HomeMy WebLinkAboutReso 2022-3431RESOLUTION NO. 2022 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING CHANGE ORDER NO. 5 TO THE AGREEMENT WITH THE STOUT GROUP, INC. FOR THE CONSTRUCTION OF THE GOLDEN SHORES UTILITY UNDERGROUNDING PROJECT, IN A TOTAL AMOUNT NOT TO EXCEED TWO HUNDRED EIGHTY-FOUR THOUSAND TWO HUNDRED SIXTY-FIVE DOLLARS AND NINETY-EIGHT CENTS ($284,265.98), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach ("City") issued and advertised Invitation to Bid No. 20-08-01 ("Bid") for professional construction services for the Golden Shores Utility Undergrounding Project and received five (5) bids; and WHEREAS, following an evaluation of the bids, it was determined that The Stout Group, Inc. ("Contractor") was the lowest responsible and responsive bidder; and WHEREAS, on October 211t, 2021, via Resolution No. 2021-3257, the City Commission awarded the Bid to, and authorized the City Manager to negotiate and enter into an Agreement with, the Contractor; and WHEREAS, the City Manager negotiated an Agreement with the Contract in an amount not to exceed $5,858,477.87, which includes a contingency in the amount of $375,000.00; and WHEREAS, on May 19th, 2022, via Resolution No. 2022-3345, the City Commission approved Change Order No. 1 to cover the increase in material costs as a result of increases to production and delivery of construction materials, in an amount not to exceed $135,150.30; and WHEREAS, on July 21St, 2022, via Resolution No. 2022-3378, the City Commission approved Change Order No. 2 for the installation of conduits and connections to private meters, in an amount not to exceed $803,000.00; and WHEREAS, via the same Resolution No. 2022-3378, the City Commission also approved Change Order No. 3 for the installation of remaining decorative streetlighting, including poles, luminaries, foundations, and electrical equipment, as well as providing as -built documentation for the final streetlighting and miscellaneous utility conduit installation, in an amount not to exceed $152,735.63; and WHEREAS, on October 20th, 2022, via Resolution No. 2022-3425, the City Commission approved Change Order No. 4 for the addition of new catch basins, manholes, and drainage piping, in an amount not to exceed $304,802.52, utilizing pricing from the FDOT - Miscellaneous Drainage Improvement Contract (E61-97); and R2022 CO 5 w Stout Group for Golden Shores Undergrounding Page 1 of 3 WHEREAS, the Contractor has submitted Change Order No. 5 for unforeseen conditions relating to the depth of existing asphalt paving that requires removal, as well as for additional costs incurred related to the project construction trailer, and additional improvements to the storm sewer system, in an amount not to exceed $284,265.98; and WHEREAS, the City Commission wishes to approve Change Order No. 5 to the Agreement with The Stout Group, Inc. for the Construction of the Golden Shores Utility Undergrounding Project, in an amount not to exceed Two Hundred Eighty -Four Thousand Two Hundred Sixty -Five Dollars and Ninety -Eight Cents ($284,265.98), bringing the total contract amount not to exceed Seven Million Five Hundred Thirty -Eight Thousand Four Hundred Thirty - Two Dollars and Thirty Cents ($7,538,432.30), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Change Order No. 5. The City Commission hereby approves Change Order No. 5 to the Agreement with The Stout Group, Inc. for the Construction of the Golden Shores Utility Undergrounding Project, in an amount not to exceed Two Hundred Eighty -Four Thousand Two Hundred Sixty -Five Dollars and Ninety -Eight Cents ($284,265.98), bringing the total contract amount not to exceed Seven Million Five Hundred Thirty -Eight Thousand Four Hundred Thirty -Two Dollars and Thirty Cents ($7,538,432.30), attached hereto as Exhibit "A". Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 3. ATTEST: Maurlcio Effective Date. Unforeseen WASA sanitary sewers have been discovered during excavation requiring repair. Construction trailer cost was excluded from bid due to another contractor providing, responsibility now shifts to Stout Group. NOTE: Unless specifically stated clearly elsewhere on this page, this contract amendment does NOT include an extension of time or grant any additional general conditions amounts. The City and the Contractor agree that the contract time adjustment and sum agreed to in this document constitute a full and complete settlement of the matters set forth herein, including all direct and indirect costs for equipment, manpower, materials, overhead, profit and delay relating to the issues set forth in this document. REASONS: Change Order No. 5 increases the overall contract amount by $284,265.98 due to unforeseen conditions relating to the depth of existing asphalt paving that needed to be removed, additional costs incurred for the project construction trailer and additional improvements to the storm sewer system in the Golden Shores neighborhood. The original contract documents anticipated the depth of the existing asphalt paving to be 4" in thickness. Ongoing excavation activities have found the vast majority of the roadway to consist of a minimum of 8" to a maximum of 14" of asphaltic concrete paving. The additional material removal and disposal is being charged at the contractual unit price per cubic foot of volume. The existing on site construction trailer was originally being provided and paid for by an alternate contractor for the city while it was being shared by both contractors. The agreement with the alternate contractor and the City has been terminated. The trailer is required for the ongoing management of the Golden Shores undergounding project and will now be paid for solely by The Stoui Group. During the most recent storm event, significant flooding within the Golden Shores neighborhood was encountered. The additional improvements contained in this Change Order will further improve the Item Number: 10.6 12
