A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
SUNNY ISLES BEACH, FLORIDA, ACCEPTING THE RESULTS OF
THE SPECIAL ELECTION HELD ON TUESDAY, NOVEMBER 4,
2008, ON PROPOSED AMENDMENTS TO THE CITY CHARTER;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on Tuesday, November 4, 2008, the City of Sunny Isles Beach held a Special
Election on proposed Amendments to the City Charter; and
WHEREAS, the City Commission desires to accept the results of the Special Election held on
November 4, 2008.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1, Accept Results of Special Election. The City Commission of the City of Sunny Isles
Beach hereby accepts the results of the Special Election held on November 4, 2008, as follows:
(1) Permission to Redraw Residential Voting Areas by Ordinance Due to Increase in
Population: The City Charter currently does not provide the City Commission with the
authority to redraw the boundaries of Residential Voting Areas due to increase in
population. It is proposed that the Charter be amended to permit the redrawing of the
boundaries of residential voting areas by Ordinance based on population growth.
Shall the above described amendment be adopted?
Yes 3,362 votes
No 1,308 votes
(2) Converting, the At -Large Commissioner Seat to a Residential Voting Area Commissioner
Seat: The City Charter currently does not require the Commissioners holding Seat 4 to
reside in a Residential Voting Area but requires the Commissioners holding Seat 1, Seat
2, and Seat 3 to reside in a Residential Voting Area. It is proposed the Charter be
amended to convert Seat 4, the At -Large Seat on the City Commission, to a Residential
Voting Area Seat.
Shall the above described amendment be adopted?
Yes 3,416 votes
No 1,113 votes

(3) Elections Dates: The City Charter currently provides that the City's general election be held
in November of odd -numbered years and that the run-off, if necessary, be held the
December following. It is proposed that the Charter be amended to provide that the City's
general elections be held in even -numbered years in November in conjunction with
elections held by Miami -Dade County, and that the terms of all currently sitting elected
officials be extended to accomplish this goal.
Shall the above described amendment be adopted?
Yes 3,128 votes
No 1,425 votes
Section 2. Effective Date. This Resolution will become effective upon adoption.

We, the undersigned, County Court Judge SHELLEY J. KRAVITZ,
Chairperson, Board of County Commissioners, JOSE "PEPE" DIAZ, Member, and
Supervisor of Elections LESTER SOLA, Member, constituting the Board of County
Canvassers in and for said County, do hereby certify that we met on the 0 day of
November, A.D., 2008, and proceeded to publicly canvass the votes cast for the
charter amendment questions herein specified at the Sunny Isles Beach Special
Election held on the 4th day of November, A.D., 2008, as shown by the returns on file
in the office of the Supervisor of Elections. We do hereby certify from said returns as
follows:

Resolution Accepting the Results of the Special Election Held on November 4,
2008 to Consider Proposed Amendments to the City Charter
RECOMMENDATION:
It is requested that the City Commission adopt the attached Resolution accepting the results of
the Special Election held on November 4, 2008.
REASONS:
The Miami -Dade Department of Elections acted as the Canvassing Board for the Special
Election held on November 4, 2008, and has issued the official results on the following proposed
amendments to our Charter:
1) Permission to Redraw Residential Voting Areas by Ordinance Due to Increase in Population;
Shall the above described amendment be adopted? Yes 3,362 votes; No 1,308 votes.
2) Convert the At -Large Commissioner Seat to a Residential Voting Area Commissioner Seat;
Shall the above described amendment be adopted? Yes 3,416 votes; No 1,113 votes.
3) Changing the Election Dates by holding general elections in even -numbered years in
November in conjunction with elections held by Miami -Dade County, and that the terms of
all currently sitting elected officials be extended to accomplish this goal:
Shall the above described amendment be adopted? Yes 3,128 votes; No 1,425 votes.
