HomeMy WebLinkAboutOrdinance 2022-582ORDINANCE NO. 2022 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AMENDING THE CITY OF SUNNY ISLES BEACH LAND DEVELOPMENT REGULATIONS (LDRs) OFFICIAL ZONING MAP FOR THE PROPERTY LOCATED AT 215 185 ST, SUNNY ISLES BEACH, FL 33160, TO AMEND THE ZONING DISTRICT FROM MODERATE DENSITY TOWNHOUSE RESIDENTIAL (R-TH) TO COMMUNITY FACILITIES PURSUANT TO CODE SECTION 265-4 OF THE CITY OF SUNNY ISLES BEACH; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach ("City") has proposed a small-scale amendment to the City's Future Land Use Map ("FLUM") for the property located at 215 185th Street, Sunny Isles Beach, Florida, and as legally described in Exhibit "A" (the "Property") from Low to Moderate Density Residential to Community Facility; and WHEREAS, the City is in need of amending its Official Zoning Map to be consistent with its FLUM, by amending the zoning district for the Property from "R-TH Moderate Density Townhouse Residential" to "Community Facilities"; and WHEREAS, on March 15, 2022, the Mayor and City Commission, sitting as the Local Planning Agency ("LPA") at a properly advertised hearing received testimony and evidence related to the amendment from stakeholders, found that the proposed amendment to the City's Official Zoning Map is consistent with the City's Comprehensive Plan; and WHEREAS, after careful review of City staff's report, the City Commission finds that the proposed amendment to the City's Official Zoning Map is consistent with the City's Comprehensive Plan. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:' Section 1. Amendment. Pursuant to Section 265-4 of the City Code, the official zoning map of the City of Sunny Isles Beach is hereby amended as described in Exhibit "B". Section 2. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clause, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. Hasbun, AICP, Planning and Zoning Director March 15, 2022 Official Zoning Map Amendment Stan Morris, City Manager Mauricio Betancur, City Clerk The City has analyzed and prepared a Comprehensive Plan Future Land Use Map (FLUM) Amendment and Official Zoning Map Amendment. The proposed amendments affect only the property located at 215 185 St, Sunny Isles Beach, FI 33160 with Folio No. 31-2202-006-0010 (the "Property"). The amendment described herein is to modify the Official Zoning Map designation for the Property from Moderate Density Townhouse Residential (R-TH) to Community Facilities. The Property The Property is approximately 29,290 square feet or 0.672 acres. The Property was donated to the City pursuant to Zoning Resolution No. 14-Z-143 and Resolution No. 2014-2275. Consequently, the City obtained the deed to the Property on July 29, 2016, legally described under Exhibit "A". The current condition of the Property includes a one-story trailer of 9,120 sq. ft. and 25 parking spaces. Zoning Analysis Under the public hearing application (PZ2022-02), the City is proposing an amendment to the City's official zoning map. The amendment must be analyzed according to City Code Section 265-16 (F). The following analysis includes the Standards for Review for its approval by the City Commission. § 265-16 (F) Standards for reviewing proposed amendments to the Official Zoning Map. In deciding whether to recommend approval of a proposed amendment, the Administration and the City Commission shall determine whether or not: (1) The proposed amendment is consistent with goals, objectives and policies of the City's Comprehensive Plan. Zoning Analysis: this application is presented contemporaneously with a comprehensive plan future land use map (FLUM) amendment requesting that the land use for the subject Property also be amended to Community Facilities. Therefore, the zoning amendment is consistent with the City's comprehensive plan provided the FLUM amendment is approved. (2) The proposed zoning district is compatible with the surrounding area's zoning designation(s) and existing uses. PZ2022-02 24 Zoning Analysis: the proposed zoning district consists of greater site development standards, in terms of height, density, and intensity (FAR) in comparison to the R-TH current zoning district. However, the Property has an existing Restrictive Covenant to Restrict Use of Land for Public Purpose recorded under Miami -Dade County Records (CFN 2016RO443160) ("Restrictive Covenant"), see Exhibit "B", which restricts the use and standards for redevelopment. (3) The subject property is physically suitable for the uses permitted in the proposed district. Zoning Analysis: The Property is suitable for the permitted uses of the district, furthermore, the Property is limited to the uses based upon the Restrictive Covenant. (4) There are sites available in other areas currently zoned for such use. Zoning Analysis: the closest Community Facilities property is approximately 1,500 feet from the Property. (5) If applicable, the proposed change will contribute to redevelopment of an area in accordance with an approved redevelopment plan. Zoning Analysis: Not applicable at this time. (6) The proposed change would adversely affect traffic patterns or congestion. Zoning Analysis: the traffic analysis submitted by Corradino Group dated February 28, 2022, see Exhibit "C" concluded that there is enough capacity to absorb potential traffic impacts at the maximum redevelopment capacity. (7) The proposed change would adversely impact population density such that the demand for water, sewers, streets, recreational areas and facilities, and other public facilities and services would be adversely affected. Zoning Analysis: the Property is restricted to be developed for community facility purposes, including but not limited to, an open -space park, parking area, and/or cultural facility. In addition, the Property was approved as a Sender of Transfer Development Rights (TDRs), therefore, the Property shall be publicly owned and be developed according to the Comprehensive Plan public purpose, specifically to Policy 14 C. (8) Whether the proposed change would have an adverse environmental impact on the vicinity. Zoning Analysis: the proposed amendment does not have an adverse environmental impact as the existing facility is to remain. (9) Whether the proposed change would adversely affect the health, safety, and welfare of the neighborhood or the City as a whole. Zoning Analysis: the proposed amendment will provide a benefit to the community as the use will be limited to community facility purposes. Recitals. The foregoing recitals are true and correct and incorporated into this Restrictive Covenant by reference. 2. Restrictive Covenant. The City agrees to develop, maintain and own the Property for community facility purposes, including, but not limited to, an open -space park, parking area, and/or cultural facilities. Any proposed use of the Property shall be consistent with the terms and conditions contained in this Restrictive Covenant. No use of the Property shall be allowed which is inconsistent with the intent and purpose of this Restrictive Covenant. 3. Term. The provisions of this covenant shall become effective upon their recordation in the Public Records of Miami -Dade County, Florida. 4. Modification, Release and Enforcement. Only the City and Beach Club Acquisition, LLC, have the right to enforce this Restrictive Covenant. No other party will be deemed a third -party L` 27 beneficiary for any purpose. This Restrictive Covenant may only be modified, amended or released by the City Commission. Enforcement shall be by action at law or in equity against the parties or persons violating or attempting to violate this Restrictive Covenant. 5. Covenant running with the land. This Declaration of Restrictive Covenant shall be recorded in the Public Records of Miami -Dade County, Florida, and shall run with the Property described in Exhibit "A" and shall be binding on all persons and entities acquiring title to or use of the Property. 7. Governing Law. This Restrictive Covenant shall be governed by and construed in accordance with the laws of the State of Florida. 8. Attorney's Fees. If any legal or equitable action or other proceeding is brought for the enforcement of the Restrictive Covenant, the successful and prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and all expenses incurred in that action or proceeding in addition to any other relief to which such party may be entitled. 9. Invalidation. Invalidation of any of the restrictive covenants contained herein by judgment or court order shall in no way effect any other conditions which remain in full force and effect. 10. Waiver. Any failure by City to enforce any of the restrictive covenants contained herein shall not be deemed a waiver by City of the right to do so thereafter. 11. Effective Date. This Restrictive Covenant shall become effective upon recordation in the Public Records of Miami -Dade County, Florida. This property is located at 215 185"' Street, Sunny Isles Beach, Florida 33160 and is Folio Number 31-2202-006-0010. The property is zoned Moderate Density Townhouse Residential (R-TH) with a FLUM designation of Low to Moderate Density Townhouse. Currently, the existing maximum allowable development intensity for the parcel includes 13 dwelling units per gross acre, for a total maximum of 8 multi -family residential units. The current condition of the property includes a one-story small office trailer of 9,120 square feet and 25 parking spaces as depicted on the site plan provided in Appendix A. The property was donated to the City of Sunny Isles Beach in accordance to Zoning Resolution No.14-Z-143 and Resolution No.2014-2275. The amendment proposes to change the Property Official Zoning Map and FLUM designations to Community Facilities as shown in Figure 1. The proposed designation allows for a maximum 25 residential care facilities per gross acre, for a total of 16 residential units. The maximum Floor Area Ratio (FAR) for non- residential uses is 2.0, for a total allowable 58,580 square feet of non-residential. The purpose of this study is to assess the proposed amendment's impact on the surrounding roadway network. The site is bordered by 185th Street to the south Atlantic Boulevard to the west, 186th Street to the north and Collins Avenue/AIA to the east. A copy of the Project Location Map is depicted in Figure 2. Figure 2 PROJECT LOCATION The study area for this analysis included all major roadways within the vicinity of the amendment. There was one (1) major roadway within the vicinity of this property that was identified and included in the roadway segment capacity analysis as shown below: • Collins Avenue/SR AIA FLUM AND ZONING AMENDMENT TRAFFIC STATEMENT 34 Page 15 3.0 -TRAFFIC DATA COLLECTION To evaluate traffic conditions on the surrounding roadway network, data was gathered from the FDOT traffic count stations within the vicinity of the amendment along the following roadway segment: • SR A1A/Collins Avenue, 300'N of NE 172nd Street Detailed traffic data gathered from the FDOT traffic online system is provided in Appendix B. 4.0 - PROGRAMMED ROADWAY IMPROVEMENTS The following roadway improvements were identified from the Miami -Dade Transportation Planning Organization (TPO) Transportation Improvement Program (TIP) and Long Range Transportation Plan (LRTP) as planned or committed projects in the vicinity of the proposed amendment. • Congestion Management along SR AIA from SR 907/SW 63 Street to SR 856/William Lehman Causeway/NW 192 Avenue o Adopt and implement a Complete Streets Policy o Improved Safety of Existing Bicycle and Pedestrian Facilities o Promote Bicycle and Pedestrian Use Roadway improvement data is included in Appendix C. 5.0 - AMENDMENT TRAFFIC AND TRIP GENERATION The amendment traffic will be analyzed to determine the impact on the surrounding roadway network based on the calculated development potential. For the purpose of this analysis, only the FAR portion of the Community Facility land use will be analyzed since the goal of the City is to maintain the property as a Community Facility. Therefore, the 5 8,5 80 square feet of non-residential FAR will be used as the proposed maximum development potential. Trip generation will be based on information contained in the Institute of Transportation Engineer's (ITE), Trip Generation Manual, 11th Edition. Land Use Code 712 (Small Office Building) will be used to determine the existing site generated trips for the sales center currently located on this property. A reduction for multimodal use such as walking, cycling or public transit use has not been applied to be conservative. Trip generation information is provided in Appendix D. 6.0 - TRIP DISTRIBUTION AND ASSIGNMENT Project Trip Distribution will be based on cardinal distribution for traffic analysis zone 605 of the Miami Dade County 2045 Transportation Model. The analysis took into consideration the short-term growth on the area's roadway based on the FDOT historical growth rate between 2015-2019. The FDOT historical growth rate information is provided in Appendix E. As shown in Table 3, an annual growth rate of 1.20% was found in this area and will be used for the analysis of the short-term and long-term impacts. It was determined that there is enough existing capacity along the adjacent roadway that service the project location. SR AIA/Collins Avenue is classified as a State Signalized Arterial with 20 -minute Headway transit service within one half mile. Per the City of Sunny Isles Beach Adopted Comprehensive Plan Policy 8A, the LOS criteria is LOS E+20 for this road segment. In order to provide a conservative analysis, no multi -modal reduction was included, but it should be noted that there are projects in the horizon which will impact traffic congestion and improvement multi -modal connectivity in this area. The existing conditions and future 2025 with and without the amendment LOS of D in the AM and PM peak periods. The future 2045 conditions with and without the amendment have a LOS D in the AM peak period and LOS E+20 in the PM peak period. The results indicate that the amendment does not significantly impact the roadway segment. ROADWAY CAPACITY ANALYSIS INFORMATION 1*: V 2030 The City will continue to maintain adequate LOS standards for the transportation system to coordinate the traffic circulation system with existing and future land uses as shown on the Future Land Use Map. Policies 8A. Unless exempted under other policies, the adopted concurrency management system shall establish the following roadway level of service standards (LOS) for the purpose of issuing development orders and permits: 1. In conformity with Miami -Dade County, the acceptable peak period LOS for all non-FHISS State and County roads inside the City shall be the following: a) Where no public mass transit service exists, roadways shall operate at or above LOS E; b) Where mass transit service having headways of 20 minutes or less is provided within 0.5 mile distance, roadways shall operate at no greater than 120 -percent of their capacity (LOS E+20); c) Where extraordinary transit service such as commuter rail or express bus service exists parallel roadways within 0.5 mile shall operate at no greater than 150 -percent of their capacity (LOSE+50). 2. The adopted level -of -service for all collector roads maintained by the City shall be 120 -percent of LOS E (LOS E+20), as defined and measured by the methodologies of the FDOT LOS Standards and Guidelines. 86. The level -of -service for all local residential roads shall be guided by the recommendation of the Miami -Dade County Street Closure/ Traffic Flow Modification Study and adopted policy. 8C. The City shall encourage FDOT and Miami -Dade County to achieve the adopted level of service on all road segments shown to be operating below their adopted level of service according to the MU ATS model. 8D. The City recognizes the interaction with mixed-use developments and the resulting internal satisfaction of trips when analyzing the traffic impact of proposed mixed-use developments that promote revitalization and redevelopment. Mixed-use developments are characterized by three (3) or more significant, mutually supporting uses with significant physical and functional integration of project components, including uninterrupted pedestrian connections, and that are developed in conformance with a coherent plan. To this extent, in conjunction with Policy 2A, (part b) of this Element, and in support of the Future Land Use Element, the City will apply the established Transportation Concurrency Exception Area (TCEA) to facilitate development in the area bounded by the Town Center Future Land Use designation. Hasbun, AICP, Planning and Zoning Director DATE: May 19, 2022 RE: Amendment to the City's Official Zoning Map (Re -Zoning) RECOMMENDATION: Staff recommends approval of this Ordinance. REASONS: The City of Sunny Isles Beach accepted a land donation according to Resolutions No. 14-Z-143 and No 2014-2275, the land donated is located at 215 185 St, Sunny Isles Beach, FL (the "Donated Property" with folio No. 31-2202-006-0010. Consequently, the City obtained ownership of the Donated Property on July 29, 2016 and entered into a triple net leaseback agreement, which maintain the land as a sales center for the project known as Turnberry Ocean Club. Currently, the City is taking possession of the Donated Property and is wishing to pursue a Community Facility in such property. Therefore, is presenting an amendment to the Official Zoning Map according to City code section 265-16. ThE official zoning map will be modified from the current zoning district of R-TH Moderate Density Townhouse Residential to Community Facilities. This amendment is presented concurrently with a Comprehensive Plan Future Land Use Map amendment, therefore this Official Zoning Map is to bi consistent with the Comprehensive Plan FLUM.
