A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, ACCEPTING A GRANT AWARD FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION'S OFFICE OF RESILIENCE AND COASTAL PROTECTION FOR THE CENTRAL ISLAND AREA DRAINAGE IMPROVEMENTS PROJECT, IN THE AMOUNT OF TWO MILLION DOLLARS ($2,000,000.00); AUTHORIZING THE CITY MANAGER TO ENTER INTO A GRANT AGREEMENT, EXPEND GRANT FUNDS, AND DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION, PROVIDED SAID GRANT AGREEMENT IS APPROVED AS TO FORM AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on August 23, 2021, the City of Sunny Isles Beach ("City") submitted an application to the Department of Environmental Protection's ("DEP") Office of Resilience and Coastal Protection Resilient Florida Program ("Program") for grants funds to be used for the Central Island Area Improvements Project ("Project"); and WHEREAS, DEP has accepted the City's application and allocated $2,000,000.00 in matching funds to be used toward the Project; and WHEREAS, the City Commission wishes to accept the award of grant funds and authorizes the City Manager to enter into a Grant Agreement with the Department of Environmental Protection, in an amount of up to Two Million Dollars ($2,000,000.00), of which a dollar -for -dollar cash match is required, for the Central Island Area Drainage Improvements Project, provided said Grant Agreement is first approved as to form and legal sufficiency by the City Attorney. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Accept Grant Award. The City Commission hereby accepts the award of grant funds in an amount of up to Two Million Dollars, ($2,000,000.00) from the Department of Environmental Protection for the Central Island Drainage Improvements Project. Section 2. Authorization of City Manager and City Attorney. The City Manager is hereby authorized to enter into a Grant Agreement with the Florida Department of Environmental Protection, provided said Grant Agreement is first approved as to form and legal sufficiency by the City Attorney, accept grant funds, expend grant funds, distribute grant monies, and do all things necessary to effectuate the terms of this Resolution. Section 3. Effective Date. This Resolution shall become effective upon adoption. REASONS: The City has been included in the Fiscal Year 2021 - 2022 Resilient Florida Program Grant Awards fo Implementation Projects, from the Department of Environmental Protection's Office of Resilience an( Coastal Protection Resilient Florida Program (Program) funded by the Coronavirus State and Loco Fiscal Recovery Funds. The Project funded under this grant award is for the Central Island Area Puml Stations and the Drainage Improvements that includes the area north of 174th Street to 183rd Street and Atlantic Avenue to North Bay Road. Funding for the project will be provided through a cost -reimbursement grant agreement between the Florida Department of Environmental Protection and the City. The estimated total cost for the projec, is $4,000,000 with the grant requiring at least a 50% local match by the City. Therefore, the City is responsible for providing a local match amount of $2,000,000.00 towards the project funded under this grant. All work is subject to approval by the Department of Environmental Protection, and only eligible activities will be reimbursed by the Program under the grant agreement once fully executed and must be completed by the agreement expiration date. To expedite the grant agreement process, the City recommends the acceptance of this grant award and authorizing the City Manager to enter into the grant agreement. Item Number: 4.0 FUNDING SOURCE: This project is budgeted for and funds are available in the Capital Improvement Program budget account number 300-5-5410-465-000-83-003 for the city's match however approval of this item does not require additional funding.
