HomeMy WebLinkAboutReso 2022-3370RESOLUTION NO. 2022 - 3 6�7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF A 2023 CHEVY TAHOE FOR USE BY THE POLICE DEPARTMENT, IN AN AMOUNT NOT TO EXCEED SIXTY-THREE THOUSAND EIGHT HUNDRED EIGHTY DOLLARS ($63,880.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in compliance with the aforementioned legal requirements for the purchase of a 2023 Chevy Tahoe for use bythe Police Department, in an amount notto exceed Sixty -Three Thousand Eight Hundred Eighty Dollars ($63,880.00), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to Sixty -Three Thousand Eight Hundred Eighty Dollars ($63,880.00), from the established Department of Justice federal forfeitures account for the purchase of a 2023 Chevy Tahoe for use by the Police Department, attached hereto as Exhibit "A". Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 21s' day of July 2022. RECOMMENDATION: Staff recommends approval of this Resolution. REASONS: The use of these funds will be used for the purchase of a 2023 Chevy Tahoe for use by the Police Department in an amount not to exceed $63,880.00.
