Wngr WORD 4 CPH, Inc. /RFQ No. 14 -07 -02 Indication of How Long it Would Take to Implement Service after Authorized to Begin Each project is unique, but typically CPH will immediately start on any assigned project within 24 hours. As CPH is provided a task order, our team will develop a detailed schedule that will be submitted with our scope and fee for review by the City's project manager. This schedule will be reviewed with the City and adjusted to meet any necessary time frames or phasing anticipated by the City. In most cases, we are able to expedite the project schedule as a result of our 210+ staff members and our ability to assign additional architects, engineers, designers, technicians, drafters, etc. In fad, we routinely work with projects that have set time frames based on either federal regulations or by grants /funding requirements. Recently, CPH completed a trail and safety improvements project which was funded through the FDOT. From the original RFP and documents provided by the City, the project was to have an eight (8) month design schedule, but during our due diligence, we recognized that the FDOT agreement required the project to be completed in five (5) months. We were able to assign additional staff and expedite the survey utilizing our in -house survey crew and completed the project on time so that the client could encumber the funds from the DOT. In addition, during the life of a project, our project manager will be available 24/7. Todd H. Hendrix, P.E., CGC will be responsive to the City's needs and answer all calls, emails, or requests in a timely manner. Since we are nearby, Todd and our team will be available at a moment's notice. Our team will in most cases respond to the City within two hours, but will respond or call City staff back within 24 hours with clarifications or answers. 5 CPH, Inc. /RFQ No. 14 -07 -02 CPH's Relevant Experience and Qualifications Our team has been providing consulting services since the 1960's in Florida and was established as a Florida Corporation in 1981. CPH's in house capabilities include engineering, architecture, planning, landscape architecture, MEP engineering, structural engineering, traffic /transportation engineering, surveying, environmental science, and construction administration /inspection. Our firm has been located in South Florida for over a decade and has nearby offices in Miami and West Palm Beach. These offices are fully staffed with qualified full -time team members that can efficiently complete any task that may be assigned under this contract. Our firm and our team members have successfully completed architecture /engineering (A /E) services for over 150 local area projects, including streets /roadways, sidewalks, traffic calming improvements, roadway safety improvements, drainage improvements, site design for municipal buildings, utilities system analysis and design, stakeholder coordination, environmental engineering, parks master planning, multi - purpose buildings design, building rehabilitation, historic renovation, building expansion, and new facilities. Recently, our proposed team worked together on a large economic redevelopment project in Plantation, Florida. As a part of the redevelopment, CPH was responsible for traffic flow improvements, demolition plans, concept planning, rehabilitation plans, landscape architecture, civil (utility and drainage), permitting, and stakeholder coordination for the overall development which included 6 new buildings and 4 existing buildings and overall 210,561 square feet of improvements. 6 CPH, Inc. /RFQ No. 14 -07 -02 Why CPH is the Best Qualified to Perform the Contract CPH has extensive experience in South Florida, and has performed the required scope of services as outlined in the RFQ for over 150 projects throughout Miami -Dade County and the surrounding area. Our key personnel have a combined 260 years of experience and include licensed engineering, architects, surveyors, contractors, landscape architects, as well as environmental scientists and planners. The team proposed to work under this contract for the City of Sunny Isles Beach has the proper certifications and accreditations to successfully complete any task outlined in the scope of services. CPH is fully licensed to provide architectural, engineering, landscape architecture, surveying, planning, construction management, and environmental services. Our firm has a long history of providing these services in Florida and has been continuously licensed since 1981. CPH is a private employee -owned corporation. Due to our ownership, which includes project managers, we have a vested interest in ensuring the City of Sunny Isles Beach is satisfied with our services. Our Team Project Manager, Todd Hendrix, P.E., has been with CPH for over 16 years and has over 16 years of total experience in practice of A/E project management, design, permitting, and construction. He has served as project manager or engineer for over 250 projects throughout Florida and Puerto Rico. Todd has served numerous clients through similar continuing contracts and recently completed services for projects that include Public Works and Waste Management 58th Street Master Plan, Jackson Memorial Hospital Renovations Study, and Shoppes at The Fountains. CPH has a proven approach and workplan that will allow us to successfully complete the City's projects. Our base approach to continuing contracts, however, is what sets our team apart. In order to establish a centralized booking area, separate entrances for law enforcement officers (LEOs) and inmates had to be created. CPH provided a conceptual plan that converted an existing covered parking garage into a secured bus drop -off area for the inmates. CPH was also able to create a concept plan for a Sally Port and secured parking area for the LEOs. Both required new entrances to be installed on existing walls. Phase IV — Design Development • Based on the approved conceptual design, CPH will prepare project drawings and documents that will be approximately 60% complete. Drawings will be as required by the project type and may include, architectural, structural, civil, mechanical, electrical, plumbing, and /or landscape packages. CPH will compile a Project Status Report, based on the accomplishments of the preliminary services. The drawings will be submitted to the City for review and comment. • When appropriate to the project, CPH will prepare a drawing indicating soil boring locations for geotechnical testing. This information will be submitted with the preliminary plan for review and authorization to proceed with geotechnical testing. • CPH will customize construction cost- estimating documents for the project and will prepare a preliminary cost estimate. The cost documents will be used throughout the project to monitor construction cost and to attach costs to various alternatives. • CPH will meet with the necessary regulatory agencies and conduct a "pre- submittal" presentation. The project alternatives will be presented and we will gain knowledge of the agencies' concerns and expectations. • CPH will prepare and submit a preliminary technical specifications package based on the 60% package. Phase V — Construction Documents Services • CPH will incorporate comments obtained from the City's review, the public involvement process, our internal review and regulatory agencies into the project design to finalize the construction drawings. • CPH will refine the design and the Project Status Report will be revised to include progress of the project and delineate issues of concern, and decisions that need to be made. • The cost estimate will be updated and revised to reflect changes to the plan. • A permitting package will be prepared and sent to all of the regulatory agencies. Meetings will be conducted with the regulatory agencies and their comments will be addressed and incorporated into the drawings. • 90% construction drawings, specifications and cost estimate, will be submitted to the City for a second review. • Upon approval of the 90% per construction documents and receipt of the comments from the City, the public, our internal review and the regulatory agencies, the 100% construction documents will be finalized and submitted to the City for bidding. • The cost estimate will be updated based on unit price bid quantities. Phase VI — Bidding Services • CPH will assist the City in preparing bid advertisements and packages. • CPH will provide the City with the interpretation of the intent of the construction documents throughout the bidding process. All responses to questions will be recorded in writing and distributed to the City and prospective bidders. • During the bid process, if requested by the City, a pre -bid meeting will be conducted with prospective bidders to receive questions and comments. CPH will respond to all questions and comments in writing via the issuance of an addendum. • CPH will revise the bid documents and prepare bid addenda as required. 43 CPH, Inc. /RFQ No. 14 -07 -02 • CPH will be present for the bid opening and will assist the City in evaluating all bids submitted, including compliance with the construction documents, project budget, ability of the contractor to perform the work, etc. • Based on the review of the bids and contractor qualifications, CPH will recommend the lowest qualified bidder to the City. Phase VII — Construction Administration Services - During construction, CPH can provide construction administration services to represent the City as its Contract Administrator for projects as agreed upon with the City of Sunny Isles Beach. Specific services typically include: • The interpretation of drawings and specifications and issuance of instructions to the contractor performing the work. • The review and approval of contractor's submittals. • Periodic construction reports, based upon site inspections. Construction observation forms will be completed by the CPH representatives and will be included in the reports. Issues of special concern will be promptly identified and the Project Manager and the City will be notified. The frequency of inspections will be based on project requirements and determined in the scope of work specific to each project. • Issue field directives, respond to contractors request for information (RFI), issue supplementary instructions and clarifications and negotiate change orders as required. • Review monthly contractor pay requests and supporting data, based on field observation visits, review of test results and contractors performance and recommend approval or disapproval to the City. Record construction drawings will also be reviewed with pay requests to insure the contractor is keeping up with recording modifications to the drawings. • Make a substantial completion inspection and develop a punch list of items that the contractor is to complete in order to receive final payment. • Make a final inspection to insure the punch list items have been completed to the satisfaction of the City. Upon the successful completion of the punch list items by the contractor, CPH team members will review the final pay request and support data for recommendation to the City. • CPH will receive the record construction drawings from the contractor and incorporate the information provided into record as -built drawings. • CPH will conduct a warranty inspection after eleven months from final acceptance of the project, and submit a written report and /or punch list of items needing attention. 44 CPH, Inc. /RFQ No. 14 -07 -02 Ability to Meet Desired Timelines and Deadlines CPH has reviewed the scope of services and has developed ideas for staffing the projects. In addition to the trail, the project includes two trail head parking lots, two dual Bocce Ball courts, and five exercise stations. Key points along the trail include inlaid brick compass roses and street crossings. With Punta Gorda being the Hibiscus City, CPH prepared an intricate design of the City Seal for the intersection of Virginia Avenue and Shreve Street. This project runs through the historic district of the City, and therefore has a very high profile. CPH completed the design and secured the required permitting, including a delicate wetlands mitigation permit with the Southwest Florida Water Management District in a very timely manner. Unfortunately, due to funding constraints with the Florida Department of Transportation, the City was unable to proceed with the full design. CPH is now working with Punta Gorda to develop a minimal Base Plan for each Phase, along with Bid Alternates that will be added based on the actual bids and available funding. Luman, jr., P.E.Nice President Print or Type Name and Tide DECe Me 29, 2010 6 of 7 Litigation Statement The following cases have all been settled: Oceanside at Beverly Beach Condominium Association, Inc. vs. CPH Engineers, Inc. et al Case No. 2012 -CA- 001020 WEMED No. 08662 -02316; Policy No. USS 10 20263 Origination Date- August 2010 Settlement Date- September 2013 CPH Engineers, Inc. was named as one of twenty defendants in a suit by Oceanside at Beverly Beach Condominium Association, Inc. The Developers went into bankruptcy and the project was never completed. The Developers owed in excess of $1 million to the General Contractor, subcontractors, and consultants including CPH Engineers, Inc. The suit is for damages in excess of $1,005,000. All damages claimed are related to the lack of maintenance for an ocean front condominium or punch list items not completed due to lack of payment to all Defendants. In order to avoid defense costs and in order to obtain a future full indemnity, this case was settled in September 2013 and CPH paid $45,000 as part of an overall settlement. In addition, the Condominium Association has agreed to indemnify CPH from any future claims from any parties. Posen Construction Inc. vs. Lee County, CPH, et al. — Liberty File No. AESPC002759 Origination Date- November 2011 Settlement Date- May 2013 CPH was one of the parties being sued by Posen Construction, Inc. for negligence. CPH provided the utility relocation design plans for Lee County along Summerlin Road between Cypress Lake Drive and Boy Scout Road. The plans were developed using the survey and roadway design plans provided by Lee County. CPH used this information to determine utility conflict information and, in coordination with Lee County Utilities, design new facilities that were not in conflict with the proposed roadway improvements. As part of the installation of the new facilities, the existing pipelines were to be either abandoned in place or removed as called out on the design plans. Posen's assertion of negligence is hinged on encountering asbestos cement pipe. CPH was not responsible for any survey or field investigation to verify piping materials. This information was provided to CPH by the County. According to the Plans and Specifications, the Contractor, Posen, was responsible for the verification of the pipe and notification of any issues to the County. Accordingly, CPH filed to have the suit dismissed based on this fact. This case was dismissed in May 2013. Par Builders, Inc. vs. CPH Engineers, Inc. - RA &MCO File No. 090157 Origination Date- December 2008 Settlement Date- January 2012 CPH is being sued by PAR Builders, Inc. for contractual performance. CPH does not have an agreement with this company. Our contract for engineering was made with Hector Rivera of Edifica. Neither Hector Rivera nor Edifica are named in the law suit. PAR is alleging that CPH indicated that the permit process would take 6 months and that CPH delayed their project by not securing permits in a timely fashion. CPR's contract makes no representation to a schedule for obtaining permits, nor can CPH be responsible for the actions of the governmental agencies when the agencies themselves do not have timeline by which permits are to be issued. In addition, PAR alleges that CPH did not use correct building foot print to develop the site plan, grading plan, etc. Hector Rivera or Edifica provided CPH the building footprint to use as a basis for our design. Allegations were also made regarding the survey and CPH's contract states that the survey is to be provided by the Owner. Our position is that PAR needs to direct any issues related to the survey to Javier Bidot who was the Surveyor hired by the Owner. This case was settled in January 2012. Rivera v. CPH, et.al. B&A File No. 287 -023 (WAL -MART) Case No. 10CA3325AN Origination Date- May 2010 Settlement Date -June 2011 CPH was sued by Sasha D. Rivera for defects in the design of a parking lot and intersection at a Wal -Mart store located in Osceola County. The plaintiff alleges that a stop sign obstructed by a tree was the cause of a car accident in which her mother was a passenger and who died due to injuries sustained in the accident. The driver of the vehicle was convicted of vehicular homicide due to the fact that she was operating the vehicle while intoxicated and under the influence from snorting computer aerosol spray. The design of the parking lot is not the proximate cause of the accident; therefore, CPH had no liability. This case was settled for $10,000 to avoid the cost of litigation. Gary Wain and Barbara Wain v. CPH Engineers, Inc., et al Origination Date- August 2005 Settlement Date- December 2010 CPH received notification of a claim concerning a drainage issue at 1059 Henley Downs Place, Heathrow, FL. The property owner complained about water standing on the property during the unprecedented hurricane season in Florida in 2004 which resulted in record rainfall. CPH denied the claimant's allegations but CPH made a business decision to resolve the matter and reduce the legal fees by agreeing to a settlement whereby the developer and CPH are sharing in the cost of constructing a drain line along the easements, plus additional landscaping. CPH's share was $60,000.
