HomeMy WebLinkAboutReso 2024-3619RESOLUTION NO. 2024 - 1 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE WAIVER OF THE COMPETITIVE BIDDING PROCEDURES OF CHAPTER 62 OF THE CITY'S CODE OF ORDINANCES; RATIFYING THE EXPENDITURE OF BUDGETED FUNDS FOR THE PURCHASE OF A 4X4 FORD F150 FROM GUS MACHADO FORD, IN AN AMOUNT NOT TO EXCEED FIFTY-TWO THOUSAND FIVE HUNDRED DOLLARS AND NO CENTS ($52,500.00); AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on September 15, 2022, via Ordinance No. 2022-590, the City Commission of the City of Sunny Isles Beach ("City") adopted the Operating and Capital Improvement Budget for the Fiscal Year Commencing October 1, 2022, through September 30, 2023 ("Adopted Budget"); and WHEREAS, the City's Cultural and Community Services Department was in need of purchasing a 4x4 Ford F-150 truck ("Truck"), which were included in the Adopted Budget; and WHEREAS, due to high demand as well as supply chain issues, there is a national shortage of vehicles; and WHEREAS, Gus Machado Ford ("Vendor") had the Truck readily available for purchase; and WHEREAS, as a result of the aforementioned constraints, and after conducting a good faith review of available sources, the City Manager determined that it was in the City's best interest to authorize the purchase of the Truck, in an amount not to exceed Fifty -Two Thousand Five Hundred Dollars and No Cents ($52,500.00); and WHEREAS, pursuant to Section 62-12 of the City's Code of Ordinances, the City Commission may authorize the waiver of competitive bidding procedures upon the recommendation of the City Manager that it is in the City's best interest to do so to obtain goods and services which cannot be acquired through the normal purchasing process due to insufficient time; and WHEREAS, the City Commission wishes to ratify the waiver of competitive bidding procedures and the expenditure of budgeted funds for the purchase of the Truck from the Vendor, in an amount not to exceed Fifty -Two Thousand Five Hundred Dollars and No Cents ($52,500.00). NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratification of Waiver of Competitive Bidding Procedures. The City Commission hereby ratifies the waiver of the competitive bidding procedures upon the recommendation of @BCL@240BF6D8.doc Page 1 of 2 124 the City Manager that it is in the City's best interest to do so pursuant to Section 62-12 of the City's Code of Ordinances Section 2. Ratification of Expenditure of Funds. The City Commission hereby ratifies the expenditure of budgeted funds for the purchase of a 44 Ford F-150 truck, in an amount not to exceed Fifty -Two Thousand Five Hundred Dollars and No Cents ($52,500.00); from Gus Machado Ford. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. REASONS: In accordance with the FY22-23 Adopted Budget, in February 2023, the City purchased a new 202; Supercrew 44 Ford F-150 from Gus Machado Ford totaling $52,500, including titles/tags anc registration. The city is requesting ratification of the purchase, and the waiver of the bidding procedure as the dealers on state contracts either did not have F -150s in stock, or long lead-times. For instance, a dealership on FSA contract emailed Purchasing in February '23 declined stating, "Ford wil likely open up orders in late spring or early summer". In comparison, today, on Florida sheriff's contract; FSA23-VEL31.0, Pursuit, Administrative, and Other Vehicles a 2023 4X4 F-150 Ford $48,269.00, with a 4 — 6 -month lead-time. It is recommended that the City waive the competitive bidding requirements of Section 62-6. This recommendation is in the best interest of the City as it will allow the continuation of CCS to travel throughout the city for completion of job duties. In early 2023, this waiver was mainly caused by the current procurement caused by COVID-19 vehicle manufacturing shutdowns and supply chair disruptions. The 44 truck was readily available on the lot for immediate pick-up and at a very competitive price. Higher quotes / rejection to quote have been attached to the requisition file. The Park's division utilizes trucks to move throughout the city. The purchase of this truck allowed us to give the supervisor a vehicle to check on staff, haul trash and debris, and assist with any other park functions needed.
