A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, EXPRESSING SUPPORT FOR A NO -WAKE ZONE IN DUMBFOUNDLING
BAY; DIRECTING THE CITY MANAGER AND CITY ATTORNEY TO BEGIN THE
PROCESS OF SUBMITTING AN APPLICATION AND AN ORDINANCE FOR REVIEW
AND APPROVAL BY THE FLORIDA FISH AND WILDLIFE CONSERVATION
COMMISSION; DIRECTING THE CITY CLERK TO DISTRIBUTE COPIES OF THIS
RESOLUTION; AUTHORIZING THE CITY MANAGER AND THE CITY ATTORNEY TO
DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Intracoastal Waterway system ("ICW") is an inland waterway that runs
along the Atlantic Seaboard; and
WHEREAS, the IWC has a body of water located on the Atlantic Coast of South Florida
known as Biscayne Bay; and
WHEREAS, Biscayne Bay has a portion of its body of water located within the
boundaries of the City of Sunny Isles Beach ("City") known as Dumbfoundling Bay ("DFB"); and
WHEREAS, DFB is an integral part of the natural ecosystem and serves as a recreational
hub for boating, fishing, and other water activities; and
WHEREAS, the area has seen a significant increase in boating and recreational water
activities, causing considerable disruption to the marine environment; and
WHEREAS, excessive wakes have may cause boating accidents, property damage, and
jeopardize the safety of swimmers, kayakers, and paddle boarders; and
WHEREAS, the Florida Fish and Wildlife Conservation Commission ("FWC") has
jurisdiction over DFB; and
WHEREAS, based on the aforementioned, the City Commission finds that it is in the best
interest of the City, its residents, and visitors to establish a no -wake zone in DFB, from the
northern limits of the City, south to 183rd Street ("Targeted Area"); and
WHEREAS, the City Commission directs the City Manager and City Attorney to begin the
process of submitting an application and drafting an ordinance for review and approval by FWC
to establish a no -wake zone in the Targeted Area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SUNNY ISLES
BEACH, FLORIDA:
Section 1. Directive to the City Manager. The City Commission hereby directs the City
Manager to begin the application process with the Florida Fish and Wildlife Conservation

Commission to establish a no -wake zone in Dumbfoundling Bay, from the northern limits of the
City, south to 183rd Street.
Section 2. Directive to the City Attorney. The City Attorney is hereby directed to draft an
ordinance establishing a no -wake zone in Dumbfoundling Bay, from the northern limits of the
City, south to 183rd Street, for review and approval by the Florida Fish and Wildlife Conservation
Commission.
Section 3. Directive to the City Clerk. The City Clerk is hereby directed to distribute copies
of this Resolution to the Florida Fish and Wildlife Conservation Commission, Miami -Dade
County Board of Commissioners, and the City of Aventura.
Section 4. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 5. Effective Date. This Resolution will become effective upon adoption.

Submitting Application and Ordinance for a No -Wake Zone
RECOMMENDATION:
This Resolution is presented for you consideration.
REASONS:
Dumbfounding Bay (DFB) is the body of water located in the northwest end of the City. It is an integra
part of the natural ecosystem and serves as a recreational hub for boating, fishing, and other water
activities. This area has seen a significant increase in boating and recreational water activities, causing
considerable disruption to the marine environment. Excessive wakes may cause boating accidents,
property damage, and jeopardize the safety of swimmers, kayakers, and paddle boarders.
The Florida Fish and Wildlife Conservation Commission (FWC) has jurisdiction over DFB and hZ
procedures in place to authorize municipalities that have bodies of water within its boundaries to
apply and establish a no -wake zone. The purpose of this Resolution is to direct the City Manager and
City Attorney to begin the process of submitting an application and drafting an ordinance for review
and approval by FWC to establish a no -wake zone in DFB.
