HomeMy WebLinkAboutReso 2024-37200-0 RESOLUTION NO. 2024 - 'Z; ? A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING THE APPOINTMENTS OF RENE E. LAMAR, OLIVER J. LANGSTADT, AND MYRA PEREZ AS SPECIAL MAGISTRATES TO PRESIDE OVER RED LIGHT CAMERA HEARINGS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach, Florida (the "City") is in need of qualified and experienced individuals to preside over the City's red light camera hearings; and WHEREAS, the City Manager has recommended the appointment of Rene E. Lamar, Oliver. Langstadt, and Myra Perez to serve the City as Special Magistrates; and WHEREAS, Rene E. Lamar has an extensive background as,a private sector attorney, and currently serves as a magistrate for code enforcement hearings and red light camera appeals for the City of Coral Gables, Florida; and WHEREAS, Oliver J. Langstadt has an extensive background as a private sector attorney, and currently serves as a magistrate for code enforcement hearings and red light camera appeals for the City of Coral Gables, Florida; and WHEREAS, Myra Perez has an extensive background as a private sector attorney, and currently serves as a magistrate for code enforcement hearings and red light camera appeals for the following cities in Florida: City of Miami, City of Sweetwater, City of Doral, and City of Coral Gables; and WHEREAS, the City Commission wishes to approve the appointments of Rene E. Lamar, Oliver J. Langstadt, and Myra Perez to preside as Special Magistrates over red light camera hearings for the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Appointments of Special Magistrates. The City Commission hereby approves the City Manager's appointments of Rene E. Lamar, Oliver J. Langstadt, and Myra Perez as Special Magistrates. Section 2. Effective Date. REASONS: The City is implementing the Intersection Safety Camera Program to reduce the number of traffic violations, crashes, and injuries caused by red-light runners. The goal is to change drivers' behavior, ensuring the community's safety as more drivers obey traffic signals and stop on red. To provide due process for who wish to contest their civil violation, local hearing officers (Special Magistrates) are required to preside over hearings, as authorized under Chapter 316, Florida Statutes. This Resolution appoints Rene E. Lamar, Oliver J. Langstadt, and Myra Perez to preside over the hearings on a rotation basis based availability. ATTACHMENTS: Resolution Item Number: 10.S 349
