HomeMy WebLinkAboutReso 2022-3359RESOLUTION NO. 2022 - s , A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, TERMINATING THE LOCAL AGENCY PROGRAM AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FPN 441646-1-58- 01) PROVIDING FOR GRANT FUNDING FOR THE PROPOSED GOVERNMENT CENTER PEDESTRIAN OVERPASS BRIDGE; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 17, 2020, via Resolution No. 2020-3099, the City Commission of the City of Sunny Isles Beach ("City") approved a grant agreement with the Florida Department of Transportation ("FDOT") to partially fund the construction of a government center pedestrian overpass bridge ("Pedestrian Bridge") in an amount not to exceed Five Hundred Thousand Dollars ($500,000.00) ("Agreement"); and WHEREAS, to date, the City has not received any of the grant funds; and WHEREAS, pursuant to Paragraph 9 of the Agreement, the parties may terminate the Agreement when its continuation would not produce the beneficial results commensurate with the further expenditure of funds; and WHEREAS, the City Commission has determined that the proposed Pedestrian Bridge would not produce the beneficial results commensurate with the further expenditure of funds; and WHEREAS, the City now wishes to terminate the Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Approving the Termination of the FDOT Local Agency Program Agreement. The City Commission hereby approves the termination of the State of Florida Department of Transportation Local Agency Program Agreement dated April 29, 2021 (FPN 441646-1-58-01). Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. REASONS: In September 2020, the City entered into a Local Agency Program Agreement with the State of Florid Department of Transportation to provide grant funding for the proposed pedestrian overpass bridge at Collins Avenue and AIA in the amount of $500,000.00. To date, no grant funds have been received by the City for this project. During the budget preparation discussions, the City Commission has determined that the proposed Pedestrian Bridge would not produce the beneficial results commensurate with the further expenditure of funds. FDOT requires that we take action to move this project forward or terminate the agreement. Without clear direction to move forward, staff recommends the termination of this agreement.
