HomeMy WebLinkAboutReso 2023-3476RESOLUTION NO. 2023 - r` A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE EXPENDITURE OF FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT FOR THE PURCHASE OF A FORD F150 VEHICLE, IN AN AMOUNT NOT TO EXCEED SIXTY-ONE THOUSAND SIX HUNDRED TEN DOLLARS AND SEVENTY-FIVE CENTS ($61,610.75), ATTACHED HERETO AS EXHIBIT "A", IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, in compliance with the aforementioned legal requirements, the City Commission wishes to ratify the expenditure of DOJ forfeiture funds by the Chief of Police for the purchase of a Ford F150 vehicle, in an amount not to exceed Sixty -One Thousand Six Hundred Ten Dollars and Seventy -Five Cents ($61,610.75), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratification of Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, attached hereto as Exhibit "A", the City Commission hereby ratifies the expenditure of forfeiture funds by the Chief of Police in an amount not to exceed Sixty -One Thousand Six Hundred Ten Dollars and Seventy -Five Cents ($61,610.75), from the established Department of Justice federal forfeitures account for the purchase of a Ford F150 vehicle. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. REASONS: We are seeking approval to ratify the purchase of a Ford F150 to be used by the Strategic Service! Division and will be subtly marked with police "ghost" graphics for increased traffic enforcement. The vehicle was purchased using Department of Justice forfeiture funds for $61,610.75 from Bartow Forc via Charlotte County Contract No. 2021000541 which will include all emergency equipment.
