Recalde (the "Applicant") submitted a zoning variance application, numbered PZ2023-17 (the "Application"), to the City of Sunny Isles Beach, Florida ("City") requesting the following: 1. Pursuant to Section 265-45 of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests a variance to increase the maximum gazebo size from one hundred and fifty square feet (150 sq. ft.) to two hundred and seventy-eight square feet (278 sq. ft.). 2. Pursuant to Section 265-45 of the City of Sunny Isles Beach Land Development Regulations, the Applicant requests a variance to reduce the gazebo setback from six feet (6') to zero feet (0') from the side and rear lot lines. 3. Pursuant to Sections 265-31 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is requesting a decrease of the minimum landscaping and green area requirement from twenty-five percent (25%) to fourteen and sixteen hundredths percent (14.16%), of the total lot area. LEGAL: LOT 20, Block 8, Golden Shores Ocean Boulevard Estates, Section B, According to the Plat Thereof, As Recorded in Plat Book 51, Page 15 of the Public Records of Dade County, Florida. ADDRESS: 241 189 Terrace, Sunny Isles Beach, FI 33160 WHEREAS, the public hearing of the City Commission was advertised and held as required by law, all interested parties concerned in the matter were heard, and due and proper consideration was given to the matter and to the information contained in the City's Development Services Department Development Staff Report; and WHEREAS, notice was provided to all interested parties regarding the Application; and WHEREAS, on January 18, 2024, the City Commission conducted a public hearing on the Application; and WHEREAS, the City Commission reviewed the Application, the written and oral recommendations of the Development Services Department and finds that the Application, in limited part, meets the criteria for variance under the Land Development Regulations and the Comprehensive Plan of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the application and the standards for approval for a variance under the Land Development Regulations and the Comprehensive Plan of the City, the City Commission makes the following findings and conclusions: The application for a variance approval seeking an increase in the maximum gazebo size from one hundred and fifty square feet (150 sq. ft.) to two hundred and seventy-eight square feet (278 sq. ft.) is not consistent with the City's Comprehensive Plan and not generally consistent with the City's Land Development Regulations. The application for a variance approval seeking a reduction in the gazebo setback from six feet (6') to zero feet (0') from the side and rear lot lines is not consistent with the City's Comprehensive Plan and not generally consistent with the City's Land Development Regulations. The application for a variance approval seeking a decrease of the minimum landscaping and green area requirement from twenty-five percent (25%) to fourteen and sixteen hundredths percent (14.16%) of the total lot area is consistent with the City's Comprehensive Plan and generally consistent with the City's Land Development Regulations. 2 Section 3. Approval. The Applicant's request for approval of a decrease of the minimum landscaping and green area requirement from twenty-five percent (25%) to fourteen and sixteen hundredths percent (14.16%) of the total lot area, is hereby APPROVED, subject to the following conditions: That the plans in the approval be substantially in accordance with that submitted for public hearing, the plans are "Boundary Survey," by MAQ Services, Inc. stamped received December 27, 2023, consisting of two sheets. Plans are subject to revisions based on comments provided by zoning staff of the City of Sunny Isles Beach. Plans are subject to modification. 2. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Development Services Department and be consistent with the specific plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 3. That the approved plan shall remain valid for a period of 24 -months from the date of the site plan modification approval. If no building permit is issued within the 24 -month time period, the site plan shall be considered null and void and of no force and effect. 4. That the Applicants comply with all City Ordinances, County, State and Federal Laws and Regulations applicable to development and permit approvals. Section 4. Denial. The Applicant's request for approval of an increase in the maximum gazebo size from one hundred and fifty square feet (150 sq. ft.) to two hundred and seventy-eight square feet (278 sq. ft.) and a reduction in the gazebo setback from six feet (6') to zero feet (0') from the side and rear lot lines are hereby DENIED. Section 5. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 6. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provisions and such holding shall not affect the validity of the remaining potions of this Resolution. Section 6. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 7. Effective Date. APPLICATION SUMMARY Application Number: PZ2023-17 Application Summary: The Applicant, owner of the property, is seeking approval of variances in relation to completed renovations and additions to a single-family home. The proposed variances are to increase the allowable maximum gazebo size, to allow the gazebo to stay on the property line as -built, and to decrease the minimum required landscaped green area. Applicant/Owner: Hernan R. Recalde 241 189 Terrace Sunny Isles Beach, FI 33160 Page 1 of 8 10 January 18, 2024 PZ2023-17 II. SITE INFORMATION Location: 241 189 Terrace Property Size: 7,500 sq. ft. (0.17 acres) Folio: 31-2202-008-0590 Legal Description: Lot 20, Block 8, Golden Shores Ocean Boulevard Estates, Section B, According to the Plat Thereof, As Recorded in Plat Book 51, Page 15 of the Public Records of Dade County, Florida. Site Description: The property is a rectangular lot in the Golden Shores residential neighborhood that has frontage on 189th Terrace. Site History: A single-family house was constructed on the property in 1951. A building permit for pavers in the backyard of the property was approved in 2005 (permit B0000-0500609). In 2016, the Applicant submitted a building permit for interior renovation and first and second -floor additions (permit 2016-1302). The scope of the proposed work triggered the entire site to be in compliance with the zoning code regulations. Therefore, the landscaped green area and setbacks were required to be met. The permit plans were adjusted and approved with demolition of the existing gazebo and removal of some pavers to comply with zoning code requirements. The additions and interior renovations have been completed; however, the Applicant is seeking approval to keep the gazebo and pavers as -built instead of removing them. This has resulted in the request for three variances, in effort to have the 2016 permit closed. Future Land Use: Low Density Residential This category is intended to have residential densities ranging from a minimum of 2.5 to a maximum of 6.0 dwelling units per gross acre. This density category is generally characterized by single-family housing (e.g. single family detached, cluster, zero -lot -line and townhouses). It could include low-rise apartments with extensive surrounding open space or a mixture of housing types provided that the maximum gross density is not exceeded. Zoning District: Single-family Residential (R-1) The Single-family Residential (R-1) District provides for low- density residential . development of one -family detached dwellings of up to one unit per lot at a maximum density of six Page 2 of 8 11 January 18, 2024 PZ2023-17 units per net acre consistent with the City's Comprehensive Plan Land Use Element and the corresponding Low Density Residential land use category. The uses within this district shall be consistent with, but may be more restrictive than, the Low Density Residential Land Use category permitted uses. Adjacent Properties: 111. REQUEST The Applicant renovated and constructed additions to the existing single-family house, including adding a second story. The building additions expanded the footprint of the house and therefore triggered compliance with zoning code requirements for green area and setbacks. The following variance requests will allow the existing gazebo and pavers on the property to remain as -is: 1. Pursuant to Section 265-45 of the City of Sunny Isles Land Development Regulations, the Applicant requests a variance to increase the maximum gazebo size from one hundred and fifty square feet (150 sq. ft.) to two hundred and seventy-eight square feet (278 sq. ft.). 2. Pursuant to Section 265-45 of the City of Sunny Isles Land Development Regulations, the Applicant requests a variance to allow the gazebo to reduce the gazebo setback from six feet (6') to zero feet (0') from the side and rear lot lines. 3. The following is a review of the Land Development Regulations relevant to the construction of the new single-family home and associated variance request: Page 3 of 8 12 January 18, 2024 PZ2023-17 ■ Sec. 265-45.F. Accessory uses - Gazebos. (1) No gazebos shall be permitted within the required front yard area, or within utility, drainage or access easements. Comments: Gazebo is located within the backyard and not within an easement. Complies. (2) Gazebos must be set back at least six feet from the side and rear lot lines: Comments: Does not comply, the existing gazebo is setback zero feet from the side and rear lot lines. Variance requested. (3) No gazebo shall have an area (footprint) larger than 100 square feet per 5,000 square feet of lot area: Comments: Does not comply, the existing gazebo is 278 sq. ft., whereas the maximum allowed for the subject site size is 150 sq. ft. Variance requested. (4) No gazebo shall have a height larger than 35 feet. Comments: Gazebo height is not larger than 35'. Complies. ■ Sec. 265-31.D. (5) Single -Family Residential (R-1) site development standards. - Landscaping and green area. (1) Lot coverage. The combined. lot area covered by all principal and accessory buildings shall not exceed 42%. Landscaping and green area must account for at least 25% of the total lot area. Comments: Does not comply, the existing landscaping and green area is 14.16% of the total lot area (1,061.64 sq. ft.), whereas 25.00% (1,875.00 sq. ft.) is required. This is a delta of 814 sq. ft. Variance requested. 2. The following are the standards of review for variance applications from code Sec. 265- 15.G.: A variance shall be granted only where competent and substantial evidence presented in the particular case shows that all of the following are met: (1) Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same zoning district, Page 4 of 8 13 January 18, 2024 PZ2023-17 (2) The special conditions and circumstances do not result from the actions of the petitioner; (3) Literal interpretation of the provisions of these LDRs deprives the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and works unnecessary and undue hardship on the applicant, (4) The alleged hardship is not economic and has not been deliberately created to establish a use or structure, which is not otherwise consistent with the LDRs. (5) Granting of the variance requested conveys the same treatment to the individual owner as to the owner of other lands, buildings or structures in the same zoning district, (6) The variance, if granted, is the minimum variance that makes possible the reasonable use of the land, building or structure; and (7) The grant of the variance is in harmony with the general intent and purpose of these LDRs, is not injurious to the neighborhood, or otherwise detrimental to the public safety and welfare and will not substantially diminish or impair property values within the vicinity. Comments: See attached Letter of Intent from the Applicant and final analysis below provided by staff. V. FINAL ANALYSIS Based on the above review, the application is not consistent with the City's Land Development Regulations (LDR's). To be in compliance with LDR's, the Applicant would need to remove approximately 814 sq. ft. of impervious area from the site and reduce the size of the gazebo and remove the structure from the setbacks. The property does not have a special condition or circumstance that is not applicable to other properties in the neighborhood, as the majority of surrounding properties are the same size and shape. Therefore, there is not a hardship that supports the proposed landscaped green area reduction or gazebo variances. The proposed variances are not necessary to make possible reasonable use of the land, building or structure. The property can continue to be enjoyed as a private residence, while meeting the landscaped green area and gazebo requirements. However, granting of the variance is not injurious to the neighborhood and would not otherwise be detrimental to the public safety and welfare and will not substantially diminish or .impair property values within the vicinity. The Applicant has asserted in the application that the variance request will not negatively impact the adjacent properties.
