A RESOLUTION OF THE LOCAL PLANNING AGENCY OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA, RECOMMENDING APPROVAL OF AN AMENDMENT TO
ADOPTED CITY OF SUNNY ISLES BEACH COMPREHENSIVE PLAN TO CREATE A
PROPERTY RIGHTS ELEMENT IN COMPLIANCE WITH F.S. 163.3177(6)(i);
APPROVING THE TRANSMITTAL OF THE AMENDMENT TO THE DEPARTMENT OF
ECONOMIC OPPORTUNITY AND REVIEWING AGENCIES IN ACCORDANCE WITH
SECTION 163.3187, FLORIDA STATUTES; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, F.S. 163.3177(6)(i) requires that each local government adopt a property
rights element as part of its comprehensive plan; and
WHEREAS, City Commission serves as the Local Planning Agency ("LPA"), and is required
to review any amendments to the City's Comprehensive Plan; and
WHEREAS, on June 16, 2022, at a properly advertised meeting of the LPA, the LPA
determined that it is in the best interest of the City and its residents to recommend approval of
an amendment of the City's Comprehensive Plan to create a property rights element.
NOW, THEREFORE, BE IT RESOLVED BY THE LOCAL PLANNING AGENCY OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Incorporation of Recitals. The foregoing "WHEREAS" clauses are hereby ratified
and confirmed as being true and correct and are hereby made a specific part of this Resolution
upon adoption hereof.
Section 2. Recommending Approval Amendments to Comprehensive Plan. The Local
Planning Agency of the City of Sunny Isles Beach hereby recommends approval of an
amendment of the City's Comprehensive Plan to create a property rights element.
Section 3. Transmittal. The Local Planning Agency of the City of Sunny Isles Beach hereby
recommends transmittal of the proposed Comprehensive Plan Amendments in accordance with
Chapter 163, Florida Statutes.
Section 4. Effective Date. This Resolution shall take effect immediately upon adoption.
