HomeMy WebLinkAboutReso 2023-3488RESOLUTION NO. 2023 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE SELECTION OF MEMBERS TO THE MOBILITY AND PEDESTRIAN SAFETY ADVISORY COMMITTEE FOR CALENDAR YEAR 2023; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in January of 2022, the City Commission of the City of Sunny Isles Beach ("City") adopted Ordinance No. 2022-577, establishing the "Mobility and Pedestrian Safety Advisory Committee" ("MAPSAC" or "Committee"); and WHEREAS, the MAPSAC is responsible for providing guidance and recommendations regarding the City's efforts to provide and promote safe and efficient use of all transportation modes within and immediately adjacent to the City, and all transportation systems, including but not limited to, streets, sidewalks, and related transportation facilities; and WHEREAS, the Committee shall be composed of seven (7) members who shall be appointed for a one-year term, and which may be renewed by the City Commission as often as desirable; and WHEREAS, Section 74-8 of the City's Code of Ordinances provides thattheMayor shall appoint the Chairperson and one (1) additional Committee member, the Vice Mayor shall appoint two (2) Committee members, and the remaining City Commissioners shall appoint one (1) Committee member each, and that the Vice Chairperson shall be selected by majority vote of the members of the Committee; and WHEREAS, Committee members shall be governed by the Rules of Procedure that govern the City Commission, the Florida Sunshine and Public Records Laws, and the terms of this Resolution; and WHEREAS, City residents interested in serving on the Committee have submitted board applications for the Commission's consideration. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Appointment of Committee Members. The Mayor shall appoint the Chairperson and one (1) additional Committee member, the Vice Mayor shall appoint two (2) Committee members, the remaining City Commissioners shall appoint one (1) Committee member each, and the Vice Chairperson shall be selected by a majority vote of the members of the Committee. Additionally, a member of the Committee forfeits his or her right to serve on the Committee if such member fails to comply with the requirements of the City Code, County Code and state law for serving on the Committee. The City Manager or designee shall create an R2023 Mapsac Appointments 2023 Page 1 of 3 application process for the selection of Committee members. The City Commission shall appoint applicants from the application process created by the City Manager or designee. Additionally: (a) Should any appointee resign during the term of the Committee, the appointing Commissioner shall select another appointee, provided said appointment is approved by majority vote of the City Commission. (b) Members shall be appointed to serve for a one-year (1) term, but that term may be renewed as often as desirable. (c) Attendance Policy: The City's attendance policy for members of boards and committees provides that, if a member fails to attend three (3) duly noticed meetings of such groups without being excused for good cause, the member may be removed from his or her seat automatically. A board member or committee member may not be removed from his or her seat unless the City Clerk certifies that the member has failed to attend three (3) duly noticed meetings. Committee duly noticed meetings of the board and committees include regular scheduled meetings and any special meetings. The City Commission finds that personal illness, family emergencies, military absences, family weddings, family graduation exercises, and bona fide business and vacation trips constitute good cause for nonattendance at a duly noticed meeting. Section 3. Selection of Committee Members. The City Commission hereby approves the following appointments to the Mobility and Pedestrian Safety Advisory Committee for calendar year 2023: Name Title Ashok R. Patel Chairperson Niki Capra Member Eric Luca Member Kenneth G. Percy Member Pavel Stoev Member Marianna Talalevsky Member Martin T. Keller Member Section 4. Annual Reporting Requirements. The Committee shall provide the City Commission with a report regarding the activities of the Committee, as deemed necessary or appropriate by the City Commission, from time to time. Section 5. Rules of Procedure. The Committee shall be governed by the Rules of Procedure that govern the City Commission, and subject to Florida's Sunshine and Public Records Law and Financial Disclosure requirements. REASONS: In January of 2022, the City Commission established the Mobility and Pedestrian Safety Advisor, Committee (MAPSAC) tasked with the responsibility of providing guidance and recommendation: regarding the City's efforts to provide and promote safe and efficient use of all transportation modes within and immediately adjacent to the City, and all transportation systems, including but not limited to, streets, sidewalks, and related transportation facilities. The MAPSAC will be composed of five members (5). The Mayor is entitled to appoint the Chairperso and the members of the City Commission are entitled to one (1) appointment each. The Vice. Chairperson is to be selected by a majority vote of the committee. The MAPSAC and its members will be governed by the Rules of Procedure that govern the Cit Commission, the Florida Sunshine and Public Records Laws, and the terms of the attached resolution.
