A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984 TO EXPEND FORFEITURE FUNDS
FROM THE DEPARTMENT OF JUSTICE ("DOJ") FOR THE PURCHASE OF TWO
MARINE PATROL VESSELS, AND REALTIME CRIME CENTER RELATED ELECTRONIC
SYSTEMS AND EQUIPMENT, IN AN AMOUNT NOT TO EXCEED TWO HUNDRED
EIGHTY THOUSAND NINE HUNDRED THIRTY-FOUR DOLLARS AND NINETY-ONE
CENTS ($280,934.91), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of
Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds
from the established Department of Justice ("DOJ") federal forfeiture account, for the approved
programs or purchases intended to enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b) upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification
that the request complies with the provisions of the aforementioned subsections; and
WHEREAS, on April 12, 2022, via Resolution No. 2022-3311, the City Commission of the City
of Sunny Isles Beach ("City") authorized the expenditure of forfeiture funds from the Department
of Justice ("Forfeiture Funds") for the purchase of a marine patrol vessel, in an amount not to
exceed $311,330.09; and
WHEREAS, on May 19, 2022, via Resolution No. 2022-3321 ("Resolution"), the City
Commission approved an Agreement with Gravois Aluminum Boats, d/b/a Metal Shark ("Vendor")
to build an deliver a marine patrol vessel ("Vessel"), in an amount not to exceed $310,677.39; and
WHEREAS, after adoption of the Resolution, the Vendor notified City staff that due to
supply chain issues the manufacturer would be unable to build and deliver the Vessel; and
WHEREAS, on June 15th, 2023, via Resolution No. 2023- U10 , the City Commission
repealed the Resolution and approved the purchase of two (2) Vessels from Phoenix Trading Inc.
("Phoenix"), in an amount not to exceed $398,454.40; and
WHEREAS, the Chief of Police has submitted a request to expend Forfeiture Funds, in
compliance with aforementioned legal requirements, for the difference in the amount not to
exceed Eighty -Seven Thousand One Hundred Twenty -Four Dollars and Thirty -One Cents
($87,124.31) attached hereto as Exhibit "A"; and
WHEREAS, the Chief of Police has also submitted a request to expend Forfeiture Funds in
compliance with the aforementioned legal requirements for the purchase of a Real Time Crime
Center Related Electronic Systems and Equipment, in an amount not to exceed One Hundred
Ninety -Three Thousand Eight Hundred Ten Dollars and Sixty Cents ($193,810.60), attached hereto

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Federally Forfeited Monies. Based on the attached certification, the
Chief of Police is hereby authorized to spend up to Two Hundred Eighty Thousand Nine Hundred
Thirty -Four Dollars and Ninety -One Cents ($280,934.91), attached hereto as Exhibit "A", from the
established Department of Justice federal forfeitures account for the difference in purchase price
of two (2) marine patrol vessel, and a Real Time Crime Center Related Electronic Systems and
Equipment.

Authorize the Expenditure of DOJ Funds for the Purchase of Two Polic(
Vessels and a Real Time Crime Center Build
RECOMMENDATION:
Staff Recommends the approval of this Resolution.
REASONS:
The Police Department was given approval to utilize Department of Justice forfeiture funds tc
purchase a police vessel in April 2022 for $311,330.09. The vendor was unable to fulfill the order of
that vessel per the terms of the contract which was terminated. The Police Department is now seeking
approval to utilize an additional $87,124.31 to purchase two police vessels from Phoenix Trading Inc
via GSA contract 47QMCA18D0006. The new vendor has two vessels built and in stock, available fo
immediate purchase. Having a second police vessel will allow the newly expanded Marine Patrol Unii
to be operational seven days a week. Each operator would be assigned their own vessel which would
minimize the strain of operating a vessel everyday, extending the life of the vessels and ensuring they
are operational as much as possible.
Additionally, the Police Department is seeking approval to purchase a Real Time Crime Center builc
from Millenium Products Inc. for $193,810.60 which includes a 10% contingency via GSA contras
GS07F0031W. The Real Time Crime Center build will allow the Police Department to maximize thi
effectiveness of the license plate reader and CCTV systems by utilizing six 55" narrow bezel videc
monitors and requisite software that will act as repository for the systems. This will allow our
Communications Officers to be able to access both systems from their work stations. They will be able
to utilize both systems on the large interfaces to assist our officers with getting real time information
they need to do their jobs. This large display will also allow our Communications Officers to passively

monitor different areas of the city and potentially private entities who elect to share their video feeds
with the Police Department. This collaboration will enhance public safety and ensure the use of this
technology is maximized.
