination of police paperwork, and limiting the use of paper as we aim to move toward more
environmentally sustainable practices. The police department has always made great effort in being a
presence in the community. As of late, the police department has engaged the community in many
events and is seeking approval to purchase giveaway items for these events in an amount not to

exceed $7,500.00. Lastly the police department has had the goal of training every officer in "active
shooter/hostile emergency response" training . We are seeking approval to acquire the services of
subject matter expert Jose Ramirez, who has trained our officers previously, to train six of our most
recently hired officers to achieve our goal. The amount spent on this training will not exceed
$6,000.00.
ADDITIONAL INFORMATION:
One of the benefits of participating in and providing personnel into high intensity narcotics
investigations is the sharing of confiscated proceeds for the enhancement of law enforcement. All of
the attached items are authorized expenditures and are designated towards charitable ,and crime
prevention programs, enhancement of law enforcement equipment as well as legal costs associated
with the asset forfeiture process.
FUNDING SOURCE:
Funds have been appropriated in account no. 600-3-5210-XXXXXX-XXXXX.
