A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROLACT OF 1984TO EXPEND PARTIAL FORFEITURE
FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE CONTRACTING OF
AN ACCREDITATION CONSULTANT AND THE PURCHASE OF A TRAINING
SIMULATOR, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED FORTY-ONE
THOUSAND FOUR HUNDRED SIXTY-FOUR DOLLARS AND SIXTY CENTS
($141,464.60), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of
Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds
from the established Department of Justice ("DOJ") federal forfeiture account, for the approved
programs or purchases intended to enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification
that the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in
compliance with the aforementioned legal requirements for the contracting of an accreditation
consultant and the purchase of a training simulator, in an amount not to exceed One Hundred
Forty -One Thousand Four Hundred Sixty -Four Dollars and Sixty Cents ($141,464.60), attached
hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached
certification, the Chief of Police is hereby authorized to spend up to One Hundred Forty -One
Thousand Four Hundred Sixty -Four Dollars and Sixty Cents ($141,464.60), attached hereto as
Exhibit "A", from the established Department of Justice federal forfeitures account for the
contracting of an accreditation consultant and the purchase of a training simulator.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

RE: Authorize Expenditure of DOJ Forfeiture Funds.
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
The use of these funds will allow the police department to purchase a simulator to train our police
officers in various areas to include discretionary shooting. The simulator will create scenarios in a
training environment that will teach our officers how to best respond in high stress situations. The
technology uses the same weapons our officers carry to include tasers and rifles to provide a realistic
response. This training aid is an addition to our training program that will undoubtedly provide our
officers with experiences that will make them better. We are seeking to utilize Department of Justice
forfeiture funds in an amount not to exceed $44,464.60 to purchase the simulator.
Additionally the funds will allow the police department to enter into an agreement with Doug
Robertson to act as a consultant to achieve and maintain accredited status by the Florida Commission
for Law Enforcement Accreditation. He will assist in the evaluation of the Police Department's currerr
policies, procedures, and all other forms of written directives to determine if they meet or exceed the
minimum standards required for accredited status. We are seeking to utilize Department of Justice
forfeiture funds in an amount not to exceed $97,000.00 to acquire his services.
FUNDING SOURCE:
Funds have been appropriated in account no. 600-3-5210-XXXXXX-XXXXX.
