HomeMy WebLinkAboutReso 2023-3478RESOLUTION NO. 2023 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNTTO FUND A SCHOOL RESOURCE SERGEANT POSITION AND TO PURCHASE A VEHICLE FOR USE BY SAID OFFICER, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED TWENTY-FOUR THOUSAND EIGHT HUNDRED THREE DOLLARS AND FIFTY-ONE CENTS ($224,803.51), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in compliance with the aforementioned legal requirements to fund the position of a school resource sergeant and for the purchase of a vehicle for use by said sergeant, in an amount not to exceed Two Hundred Twenty -Four Thousand Eight Hundred Three Dollars and Fifty -One Cents ($224,803.51), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Partial Federally Forfeited Monies. Based on the attached certification, attached hereto as Exhibit "A", the Chief of Police is hereby authorized to spend Two Hundred Twenty -Four Thousand Eight Hundred Three Dollars and Fifty -One Cents ($224,803.51), from the established Department of Justice federal forfeitures account to fund the position of a school resource sergeant and for the purchase of a vehicle for use by said sergeant. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. REASONS: The Police Department is seeking approval to expend Department of Justice forfeiture funds to pay foi the salary and benefits of a full time school resource sergeant (SRS). The SRS position will allow ou police department to have a presence at the school and will supplement the current police officer provided by Miami -Dade Schools Police. The SRS will be expected to work in conjunction with thi Miami -Dade Schools Police Officer to serve the students, teachers, and parents as well as participate in educational programs such as DARE. The estimated amount to include fringe benefits needed tc fund this position is $180,000.00. Additionally, the SRS will need a vehicle designated for the sergeant's new role. We are seeking to use Department of Justice forfeiture funds to purchase a 2022 hybrid Ford Explorer for $43,479.51 whirl will include all emergency equipment and markings. The purchase will be made utilizing Charlotte County Contract No. 2021000541. FUNDING SOURCE: Funds have been appropriated in account no. 600-3-5210-000000-00000.
