A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, APPROVING A MEMORANDUM OF UNDERSTANDING REGARDING
ARTICLE 26 OF THE COLLECTIVE BARGAINING AGREEMENT BETWEEN THE CITY
OF SUNNY ISLES BEACH AND THE POLICE BENEVOLENT ASSOCIATION,
ATTACHED HERETO AS EXHIBIT "A"; PROVIDING THE CITY MANAGER WITH THE
AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on October 15, 2020, via Resolution No. 2020-3124, the City Commission
entered into a Collective Bargaining Agreement ("CBA") with the Police Benevolent Association
("PBA") regarding terms and conditions of employment; and
WHEREAS, the parties are proposing a Memorandum of Understanding to amend Article
26 of the CBA to provide that police officers with a minimum of four (4) years of law
enforcement experience, the most recent two (2) years with the City, shall be eligible to take
the examination for a promotion to the rank of Police Sergeant; and
WHEREAS, the City Commission wishes to approve the Memorandum of Understanding.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Memorandum of Understanding. The City Commission hereby
approves the Memorandum of Understanding amending Article 26 of the Collective Bargaining
Agreement, attached hereto as Exhibit "A".
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF SUNNY ISLES BEACH AND
THE DADE COUNTY POLICE BENEVOLENT ASSOCIATION
This Memorandum of Understanding ("MOU") is entered into this 'T day of
rJ V h(?, , 2022, by and between the City of Sunny Isles Beach, hereafter
referred to as the "City", and the South Florida Police Benevolent Association, also
known as the Dade County PBA, hereafter referred to as the "PBA." The City and the
PBA are collectively referred to as the "Parties."
WHEREAS the City and the PBA are Parties to a Collective Bargaining
Agreement for the period of October 1, 2019, to September 30, 2022 ("CBA") which sets
forth the terms and conditions of employment for the City's bargaining unit members;
and;
WHEREAS the Parties acknowledge that Article 26, Promotion Procedures, of
the current Collective Bargaining Agreement between the Parties currently sets forth the
promotional testing process and eligibility criteria for Bargaining Unit Members, and;
WHEREAS the Parties desire to amend the current language of Article 26 to
reflect the promotional process be applicable to the rank of Sergeant, instead of to the
rank of Corporal.
NOW THEREFORE, the Parties agfee as follows:
1. The above recitals are true and correct and incorporated herein by reference.
2. The Parties further agree that Article 26, PROMOTION PROCEDURE, shall
be modified as follows I:
a) Section 1. Police officers with a minimum of four (4) years law enforcement

experience, the most recent two (2) years with the City of Sunny Isles Beach, shall be
eligible to take the examination for a promotion to the rank of Police Ger-per-al Sergeant.
b) Section 2. All promotions shall be in accordance with the current Police
Department Policy or as such Policy is subsequently amended by the City. Should the City
seek to change its promotional policy, the City will provide the PBA with a copy of the new
policy at least thirty (30) days prior to the effective date of such policy. The City will
announce promotional examinations at least thirty (30) days in advance of the assessment
process. The eligibility list shall be valid for up to one (1) year. The Police Chief has the
option to extend the eligibility list one more year.
c) Section 3. A candidate for promotion shall have the right to review the scored
elements of the Assessment process.
d) Section 4. In the event of a promotion, an employee will be placed in the next
highest step in the position to which they are promoted. In the event the increase in
salary is less than three percent (3%), the employee will be moved to the next highest
step in his/her promoted position, regardless of the percentage increase.
3. Other than as specifically set forth herein, this MOU does not modify the

5. The Parties have had the opportunity to consult with legal counsel of their
choosing.
6. This Memorandum of Understanding shall be effective upon the execution of
the agreement by all Parties listed below and after final approval/ratification by the
Sunny Isles Beach Commission. Once in effect, this Memorandum of Understanding

shall continue in effect as part of the current Collective Bargaining Agreement until
modified though further negotiations.

RE: Memorandum of Understanding Approving Change of the Corporal Positior
to the Sergeant Position
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
The Sunny Isles Beach Police Department requires the elimination of the Corporal position and the
promotion of current Corporal officers to the rank of Sergeant. The squads have grown in size, and
each shift now requires two Sergeants to provide adequate supervision. Supervisors require more
authority to make critical decisions, and the Sergeant rank provides that solution. ,
Any change of the bargaining unit agreement requires approval of the City Commission.
