ST, SUNNY ISLES BEACH, FL 33160 FROM LOW TO MEDIUM DENSITY
RESIDENTIAL TO COMMUNITY FACILITIES; APPROVING THE TRANSMITTAL OF
THE AMENDMENT TO THE DEPARTMENT OF ECONOMIC OPPORTUNITY AND
REVIEWING AGENCIES IN ACCORDANCE WITH SECTION 163.3187, FLORIDA
STATUTES; PROVIDING FOR SEVERABILITY; PROVIDING 'FOR REPEALER;
PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on or about April 4, 2014, Beach Club Acquisitions, LLC ("Beach Club")
submitted an application to the City of Sunny Isles Beach, Florida ("City") requesting approval to
construct a temporary sales center office for the project currently known as Turnberry at the
property located at 215185th Street, Sunny Isles Beach, Florida, and as legally described in Exhibit
"A" (the "Property"), which is approximately 0.672 acres; and
WHEREAS, by Zoning Resolution 14-Z-143 adopted July 31, 2014, the City Commission
approved the Turnberry project, which included an agreement by Beach Club to donate the
Property to the City in exchange for transferable of development rights; and
WHEREAS, on July 29, 2016, pursuant to the aforementioned Resolution, the City
acquired title to the Property and entered into a Triple Net Leaseback Agreement ("Lease") with
Beach Club, whereby Beach Club would continue to utilize the Property; and
WHEREAS, the Lease has since been terminated, and the City has taken possession of the
Property; and
WHEREAS, the City now wishes to utilize the Property as a Community Facility; and
WHEREAS, according to the City's Comprehensive Future Land Use Map ("FLUM") the land use
designation for the Property is Low to Moderate Density Residential; and
WHEREAS, the City intends to change the land use designation of the Property from Low to
Moderate Density Residential to Community Facility; and
WHEREAS, the Sunny Isles Beach Commission, after careful consideration of this matter,
deems it in the best interests of the general welfare of the City and its inhabitants to approve a
small-scale amendment to the FLUM as hereinafter set forth; and
WHEREAS, the proposed FLUM amendment is being submitted concurrently with a
zoning map amendment from "R-TH Moderate Density Townhouse Residential" to "Community
Facilities"; and

WHEREAS, on March 15, 2022, the Mayor and City Commission sitting as the Local
Planning Agency ("LPA") at a properly advertised hearing received testimony and evidence
related to the amendment from stakeholders found that the small-scale comprehensive plan
amendment to the Comprehensive FLUM is consistent with the City's Comprehensive Plan and
provisions of Sec. 163.3187 Florida Statutes; and
WHEREAS, after careful review of the application, staff has determined that this
Application is in compliance with the City's Comprehensive Plan and consistent with Sec.
163.3187 of the Florida Statutes; and
WHEREAS, the City Commission has reviewed the City staff's report, incorporated herein,
which contains data and analysis supporting the FLUM amendment; and
WHEREAS, the City Commission finds that the proposed FLUM amendment is consistent
with the City's Comprehensive Plan and Land Development Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:`
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this Ordinance
upon adoption hereof.
Section 2. Small -Scale Amendment to the Future Land Use Map. The City of Sunny Isles
Beach Future Land Use Map is hereby amended as follows:
The land use designation in the Future Land Use Map for the property located at 215 185
Street, Sunny Isles Beach, Florida 33160, as legally described in Exhibit "A", and graphically
depicted in Exhibit "B", attached hereto and made a part thereof, is changed from "R-TH
Moderate Density Townhouse Residential" to "Community Facilities."
Section 3. Repealer. All ordinances, or parts of ordinances in conflict herewith be, and the
same, are hereby repealed.
Section 4. Severability. If any section, subsection, clause or provision of this Ordinance is
declared invalid or unconstitutional by a court of competent jurisdiction, the remainder shall not
be affected by such invalidity.
Section 5. Transmitta. The City Manager or designee is hereby directed to transmit the City
of Sunny Isles Beach Draft Future Land Use Map Amendments to the State of Florida Department
of Economic Opportunity in accordance with Section 163.3187, Florida Statute, together with the
Memorandum prepared by The Corradino Group.

Section 6. Effective Date. This Ordinance will become effective ten (10) days after adoption
at second reading.

Small Scale Comprehensive Plan Future Land Use Map (FLUM) Amendment
The City has analyzed and prepared a small scale Comprehensive Plan Future Land Use Map (FLUM)
Amendment. The proposed amendment affects only the property located at 215 185 St, Sunny Isles Beach,
FI 33160 with Folio No. 31-2202-006-0010 (the "Property"). The amendment is to modify the Property
FLUM designation of Low to Medium Density Residential to Community Facilities.
The Property
The Property is approximately 29,290 square feet or 0.672 acres. This Property was donated to the City
in accordance to Zoning Resolution No. 14-Z-143 and Resolution No. 2014-2275. Consequently, the City
obtained the deed to the Property on July 29, 2016, legally described under Exhibit "A". The current
condition of the Property includes a one-story trailer of 9,120 sq. ft. and 25 parking spaces.
Analysis
The FLUM amendment is from Low to Medium Density Residential to Community Facilities. The current FLUM
designation allows for residential for up to 13 dwelling per gross acre. The proposed designation to
Community Facilities allows for up to 25 residential care facilities and 2.0 of non-residential FAR.
FROM: 0.672 x 13 = 8 residential units
TO: 0.672 x 25 = 16 residential units
0.672 (29,290) x 2.0 = 58,580 square feet of non-residential FAR
As set forth more particularly below, the Property was donated to the City in exchange for Transfer
Development Rights (TDRs), and is therefore deemed a Sender site. According to the City Comprehensive
Plan and Land Development Regulations, as a result of the above referenced exchange, all private
development rights related to the density and intensity were transferred and severed from the Property,
and the Property is required to be used for a public purpose consistent with the Comprehensive Plan,
specifically Policy 14C. The Comprehensive Plan stipulates and requires that properties in exchange for TDRs
meet and accomplish a public purpose. In this case, Policy 14 C d) specifies uses consistent with the
Comprehensive Plan such as public parks, plazas and/or open space, or other essential public facilities.

The transfer of development rights from privately owned sender sites must result in the
accomplishment of a public purpose that is consistent with the Comprehensive Plan such as the
creation of public parks, plazas and/or open space, the conservation of historic, sensitive
environmental and archeological resources, the protection and enhancement of waterfront public
access corridors not otherwise required by the land development regulation, the erection of public
parking garages to serve the Town Center or the development of public educational facilities and
other essential public facilities. This limitation shall not apply to government site more particularly
described in policy above.

Sender sites shall be dedicated to public ownership or preserve for public purpose through a
conservation easement of other recordable mechanism.
Because the Property's uses are restricted by the Comprehensive Plan policies related to sender sites
under Policy 14 C d), the Property can never be developed to allow for density. Therefore, for the
purpose of this analysis, only the FAR will be analyzed and the potential increase of square footage
will the calculated.
Existing: 9,120 square feet of non-residential
Potential: 58,580 square feet of non-residential
Change: 49,460 square feet increase of non-residential
Level of Services (LOS)
Transportation:
Policy 4K.
Pedestrian Level of Service Standards. The City shall seek to maintain a pedestrian Level of Service Standard
of C or better on all roadways with designated pedestrian facilities in accordance with the flowing
definitions:
LOS C - Adequate for pedestrians, some deficiencies in intersection design, moderate
interactions with motor vehicles;
LOS: C Some deficiencies in intersection design, some gaps, Atlantic Blvd sidewalk and
connection to Collins Ave sidewalk to be completed by approximately the third quarter of 2023.
Policy 5H.
Bicycle Level of Service Standards. The City shall seek to maintain a bicycle Level of Service Standard of C
or better on all roadways with designated bicycle lanes in accordance with the flowing definitions:
LOS C - Appropriate for most riders, some supervision may be required, moderate interaction with motor
vehicles.
LOS: C FDOT completed full Sharrows (term to describe when roadway lanes are shared
by cyclists and motor vehicles) along northbound and southbound Collins Avenue. Further safety
bicycle improvements are under the Golden Shores Underground Project.
Objective 8 — Roadway Concurrency
The City will continue to maintain adequate LOS standards for the transportation system to
coordinate the traffic circulation system with existing and future land uses as shown on the Future
Land Use Map.

8A. Unless exempted under other policies, the adopted concurrency management system shall establish the
following roadway level of service standards (LOS) for the purpose of issuing development orders and
permits:
1. In conformity with Miami -Dade County, the acceptable peak period LOS for all non-FHISS State
and County roads inside the City shall be the following:
a) Where no public mass transit service exists, roadways shall operate at or above LOS E;
b) Where mass transit service having headways of 20 minutes or less is provided within 0.5 mile
distance, roadways shall operate at no greater than 120 -percent of their capacity (LOS E+20);
c) Where extraordinary transit service such as commuter rail or express bus service exists parallel
roadways within 0.5 mile shall operate at no greater than 150 -percent of their capacity (LOSE+50).
2. The adopted level -of -service for all collector roads maintained by the City shall be 120 -percent
of LOS E (LOS E+20), as defined and measured by the methodologies of the FDOT LOS Standards
and Guidelines.
8B. The level -of -service for all local residential roads shall be guided by the recommendation of the Miami -
Dade County Street Closure Traffic Flow Modification Study and adopted policy.
LOS: D in the AM and PM peak periods in the year 2025 conditions and LOS E+20 in the PM peak
period in the year 2045 conditions. See attached Exhibit "B" for the Traffic analysis from Corradino
Group dated February 28, 2021.
Recreation and Open Space
Objective 4
Provide local park recreational facilities at the following Level of Services Standards: 2.75 acres per
thousand population.
Population (2020 — U.S. Census) — 22,342
LOS Standard — 2.75 acres/1,000 residents
Existing Park Acreage — 69.8 Acres
Park Acres required to meet LOS Standard — 61.44 acres
Surplus Parks Remaining — +8.36 acres
Proposed Community Facility to increase recreational facilities, therefore no impact to Recreation
and Open Space Level of Service.

Objective 3 — The City will work with service providers to ensure an adequate level of service for public
facilities to meet both existing and projected needs as identified in the comprehensive plan through
implementation of those projects listed in the Capital Improvements Element. All improvements for
replacement, expansion or increase in capacity of facilities shall conform with the adopted policies of the
comprehensive plan including level of services standards for the facilities.

Schools
The City will coordinate with service providers to ensure that public facility improvements will be
evaluated for funding accordance with the following general criteria:
1) Improvements which are necessary to protect the health, safety and environmental
integrity of the community, consistent with the policies of the [Comprehensive Plan] and
applicable federal, state, and county regulatory requirements.
2) Improvements that are necessary to meet existing deficiencies in capacity or in
performance. These include the retrofit of deteriorating facilities that fail or threaten to
fail to meet health, safety or environmental standards.
3) Improvements that extended service to previously unserved developed areas.
4) Improvements that have been identified in adopted functional plans and address system
details which are beyond the scope of the comprehensive plan for wastewater and
potable water facilities, and are consistent with the goals, objectives and policies of the
comprehensive plan,
5) Cost-effective improvements to expand capacity, maximize operational efficiency, and
increase productivity.
6) Improvements to adapt existing infrastructure or provide new infrastructure that is
resilient to the impacts of potential climate change, including sea level rise, more
frequent floating, higher temperature and more frequent storm events.
Objective 2
The City of Sunny Isles Beach shall coordinate new residential development with the future
availability of public school facilities consistent with the adopted level of service standards for public
school concurrency, to ensure the inclusion of those projects necessary to address existing deficiencies
in the 5 -year schedule of capital improvements, and meet future needs based upon achieving and
maintaining the adopted level of service standards throughout the planning period.
There are no residential units as part of this small-scale amendment. The Property will remain as a
Community Facility as described on City -Initiated Public Hearing Application (PZ2022-02).

1.0 — INTRODUCTION
The Corradino Group was hired on behalf of the City of Sunny Isles Beach to prepare the required traffic
impact statement for a Comprehensive Plan Future Land Use Map (FLUM) Amendment and Official
Zoning Map Amendment that impact one (1) property totaling 0.672 acres. This property is located at 215
185`h Street, Sunny Isles Beach, Florida 33160 and is Folio Number 31-2202-006-0010. The property is
zoned Moderate Density Townhouse Residential (R-TH) with a FLUM designation of Low to Moderate
Density Townhouse. Currently, the existing maximum allowable development intensity for the parcel
includes 13 dwelling units per gross acre, for a total maximum of 8 multi -family residential units. The
current condition of the property includes a one-story small office trailer of 9,120 square feet and 25 parking
spaces as depicted on the site plan provided in Appendix A. The property was donated to the City of Sunny
Isles Beach in accordance to Zoning Resolution No.14-Z-143 and Resolution No.2014-2275. The
amendment proposes to change the Property Official Zoning Map and FLUM designations to Community
Facilities as shown in Figure 1. The proposed designation allows for a maximum 25 residential care
facilities per gross acre, for a total of 16 residential units. The maximum Floor Area Ratio (FAR) for non-
residential uses is 2.0, for a total allowable 58,580 square feet of non-residential. The purpose of this study
is to assess the proposed amendment's impact on the surrounding roadway network.

2.0 -EXISTING CONDITIONS
The property proposed for amendment is located at the northeast corner of the intersection at 185th Street
and Atlantic Boulevard in Sunny Isles Beach, Florida. The site is bordered by 185th Street to the south
Atlantic Boulevard to the west, 186th Street to the north and Collins Avenue/AIA to the east. A copy of the
Project Location Map is depicted in Figure 2.

The study area for this analysis included all major roadways within the vicinity of the amendment. There
was one (1) major roadway within the vicinity of this property that was identified and included in the
roadway segment capacity analysis as shown below:

3.0 -TRAFFIC DATA COLLECTION
To evaluate traffic conditions on the surrounding roadway network, data was gathered from the FDOT
traffic count stations within the vicinity of the amendment along the following roadway segment:
• SR A1A/Collins Avenue, 300'N of NE 172°d Street
Detailed traffic data gathered from the FDOT traffic online system is provided in Appendix B.
4.0 - PROGRAMMED ROADWAY IMPROVEMENTS
The following roadway improvements were identified from the Miami -Dade Transportation Planning
Organization (TPO) Transportation Improvement Program (TIP) and Long Range Transportation Plan
(LRTP) as planned or committed projects in the vicinity of the proposed amendment.
• Congestion Management along SR AIA from SR 907/SW 63 Street to SR 856/William Lehman
Causeway/NW 192 Avenue
o Adopt and implement a Complete Streets Policy
o Improved Safety of Existing Bicycle and Pedestrian Facilities
o Promote Bicycle and Pedestrian Use
Roadway improvement data is included in Appendix C.
5.0 - AMENDMENT TRAFFIC AND TRIP GENERATION
The amendment traffic will be analyzed to determine the impact on the surrounding roadway network based
on the calculated development potential. For the purpose of this analysis, only the FAR portion of the
Community Facility land use will be analyzed since the goal of the City is to maintain the property as a
Community Facility. Therefore, the 5 8,5 80 square feet of non-residential FAR will be used as the proposed
maximum development potential.
Trip generation will be based on information contained in the Institute of Transportation Engineer's (ITE),
Trip Generation Manual, 11th Edition. Land Use Code 712 (Small Office Building) will be used to
determine the existing site generated trips for the sales center currently located on this property. Land Use

The proposed amended property which includes is expected to generate 1,557 net weekday, 97 net morning
peak hour and 126 net evening peak hour trips as summarized in Table 1. A reduction for multimodal use
such as walking, cycling or public transit use has not been applied to be conservative. Trip generation
information is provided in Appendix D.
6.0 - TRIP DISTRIBUTION AND ASSIGNMENT
Project Trip Distribution will be based on cardinal distribution for traffic analysis zone 605 of the Miami

7.0 — ROADWAY SEGMENT CAPACITY ANALYSIS
The amendment's impact on the roadway segment of Collins Avenue/SR AIA was examined for the AM
and PM peak hour during short-term (2025) and long-term (2045) horizon years. The analysis took into
consideration the short-term growth on the area's roadway based on the FDOT historical growth rate
between 2015-2019. The FDOT historical growth rate information is provided in Appendix E. As shown
in Table 3, an annual growth rate of 1.20% was found in this area and will be used for the analysis of the
short-term and long-term impacts.

8.0 - CONCLUSION
The Corradino Group was hired on behalf of the City of Sunny Isles Beach to prepare the required traffic
impact statement for a Comprehensive Plan Future Land Use Map (FLUM) Amendment and Official
Zoning Map Amendment that impact one (1) property totaling 0.672 acres. This property is located at 215
185`h Street, Sunny Isles Beach, Florida 33160 and is Folio Number 31-2202-006-0010. The property is
zoned Moderate Density Townhouse Residential (R-TH) with a FLUM designation of Low to Moderate
Density Townhouse. Currently, the existing maximum allowable development intensity for the parcel
includes 13 dwelling units per gross acre, for a total maximum of 8 multi -family residential units. The
current condition of the property includes a one-story small office trailer of 9,120 square feet and 25 parking
spaces. The property was donated to the City of Sunny Isles Beach in accordance to Zoning Resolution
No. 14-Z-143 and Resolution No.2014-2275. The amendment proposes to change the Property Official
Zoning Map and FLUM designations to Community Facilities. The proposed designation allows for a
maximum 25 residential care facilities per gross acre, for a total of 16 residential units. The maximum Floor
Area Ratio (FAR) for non-residential uses is 2.0, for a total allowable 58,580 square feet of non-residential.
This roadway capacity analysis has been prepared to identify the amendment's potential impact on the
surrounding roadway network.
It was determined that there is enough existing capacity along the adjacent roadway that service the project
location. SR AIA/Collins Avenue is classified as a State Signalized Arterial with 20 -minute Headway
transit service within one half mile. Per the City of Sunny Isles Beach Adopted Comprehensive Plan Policy
8A, the LOS criteria is LOS E+20 for this road segment. In order to provide a conservative analysis, no
multi -modal reduction was included, but it should be noted that there are projects in the horizon which will
impact traffic congestion and improvement multi -modal connectivity in this area. The existing conditions
and future 2025 with and without the amendment LOS of D in the AM and PM peak periods. The future
2045 conditions with and without the amendment have a LOS D in the AM peak period and LOS E+20 in
the PM peak period. The results indicate that the amendment does not significantly impact the roadway
segment.

The City will continue to maintain adequate LOS standards for the transportation
system to coordinate the traffic circulation system with existing and future land uses as
shown on the Future Land Use Map.
Policies
8A. Unless exempted under other policies, the adopted concurrency management
system shall establish the following roadway level of service standards (LOS) for
the purpose of issuing development orders and permits:
1. In conformity with Miami -Dade County, the acceptable peak period LOS for
all non-FHISS State and County roads inside the City shall be the following:
a) Where no public mass transit service exists, roadways shall operate at or
above LOS E;
b) Where mass transit service having headways of 20 minutes or less is
provided within 0.5 mile distance, roadways shall operate at no greater
than 120 -percent of their capacity (LOS E+20);
c) Where extraordinary transit service such as commuter rail or express bus
service exists parallel roadways within 0.5 mile shall operate at no greater
than 150 -percent of their capacity (LOSE+50).
2. The adopted level -of -service for all collector roads maintained by the City
shall be 120 -percent of LOS E (LOS E+20), as defined and measured by the
methodologies of the FDOT LOS Standards and Guidelines.
86. The level -of -service for all local residential roads shall be guided by the
recommendation of the Miami -Dade County Street Closure/ Traffic Flow
Modification Study and adopted policy.
8C. The City shall encourage FDOT and Miami -Dade County to achieve the adopted
level of service on all road segments shown to be operating below their adopted
level of service according to the MU ATS model.
8D. The City recognizes the interaction with mixed-use developments and the
resulting internal satisfaction of trips when analyzing the traffic impact of
proposed mixed-use developments that promote revitalization and
redevelopment. Mixed-use developments are characterized by three (3) or more
significant, mutually supporting uses with significant physical and functional
integration of project components, including uninterrupted pedestrian
connections, and that are developed in conformance with a coherent plan. To
this extent, in conjunction with Policy 2A, (part b) of this Element, and in support
of the Future Land Use Element, the City will apply the established Transportation
Concurrency Exception Area (TCEA) to facilitate development in the area
bounded by the Town Center Future Land Use designation.

RE: Comprehensive Plan Future Land Use Map (FLUM) Amendment
RECOMMENDATION:
This Ordinance is recommended for your approval.
REASONS:
The City of Sunny Isles Beach accepted a land donation according to Resolutions No. 14-Z-143 and No
2014-2275, the land donated is located at 215 185 St, Sunny Isles Beach, FL (the "Donated Property"
with folio No. 31-2202-006-0010. Consequently, the City obtained ownership of the Donated Property
on July 29, 2016 and entered into a triple net leaseback agreement, which maintain the land as a sales
center for the project known as Turnberry Ocean Club. Currently, the City is taking possession of the
Donated Property and is wishing to pursue a Community Facility in such property. Therefore, is
presenting an amendment to the City's Comprehensive Plan Future Land Use (FLUM) to change th,
future land use of Low to Moderate Density Townhouse to Community Facilities. This amendment wil
be transmitted to the State Department of Economic Opportunities (DEO) and to all external agencie!
require to review the amendment, thus, this amendment will be pursued as a small scale
Comprehensive Plan amendment, according to F.S. 163.3187.
