PZ2023-10) SUBMITTED BY LA PLAYA BEACH ASSOCIATES, LLC, TO ALLOW A VARIANCE FROM THE REQUIREMENTS OF §265-63.1 OF THE CITY'S LAND DEVELOPMENT REGULATIONS TO INCREASE THE ALLOWABLE SIZE OF TWO WALL SIGNS FROM 35 SQUARE FEET TO 58 SQUARE FEET, AND FROM 35 SQUARE FEET TO 43 SQUARE FEET, AT THE PROPERTY LOCATED AT 18801 COLLINS AVENUE, SUNNY ISLES BEACH, FLORIDA; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, La Playa Beach Associates, LLC (the "Applicant") submitted a zoning variance application, numbered PZ2023-10 (the "Application"), to the City of Sunny Isles Beach, Florida ("City") requesting the following: a. Pursuant to Section §265-63.1 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a sign ordinance variance to increase the allowable size of a wall sign from 35 square feet to 58 square feet; and b. ADDRESS: 18801 Collins Avenue, Sunny Isles Beach, FL 33160 WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the information contained in the City's Development Services Department Development Review Report; and WHEREAS, notice was provided to all interested parties regarding the Application; and WHEREAS, on September 21, 2023, the City Commission conducted a public hearing on the Application; and WHEREAS, the City Commission reviewed the Application, the written and oral recommendations of the Development Services Department and finds that the Application meets the criteria for variance under the Land Development Regulations and the Comprehensive Master Plan of the City. 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the application and the standards for approval for a variance under the Land Development Regulations and the Comprehensive Master Plan of the City, the City Commission makes the following findings and conclusions: The application for variance approval seeking the following variance: a. a sign ordinance variance to increase the allowable size of a wall sign from 35 square feet to 58 square feet; and b. a sign ordinance variance to increase the allowable size of a wall sign from 35 square feet to 43 square feet. is consistent with the City's Comprehensive Plan and generally consistent with the City's Land Development Regulations. Section 3. Approval. The Applicant's request for approval of the following variance: a. a sign ordinance variance to increase the allowable size of a wall sign from 35 square feet to 58 square feet; and b. a sign ordinance variance to increase the allowable size of a wall sign from 35 square feet to 43 square feet. is hereby APPROVED, subject to the following conditions: 1. The plans reviewed are entitled "St. Regis Sales Center Sign" prepared by Emerald Designs, stamped received July 7, 2023, consisting of four (4) sheets and a survey entitled "La Playa Sunny Isles Beach" prepared by Fortin, Leavy, Skiles, Inc. stamped received July 7, 2023, consisting of one (1) sheet. Plans are subject to revisions -based comments provided by zoning staff of the City of Sunny Isles Beach. 2. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Planning and Zoning Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant 3 shall be required to obtain another approval of the City Commission. 3. That the Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. 4. That the approved variance shall remain valid for a period of 24 -months from the date of the approval. If no building permit is issued within the 24 -month time period, the variance approval shall be considered null and void and of no force and effect. 5. That the Applicant complies with all City Ordinances, County, State and Federal Laws and Regulations applicable to development and permit approvals. Section 4. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provisions and such holding shall not affect the validity of the remaining potions of this Resolution. Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 7. Effective Date. This Resolution shall become effective upon adoption. Residential densities with bonuses may not exceed eighty (80) units per acre for apartments. The density may be increased by the utilization of TDRs. Zoning District: Mixed Use — Resort (MU -R) This district provides for multifamily dwellings at a maximum density of 80 dwelling units per acre for condominiums and 125 dwelling units for apartment/hotel. Apartments, hotels, motels and apartment -hotels, commercial services and retails goods internal to the buildings and conference facilities are permitted uses. The density may be increased by the utilization of TDRs. Site Description: The site is a rectangular shaped lot, located on the east side of Collins Avenue. The subject property was developed in 1963 with a two-story motel with a total of 349 units. The motel was demolished in 2015. On July 16, 2015, the temporary "Varadero Sales Center" was approved by the City Commission per Resolution 2015-2444 as a single -story building, 7,801 sq. ft. in size, that consists of offices and showrooms. The sales center supports the marketing of the future development named "St. Regis Residences," formally known as La Playa Varadero. The sales center is fully constructed and operational. REQUESTS The following requests will enable the Applicant to install two wall signs on the front fagade of the sales center: Pursuant to Section §265-18 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a Site Plan Modification to an approved site plan to change the location of building signage. The request is for two wall signs facing Collins Avenue. 2. Sign ordinance variance per Section §265-63.1 of the City of Sunny Isles Beach Code of Ordinances to increase the allowable size of wall signs from 35 square feet to 43.1 square feet and 58 square feet pursuant to Section §265-56.B.(3). IV. ZONING REVIEW The plans reviewed are entitled "St. Regis Sales Center Sign" prepared by Emerald Designs, stamped received July 7, 2023, consisting of four (4) sheets and a survey entitled "La Playa Sunny Isles Beach" prepared by Fortin, Leavy, Skiles, Inc., stamped received July 7, 2023, consisting of one (1) sheet. 1. The following is a review of §265-56.B of the Land development Regulations, titled, "Nonresidential, Town Center and Mixed -Use Resort District Signs:" § 265-56. B. Wall signs § 265-56. B. (1) Approvals necessary: City Manager or designee. Comment: Complies, satisfied with the processing of this application and pending building permit. § 265-56. B. (2) Maximum number: (a) Office: one per wall face, or two for walls over 80 feet in length. (b) Retail: one sign per tenant. On -corner or through -store locations may have an additional wall sign. Such second sign shall be limited to 50% of the square footage of the primary sign and shall not be placed on the same building elevation as the primary sign. Comment: Complies, two wall signs are allowed, as the southern wall face is 107 feet in length. However, one wall sign was approved with the original site plan; therefore, the site plan modification is requested to allow two. § 265-56. B. (3) Maximum sign area: For establishments with up to 200 feet of frontage on a single elevation, one square foot for each lineal foot of tenant frontage up to a maximum of 35 square feet. Comment: Does not comply, variance requested. One sign is 58 square feet and the other sign is 43.1 square feet, for a total of 101 square feet of wall signage. §265-56.B.(4) Illumination. reverse channel or channel letter sign only. Comment: Complies, the proposed wall signs are back -lit. §265-56.B.(5) Supplemental provisions. See gas station provisions contained in this article. Comment: Not applicable. § 265-56.8. (6) Multitenant shopping center shall conform with § 265-58J of this article. Comment: Not applicable. 2. The following are the standards of review for a sign ordinance variance from code Sec. 265-63.1.C.: Review by the City Commission. The application for a variance may be granted if the City Commission finds: (1) The variance is not contrary to the public interest; (2) Special conditions and circumstances do not result from actions of the applicant; (3) A literal enforcement of the provisions of this chapter may result in unnecessary hardship. Comments: See attached Letter of Intent from the Applicant and final analysis below provided by staff. V. FINAL ANALYSIS To allow the proposed signage, the City must consider the number of wall signs and the size of the wall signs. First, the site plan modification must be approved to increase the number of wall signs allowed from one (1) to two (2). The Land Development Regulations allow offices to have two signs on walls longer than 80 feet. The west fagade of the sales center, that faces Collins Avenue, is 107 feet in length. Therefore, the request for two wall signs is consistent with the Land Development Regulations. Second, the proposed size of the signs requires a sign ordinance variance. As stated in the sign ordinance purpose and intent of code Sec. 265-50.B.(2), these regulations Page 5 of 8 17 September 21, 2023 PZ2023-10 "promote positive conditions for sign communication enabling the identification of residences and business but limiting the size and number of signs and sign messages to a minimum reasonably necessary while, at the same time, avoiding nuisances to nearby properties and promoting an attractive environment and lessening visual clutter." The City's sign ordinance establishes a maximum wall sign area of 35 square feet per each wall sign. The subject property does not have a special condition or circumstance to justify an increased wall sign size above the 35 square foot maximum. A literal enforcement of the provisions of the sign ordinance would allow the sales center to have two wall signs, but both at a size of 35 square feet each, or 70 square feet total. The proposed variance to increase the total size of the wall signs to 101 square feet conflicts with the purpose and intent of lessening visual clutter. Staff has compiled the relevant facts of the requested site plan modification and sign ordinance variance and recommends the application be presented to City Commission for consideration. VI. CONDITIONS If the City approves the site plan modification, it will be subject to the following conditions set forth in Section VI. Both signs exceeded the maximum allowed of 35 sq.ft. per Code Sec. 265-56(B)(3). The "St Regis Residences" sign is 37"x226" (58 SQ.FT.) The "Fortune International Group — Chateau Group" is 109"x57" (43 SQ.FT.) The front wall is composed of a modulation of 16 porcelain tiles of 122" x 60" each (northwest and southwest). For scale and harmonic proportion we used one module for the name "St Regis Residences" (northwest) and two modules for "Fortune International Group — Chateau Group" (southwest) sign. We use the same background material as the fagade to maintain homogeneity and ensure that only the letters are visible from Collins Avenue. Placement of the fagade sign is far from sidewalk and with limited visibility due to the distance, the vegetation and the art placed in the property. Fagade sign is mounted more than 320 feet away from the sidewalk. We strongly believe signs are necessary for the public and potential clients to identify the Sales Gallery within such a big lot. Bringing such a reputable brand to Sunny Isles Beach will help the Sales of this Monument project. Fast sales will aid on expediting the construction of the second phase of the project.
