HomeMy WebLinkAboutReso 2023-3482RESOLUTION NO. 2023 - ' 2- A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE WAIVER OF THE BIDDING REQUIREMENTS OF CHAPTER 62 OF THE CITY'S CODE OF ORDINANCES; RATIFYING THE PURCHASE OF A CERTIFIED 2021 FORD PASSENGER VAN TRANSIT XLT FROM MIDWAY FORD, IN AN AMOUNT NOT TO EXCEED FIFTY-FIVE THOUSAND SIX HUNDRED NINETEEN DOLLARS AND TWENTY CENTS ($55,619.20), ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Public Works Department of the City of Sunny Isles Beach ("City") was in need of purchasing a passenger bus to ensure the City provided essential transportation services to its residents and visitors; and WHEREAS, City staff obtained a quote from Midway Ford ("Vendor") for the purchase of a certified used 2021 Ford Passenger Van Transit XL ("Bus"); and WHEREAS, pursuant to Section 62-12 City's Code of Ordinances the City Commission may waive the competitive bidding requirements upon the City Manager's recommendation that it is in the City's best interest to do so; and WHEREAS, due to market volatility and supply chain issues, the City Manager determined that it was in the best interest of the City to forego the competitive bidding procedures for the purchase of the Bus, and made said purchase; and WHEREAS, the City Commission wishes to ratify the waiver of the bidding requirements of Chapter 62 of the City's Code, and ratify the purchase of a certified used 2021 Ford Passenger Van Transit XL, in an amount not to exceed Fifty -Five Thousand Six Hundred Nineteen Dollars and Twenty Cents ($55,619.20), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Waiver of Bidding Requirements. The City Commission hereby ratifies the waiver of the bidding requirements set forth in Chapter 62 of the City's Code of Ordinances for the purchase of a certified used 2021 Ford Passenger Van Transit XL. Section 2. Ratification of Purchase. The City Commission hereby ratifies the purchase of a certified used 2021 Ford Passenger Van Transit XL, in an amount not to exceed Fifty -Five Thousand Six Hundred Nineteen Dollars and Twenty Cents ($55,619.20), attached hereto as Exhibit "A". Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. REASONS: The City provides free Community Shuttle Service 7 days per week with three lines runnin€ simultaneously for the convenience of residents and visitors. To efficiently and timely maintain essential public services, and understanding that the transit vehicle was needed as soon as possible to ensure the City had a sufficient number of vehicles to provide such shuttle service, staff solicited quotes from various dealerships for similar vans. The city issued PO # 23-00867 on February 14, 202--- for 02-for the purchase of said vehicle. Due to supply chain constraints and market volatility, Purchasing and Fleet found it in the city's best interest to waive bidding in the purchase of this Ford to avoid disrupting operations in the Public Works/Transportation department. Furthermore, various Ford dealerships emailed written responses to Purchasing stating they do not have inventory of new vans. According to one of the vendors, Forc will likely open the orders in late spring or early summer with a projected delivery time of 8-12 months. In accordance with Chapter § 62-12. - Waiver of Competitive Bidding Procedures - The Cit, Commission may authorize the waiver of competitive bidding procedures upon the recommendation of the City Manager that it is in the City's best interest to do so, to obtain goods and services which cannot be acquired through the normal purchasing process due to insufficient time, the nature of the Item Number: 10.1-1 goods or services, or other factors. Purchases authorized by waiver process shall be acquired after conducting a good faith review of available sources and negotiation as to price, delivery and terms. In accordance with the amended Budget, the City purchased a certified used 2021 Ford Passenger Var Transit XL totaling $55,619.20 with Midway Ford, which was received on February 15, 2023. ADDITIONAL INFORMATION: The van has approximately 40,000 miles. Although basic warranty has already expired, the warranty remains valid on Drivetrain, Emissions and Corrosion components. With the approval of this purchase, the transportation division shuttle buses consist of six (6) 24-28 passenger shuttle buses, one 14(12+2) passenger Minibus, one (1) 15 passenger van (on loan from CCS), and the proposed 15 passenger van. This Ford Passenger van will serve for field trips and a! backup if a bus were to go out of service due to mechanical disruptions, while maintaining ADA compliance.
