HomeMy WebLinkAboutReso 2022-3389RESOLUTION NO. 2022 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROLACT OF 1984TO EXPEND PARTIAL FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT, FOR NEW POLICE OFFICER HIRES, AUTOMATIC CARD READERS, POLICING EQUIPMENT, AND COMMUNITY EVENTS, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED THIRTY-FIVE THOUSAND SEVEN HUNDRED DOLLARS ($235,700.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in compliance with the aforementioned legal requirements for new police officer hires, automatic card readers, policing equipment, and community events, in an amount not to exceed Two Hundred Thirty -Five Thousand Seven Hundred Dollars ($235,700.00), attached hereto as Exhibit „A„ NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, the Chief of Police is hereby authorized to spend up to Two Hundred Thirty -Five Thousand Seven Hundred Dollars ($235,700.00), attached hereto as Exhibit "A", from the established Department of Justice federal forfeitures account for new police officer hires, automatic card readers, policing equipment, and community events, in an amount not to exceed Two Hundred Thirty -Five Thousand Seven Hundred Dollars ($235,700.00). REASONS: The Police Department is seeking approval to expend Department of Justice forfeiture funds tc increase the amount of sworn personnel. We currently have two police detectives detached to federal task forces and the Department of Justice allows the use of forfeiture funds to pay for their new hire replacements. The replacement officers would be operating as uniform patrol officers policing Sunny Isles Beach. To fund the replacement new hires would cost $217,280.00. The Police Department is also seeking approval to purchase giveaway community policing items for use at various events. These items have been very popular and serve to educate the public on various initiatives. We are seeking approval to allocate $10,000.00 for that purpose. Additionally the promotion and reassignment of police supervisors has created the need to purchase three additional Apple iPads and accessories for $2,750.00. The Apple iPads will allow the supervisors to work more efficiently and provide a host of benefits to include evidence collection, improved communication, optimizing the dissemination of police paperwork, and limiting the use of paper as we aim to move toward more environmentally sustainable practices. The Police Department is currently upgrading tc electronic citations to modernize the process. In an effort to maximize efficiency and expedite the citation process we are seeking authorization use forfeiture funds to purchase automatic card readers. The automatic card readers will allow officers to swipe a driver's license which will automatically populate the information in the electronic fields.
