HomeMy WebLinkAboutReso 2023-3541RESOLUTION NO. 2023 - J A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, TERMINATING THE STATE -FUNDED GRANT AGREEMENT WITH THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION (FPN 445792-1-54-01) PROVIDING FOR GRANT FUNDING FOR THE PROPOSED PEDESTRIAN PARK BRIDGE AT 174" STREET; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on November 21, 2019, via Resolution No. 2019-3016, the City Commission of the City of Sunny Isles Beach ("City") approved a Stated -Funded Grant Agreement with the Florida Department of Transportation ("FDOT") to partially fund the construction of a Pedestrian Park Bridge ("Pedestrian Bridge") in an amount not to exceed Four Hundred Twenty - Five Thousand Dollars and No Cents ($425,000.00) ("Agreement"); and WHEREAS, the State -Funded Grant Agreement was fully executed and entered into by the City and FDOT on February 20, 2020; WHEREAS, to date, the City has not proceeded with the project and has not received any of the grant funds; and WHEREAS, pursuant to Paragraph 5(b) of the Agreement, the parties may terminate the Agreement when "its continuation would not produce the beneficial results commensurate with the further expenditure of funds;" and WHEREAS, the City Commission has determined that the proposed Pedestrian Park Bridge would not produce the beneficial results commensurate with the further expenditure of funds; and WHEREAS, the City now wishes to terminate the Agreement. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Approving the Termination of the FDOT State -Funded Grant Agreement. The City Commission hereby approves the termination of the FDOT State -Funded Grant Agreement, dated February 20, 2020 (FPN 445792-1-54-01). Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. REASONS: The City of Sunny Isles Beach has determined that the proposed Pedestrian Bridge located at Collin. Avenue and 174th Street would not produce the beneficial results commensurate with the further expenditure of funds and desires to terminate the agreement with FDOT.
