A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE
COMPREHENSIVE CRIME CONTROL ACT OF 1984, TO EXPEND FORFEITURE FUNDS
FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT TO
PURCHASE BOAT LIFTS FOR THE MARINE PATROL STATION AT BELLA VISTA PARK,
IN AN AMOUNT NOT TO EXCEED THIRTY-NINE THOUSAND DOLLARS AND NO
CENTS ($39,000.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of
Sunny Isles Beach, Florida ("City") and its Police Department are authorized to expend forfeiture
funds from the established Department of Justice ("DOJ") federal forfeiture account, for approved
programs or purchases intended to enhance law enforcement purposes; and
WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida
Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a
municipality, liens and forfeiture funds may be expended if accompanied by written certification
that the request complies with the provisions of the aforementioned subsections; and
WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in
compliance with the aforementioned legal requirements to purchase boat lifts for the marine
patrol station at Bella Vista Park, in an amount not to exceed Thirty -Nine Thousand Dollars and No
Cents ($39,000.00), attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Expenditure of Federally Forfeited Monies. Based on the attached certification,
attached hereto as Exhibit "A", the Chief of Police is hereby authorized to spend Thirty -Nine
Thousand Dollars and No Cents ($39,000.00), from the established Department of Justice federal
forfeitures account to purchase boat lifts for the marine patrol station at Bella Vista Park.
Section 2. Effective Date. This Resolution shall become effective immediately upon adoption.

RE: Authorize the Expenditure of DOJ Funds for the Purchase of Two Boat Lift
for the Marine Patrol Vessels
RECOMMENDATION:
Staff recommends approval of this resolution.
REASONS:
The Police Department has expanded the service offered to the community by purchasing two marine
patrol vessels to patrol Sunny Isles Beach waterways. There is a need to acquire boat lifts for the
vessels at the new dock space located at Bella Vista Park to properly store the vessels. A vendor waE
awarded the bid for a "Turnkey Design and Installation of Boat Lifts" in response to RFP 23-07-01. E
portion of the proposal is able to be funded by Department of Justice forfeiture funds. The Police
Department is requesting approval to spend $39,000.00 of the aforementioned DOJ funds to purchase
the two boat lifts which is a portion of the awarded bid.
FUNDING SOURCE:
Funds have been appropriated in account 600-3-5210-464200-99504.
