A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, REJECTING ALL BIDS RECEIVED FOR INVITATION TO BID NO. 23-03-01
FOR CITY OF SUNNY ISLES BEACH CENTRAL ISLAND DRAINAGE IMPROVEMENT &
CITY OF NORTH MIAMI BEACH DISTRIBUTION SYSTEM WATERMAIN
REPLACEMENTS; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS
NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, on March 27, 2023, the City of Sunny Isles Beach ("City") issued and advertised
Invitation to Bid No. 23-03-01 ("ITB") for the City of Sunny Isles Beach Central Island Drainage
Improvement & City of North Miami Beach Distribution System Watermain Replacements
("Services"), and received one (1) bid; and
WHEREAS, upon careful review and consideration, the City Manager recommends
rejection and re -advertisement of the ITB; and
WHEREAS, pursuant to Section C-3.10 (a) of the City's Charter, the City Commission, upon
recommendation of the City Manager and by a majority, has the authority to reject all proposals
and re -advertise; and
WHEREAS, the City now wishes to reject all bids submitted in response to ITB No. 23-03-
01.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Resection of All Bids. The City Commission hereby rejects all bids received for
Invitation to Bid No. 23-03-01.
Section 2. Authorization of the City Manager. The City Manager is hereby authorized to do
all things necessary to effectuate this Resolution.

Distribution System Watermain Replacement
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
On December 19, 2022 the City of Sunny Isles Beach ("SIB") and the City of North Miami Beac
("NMB") entered a memorandum of understanding for a joint procurement of a capital improvement
construction project. SIB proposed to complete the Central Island Drainage Improvements projec
("SIB Project") and NMB is proposed to complete the Sunny Isles Distribution System Watermai
Replacement project ("NMB Project"). SIB and NMB wished to construct the Projects in conjunctio
with each other, concurrently, utilizing the same contractor, to minimize the impacts to the residents
of the City and to realize potential cost savings by combining the Projects. Each Party was responsible
for bearing its own costs and expenses related to any protests that may be filed with their respective
agency.
On March 27, 2023, the city of sunny isles beach (lead agency) released Invitation to Bid # 23-03-01,
titled City of Sunny Isles Beach Central Island Drainage Improvement & City of North Miami Beac
Distribution System Watermain Replacements on DemandStar. The ITB was broadcasted to 2,58`
contractors. On April 12, 2023, the city held a mandatory pre-bid meeting, in which eleven (11)
interested bidders attended the sunshine meeting.
On June 7, 2023, the city's clerk office received (1) bid. As a result of the limited competition and the
single bid total being in excess of each city's budget, the recommendation is to reject the single bid.
Pursuant to the City of Sunny Isles Beach Code of Ordinances, Chapter 62, Section 8, Procedures fc

Reject all bids. This resolution is requesting authorization to reject all bids and re -advertise.
Upon the termination of the Cone of Silence, the Procurement Departments of each agency will due
diligently perform market research to fact -find the driving reasons behind the limited response.
As per F.S. 119.071(1)(b)3, re -advertised solicitations are exempt from inspection until such time as
the agency provides notice of an intended decision or until 30 days after opening the bids, proposals,
or final replies, which is earlier (F.S. 119.071(1)(b)2) but not to exceed 12 months.
