HomeMy WebLinkAboutReso 2022-3388RESOLUTION NO. 2022 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE EXPENDITURE OF PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 FOR A NEW CRIME SCENE VEHICLE AND A SPACE ASSESSMENT FEASIBILITY STUDY, IN AN AMOUNT NOTTO EXCEED ONE HUNDRED FIFTY-ONE THOUSAND FIFTY-THREE DOLLARS ($151,053.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for the approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted for ratification the expenditure of DOJ forfeiture funds in compliance with the aforementioned legal requirements fora new crime scene vehicle and a space assessment feasibility study, in an amount not to exceed One Hundred Fifty - One Thousand Fifty -Three Dollars ($151,053.00), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratification of Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to One Hundred Fifty - One Thousand Fifty -Three Dollars ($151,053.00), attached hereto as Exhibit "A", from the established Department of Justice federal forfeitures account for a new crime scene vehicle and a space assessment feasibility study. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 15th day of September 2022. REASONS: The Police Department has hired a veteran crime scene investigator and is in need of a crime scene vehicle. The vehicle will be used by the investigator to respond to crime scenes and will have all the necessary equipment to process scenes. By using Department of Justice forfeiture funds the Police Department purchased a Ford Explorer Hybrid to utilize as a full time crime scene vehicle in an amount not to exceed $47,000.00. We are seeking ratification of the purchase. The Police Department hired Architect Design Group (ADG) to design a new police department ani conduct a comprehensive site feasibility study and space needs assessment. We are seeking to ratify the expenditure of $104,053.00 with ADG. FUNDING SOURCE: Funds have been appropriated in account no. 600-3-5210-XXXXXX-XXXXX.
