Nunez Construction, Inc. was incorporated in 1993 and immediately began work on a number of single
and multi -family residential developments. The company built on this success and expanded its reach
into commercial developments including industrial, retail, transportation, retail, aviation and medical
projects.
The company developed a strong expertise in delivering complicated ground -up medical facilities on
aggressive timetables. We have built over S0,000 SQ FT of Medical Facilities for Leon Medical Center, (6
Centers) throughout a 10 -year period, providing safe environments to protect health of patients during
construction taking place in already working facilities.
To date, Nunez Construction has been working over 14years, accumulating extensive experience,

CARLOS M. NUNEZ— President
Carlos Nunez is President and Founder of Nunez Construction since 1995. He leads the
overall master planning of all operations, overseeing all the company's financial and bonding programs
and assuring that the company is working within regulatory and legal constraints that govern our
industry. He is,responsible for the compliance of all State and Federal Labor laws while insurinq the
implementation of the company's Health and Safety plan.
Carlos leads negotiations with clients and participates actively in all negotiations with major
subcontractors and suppliers. He also tracks overall project performance versus established project
budgets and schedules. This is accomplished by holding daily & weekly updates with Senior
Management and Project Managers/Superintendents respectively. His professional and human values
and clarity in communication have built long-lasting relationships with his employees, sub -contractors,
and clients.

EDSEL MARTINEZ—Senior Project Manager I RESPONSIBLE FOR THIS PROJECT
Edsel Martinez is a Sr. Project Manager that has been with Nunez Construction for close to 20 years.
Graduated in Cuba as a Civil Engineer (Hydraulic Expert), and later Civil Engineer at Florida Board of
Professional Engineers (FDPE), Edsel has collaborated in Nunez Construction's growth as a key player
managing and directing all phases of construction including staffing and estimating, executing value
engineering, procurement, construction.
He has extensive experience of full on-site construction management and land development,
effectively scheduling, monitoring, and inspecting all work from start to completion.
He has a proven reputation for effectively working with architects, engineers, developers, bankers,
contractors, inspectors, city officials, agents, owners, and home buyer. He believes in continuous
communication and keeping everyone in the loop. He is responsible for sub -contractors and all activities
on site, schedule, as well as customer orientation, including maintaining budgets, processing invoices,
and controlling overhead costs.
Edsel is a Certified General Contractor (2006) and Certified Plumbing Contractor (2013) for the State of
Florida.
Edsel holds under his belt the close out of at least seven Health Facilities, over $22 million at Miami
International Airport in construction and remodeling of various concessionaires including three airport
lounges, as well as numerous restaurants, residential, corporate, industrial and government
constructions. Most recently he was Sr, Project Manager at IVF Florida construction (20,000 sq ft clinic
and fertility lab).
Edsel is a man of strong family values and a person with a great sense of humor. His attitude towards life
is of finding possibilities and solutions in a constructive and positive way.
YOAN DRY GALAN — Project Manager
Yoandry Galan is a Project Manager at Nunez Construction. He has been responsible for the overall daily
management of company's projects, ensuring that project milestones are met. Coordinates all
subcontractors' activities throughout project construction. Responsible for project sites being kept in safe
and clean conditions since 2017.
Yoandry holds an MBA from Florida International University and a BFin & Marketing from Manhattan
College Riverdale, NY School of Business. He also is a Certified General Contractor for the State of Florida.
His most recent accomplishment is directly supervising all construction work for a 20,000 Sq Ft. fertility
clinic, including exam, consult rooms, office space, nurse stations, ORs, and recovery rooms and a 2,500
Sq Ft Clean Room Fertilization Laboratory.
His experience as Project Manager and previously Superintendent has been overseeing supervising
construction process for Gateway Park Center for the City of Sunny Isles.15,000 Sq Ft of construction of a
state-of-the-art community space including ballroom, fitness center, kitchen, classrooms, and social
areas. Yoandry oversaw and ensured timely delivery and budget maintenance for all tenant

improvements work at Miami International Airport (M DAD, including clients such as Duty -Free Americas,
HM Host, American Express Centurion Lounge, JC Decaux, Concessions Miami, Areas. He also
collaborated in completing the 20,000 sq ft interior build out of Istituto Marangoni in the Miami Design
District.
Yoandry has been an active volunteer for the Miami community with local and State representatives from
2015-2018. He is a family man, close to his family and is recently married. Yoandry is not only a sports fan
but also a team player. He literally was a Division One Baseball player, earning his university scholarship
for his outstanding performance on the field and academically. Those team building and communication
skills can be clearly depicted on the work site, adding value to each project.
LIN ET SANCH EZ —Administrative Supervisor
Linet Sanchez is Nunez Construction Administrative Supervisor since 2013. She is responsible for the
Construction financial management and services in project financing strategies and budgeting, project
bonding planning, Davis Bacon Certified payroll processing, personnel payroll, accounts payables &
receivables, county & airport project logistics, accounting Supervision and administrative processes for
projects. She is detail -oriented, rigorous, and flexible when required.
Graduated from Florida International University, Linet holds a Bachelor's Degree in Finance and is a
certified Notary Public for the State of Florida.
Linet is forever curious and adventurous; she is a savvy and seasoned traveler that has visited the most
unexpected corners of the world through her five senses. She is an avid learner of Chinese and a K -Pop
fa n.
SYLVIA GRAVES — Proiect Engineer
Sylvia Graves has been a Project Engineer on the Nunez team since 2019, responsible for Project
scheduling monitoring, activity coordination, plan review and assisting in the development of cost
estimating and timely procurement. She works closely with the Project Managers/Superintendents to
pre-empt activities and needs to respond in an efficient manner. She creates and manages the submittal
and RFI process on Procore to fulfillment and executes all close-out packages for projects. Sylvia also
coordinates legal documentation for new projects, and for permitting. She manages and updates all
project records, prepares change order requests when necessary and assists in all safety documentation
req u i red.
Prior to her entrance in the world of construction, Sylvia, a graduate from Boston University with a B.S. in
Mass Communications and a B.A . in Liberal Arts, has been a seasoned branding, advertising & marketing
professional that has held positions as GM for Advertising & Media at Telefonica / Coord for Advertising
and Brand Image and CANTV-Verizon, Owner at Betancourt & Graves ad agency and VP Account
Services at JWT, with 30+ years of experience, creating, building & communicating brands through
assertive strategies. She has achieved goals through successful execution across diverse markets and
product categories for both large multinationals and local SBE's, built strong and lasting relationships
with a broad base of clients in a range of industries.
She believes that by understanding what truly drives people one can open relevant dialogues that allow
space to build brands in unique ways. This vision not only applies to her experience in developing brands
but can be projected in her work in construction.
Sylvia is of a bi-cultural background having lived in Venezuela most of her life, while having an
international education. Sylvia has a passion for nature, hiking, sailing, cycling, and kayaking. She believes

4. Approach I Methodology:
Nunez Construction's organizational structure is lean and efficient. We follow a culture of open
communication which allows our team members to be informed of all aspects of our projects to ensure a
fluid and efficient process. This culture extends to our sub -contractors, architects, engineers and to our
clients. This includes daily communication, bi-weekly meetings with Owners, architect and GC, and
includes engineers when necessary to discuss updates, tackle emerging issues and to keep all informed.
We also work with Procore for project management (submittals, BFI's, schedules, reports, construction
photos, to centralize approval processes and documentation with all team members. We also provide 3 -
week look ahead and construction schedules as work tools throughout project. Nunez Construction will
provide a dedicated team assigned to this project to ensure proper delivery.
Emergency Response Plan (2 -hour Call -out): Nunez Construction works with a 3 -tier level emergency
contact system, which ensures a timely response for emergencies. We provide the names and numbers
of three members of our team who work on the project. In addition, Owner will have direct number of
sub -contractor's if required.
As part of our close-out documentation, warranties will be provided for both products and services
associated to this project.

FORM OF PERFORMANCE BOND
KNOW ALL MEN BY THESE PRESENTS
That, pursuant to the requirements of Florida Statute 255.05, we,
as Principal, hereinafter called
Contractor, and as Surety, are bound to the City of Sunny
Isles Beach, Florida, as Obligee, hereinafter called City, in the amount of

executors, administrators, successors and assigns, jointly and severally.
WHEREAS, Contractor has by written agreement entered into a Contract, Bid/Contract No, awarded the
day of , 20 , with in accordance with contract documents prepared by the City
of Sunny Isles Beach, which Contract is by reference made a part hereof, and is hereafter referred to as the
Contract;
THE CONDITION OF THIS BOND is that if the Contractor:
1. Fully performs the Contract between the Contractor and the City for services described within (Bid No.
) within calendar days after the date of Contract commencement as specified in the
Notice to Proceed and in the manner prescribed in the Contract; and
2. Indemnifies and pays City all losses, damages (specifically including, but not limited to, damages for
delay and other consequential damages caused by or arising out of the acts, omissions or negligence of
Contractor), expenses, costs and attorney's fees including attorney's fees incurred in appellate proceedings, that
City sustains because of default by Contractor under the Contract; and
3. Upon notification by the City corrects any and all defective or faulty Work or materials which appear within
one and one half (1 1/2) years, and:
4. Performs the guarantee of all Work and materials furnished under the Contract for the time specified in
the Contract, then this Bond is void, otherwise it remains in full force. Whenever Contractor shall be, and
declared by City to be, in default under the Contract, the City having performed City's obligations there under, the
Surety may promptly remedy the default, or shall promptly:
4.1. Complete the Contract in accordance with its terms and conditions; or
4.2. Obtain a Bid or Bids for completing the Contract in accordance with its terms and conditions,
and upon determination by Surety of the best, lowest, qualified, responsible and responsive
Proposers, or, if the City elects, upon determination by the City, and Surety jointly of the best,
lowest, qualified, responsible and responsive Proposers, arrange for a Contract between such
Proposers and City, and make available as Work progresses (even though there should be a
default or a succession of defaults under the Contract or Contracts of completion arranged
under this paragraph) sufficient funds to pay the cost of completion less the balance of the
Contract Price; but not exceeding, including other costs and damages for which the Surety
may be liable hereunder, the amount set forth in the first paragraph hereof. The term "balance
of the Contract Price." as used in this paragraph, shall mean the total amount payable by City
to Contractor under the Contract and any amendments thereto, less the amount properly paid
by City to Contractor.
No right of action shall accrue on this Bond to or for the use of any person or corporation other than the City
named herein.
The Surety hereby waives notice of and agrees that any changes in or under the Contract Documents and
compliance or noncompliance with any formalities connected with the Contract or the changes do not affect
Surety's obligation under this Bond.

Florida Statute 448.095 directs all public employers, including municipal governments, to verify the
employment eligibility of all new public employees through the U.S. Department of Homeland Security's E -
Verify System, and further provides that a public employer may not enter into a contract unless each party
to the contract registers with and uses the E -Verify system.
Florida Statute 448.095 further provides that if a contractor enters into a contract with a subcontractor, the
subcontractor must provide the contractor with an affidavit stating that the subcontractor does not employ,
contract with, or subcontract with an unauthorized alien.
In accordance with Florida Statute 448.095, all contractors doing business with the City of Sunny Isles
Beach are required to verify employee eligibility using the E -Verify system for all existing and new
employees hired by the contractor during the contract term. Further, the contractor must also require and
maintain the statutorily required affidavit of its subcontractors. It is the responsibility of the awarded vendor to
ensure compliance with E -Verify requirements (as applicable). To enroll in E -Verify, employers should visit
the E -Verify website (litto5://www.e-verity.gov1eiiiployers/etirolliiig-in-e-vcri€.�,) and follow the
instructions. The contractor must, as usual, retain the 1-9 Forms for inspection.

S. Exceptions
Exception 1:
Regarding item 2.8 Performance and Payment Bond, section 95.11(3)(c) states the following, "(c) An
action founded on the design, planning, or construction of an improvement to real property, with the
time running from the date of actual possession by the owner, the date of the issuance of a certificate of
occupancy, the date of abandonment of construction if not completed, or the date of completion of the
contract or termination of the contract between the professional engineer, registered architect, or
licensed contractor and his or her employer, whichever date is latest; except that, when the action
involves a latent defect, the time runs from the time the defect is discovered or should have been
discovered with the exercise of due diligence. In any event, the action must be commenced within 10
years after the date of actual possession by the owner, the date of the issuance of a certificate of
occupancy, the date of abandonment of construction if not completed, or the date of completion of the
contract or termination of the contract between the professional engineer, registered architect, or
licensed contractor and his or her employer, whichever date is latest."
Both Nunez Construction and our bonding agent do not find acceptable the language within the
contract. The surety is not statutory obligated to 95.11(3)(c), specifically, the 10 -year latent defect, unless it
is written into the contract or performance bond. Underwriting a 10 -year obligation for a surety is a very
onerous ask and something that is not considered in surety rates and indemnity package. We would ask
to consider striking out this language from the contract.
Exception 2:
Nunez Construction is committed to respecting prices reflected on Bid. However, given current price
escalations due to market conditions, "Where and when the delivery of material is delayed or quantities
are limited, as a result of shortages, rationing or unavailability, Contractor shall not be liable or responsible
for any delays or damages caused thereby. When this occurs, Contractor may propose substitute
materials or suppliers or alternate means of acquiring said materials, and contractor and sub -contractor
shall negotiate an equitable price and time adjustment to this agreement. Additionally, when the costs
of any material exceed 3% more than documentable price originally quoted to Contractor, the Contractor
shall notice Owner in writing of such change and the parties shall come to mutual agreement on a new
price. Until such time as Contractor negotiates any applicable price and time adjustments, Contractor
shall be relieved of further performance under this agreement. This provision shall control over all other
terms and conditions of this agreement and contract documents."
