A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND PARTIAL FORFEITURE
FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE
ACCOUNT FOR SUBSCRIPTION TO A FACIAL RECOGNITION DATABASE,
ELECTRONIC POLICING EQUIPMENT, AND TEMPERATURE REGULATED EVIDENCE
STORAGE, IN AN AMOUNT NOT TO EXCEED TWENTY-SEVEN THOUSAND FOUR
HUNDRED NINETY-FIVE DOLLARS ($27,495.00), ATTACHED HERETO AS EXHIBIT
"A"; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of
Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds
from the established Department of Justice ("DOJ") federal forfeiture account, for approved
programs or purchases intended to enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification
that the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in
compliance with the aforementioned legal requirements for subscription to a facial recognition
database, electronic policing equipment, and temperature regulated evidence storage, in an
amount not to exceed Twenty -Seven Thousand Four Hundred Ninety -Five Dollars ($27,495.00),
attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached
certification, the Chief of Police is hereby authorized to spend up to Twenty -Seven Thousand Four
Hundred Ninety -Five Dollars ($27,495.00), attached hereto as Exhibit "A", from the established
Department of Justice federal forfeitures accountfor subscription to a facial recognition database,
electronic policing equipment, and temperature regulated evidence storage.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

MEMORANDUM

RE: Authorize the Expenditure of DOJ Forfeiture Funds
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
The Police Department is seeking approval to expend Department of Justice forfeiture funds tc
purchase Apple iPads and cases for every police officer. Recently, supervisors have used the iPads to
collect evidence and complete paperwork electronically which has made both processes much more
effective. It has streamlined our evidence collection and has become an environmentally conscience
way of disseminating paperwork. These iPads will be used in lieu of purchasing new digital cameras
and will offer a much more robust solution with an equally efficient camera. We are seeking to use
$17,000.00 of DOJ funds for this purchase.
The Police Department is also in need of a refrigerator for the property and evidence room. The
storage of biological evidence is of paramount importance and we are in need of a refrigerator that
has the capacity to store this evidence. We are seeking to use $3,000.00 in DOJ funds for this
purchase.
Lastly, the Police Department is requesting to use $7,495.00 of DOJ forfeiture funds to subscribe to
facial recognition database. The database uses open source data and advanced technology to identify
subjects of crime via facial recognition. This tool will allow investigators the opportunity to generate
leads where they might not have without such technology.
