HomeMy WebLinkAboutReso 2024-3744RESOLUTION NO. 2024 - 3 A •RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, RATIFYING THE "DECLARATION OF A STATE OF LOCAL EMERGENCY" DECLARED BY THE CITY MANAGER ON OCTOBER 8, 2024, AND THE "TERMINATION OF A STATE OF LOCAL EMERGENCY" ISSUED ON OCTOBER 10, 2024, DUE TO HURRICANE MILTON; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THE TERMS OF THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with Chapter 29 of the City of Sunny Isles Beach Code, the City Manager declared a State of local emergency due to Hurricane Milton on October 8, 2024; and WHEREAS, the emergency dangers and threats of Hurricane Milton have passed, and the City Manager of the City of Sunny Isles Beach has terminated the State of a Local Emergency, on October 10, 2024. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Ratification of the Declaration of State of Local Emergency. The City Commission of the City of Sunny Isles Beach hereby ratifies the "Declaration of a State of Local Emergency" issued by the. City Manager on October 8, 2024, attached hereto as Exhibit "A". Section 2. Confirmation of Termination of the State of Local Emergency, The City Commission of the City of Sunny Isles Beach hereby ratifies the "Termination of a°State of Local Emergency" issued by the City Manager on October 10, 2024, attached hereto as Exhibit "B", provided however this confirmation of termination shall not be construed as a limitation on the City Manager's authority to declare a state of emergency at any date subsequent to this resolution. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate the terms of this resolution. Section 4. Effective Date. Due to Hurricane Milton and the Declaration of a State of Emergency by Governor Ron DeSantis and the Declaration of a Local State of Emergency by Miami -Dade County Mayor Daniella Levine Cava, the City of Sunny Isles Beach is facing dangerous conditions of sufficient severity and magnitude to warrant coordinated local government action to prevent or alleviate the damage, loss, hardship or suffering threatened or caused thereby; 2. Due to Hurricane Milton, a condition of extreme peril of life and property necessitates the proclamation of the .existence of an emergency; NOW, THEREFORE, IT IS HEREBY RESOLVED that an emergency now exists throughout the City of Sunny Isles Beach; IT IS FURTHER RESOLVED that during the existence of said emergency the powers, functions, and duties of the City Manager/designee of the City of Sunny Isles Beach be those prescribed by State law and the ordinances, resolutions, and approved plans of the City of Sunny Isles Beach in order to mitigate the effects of said emergency. REASONS: Pursuant to Chapter 29 of the City's Code, the City Manager is authorized, subject to ratification by the City Commission, to declare a State of Local Emergency due to impending dangers that may affect the safety and well being of residents and employees. On October 8, 2024, the City Manager declared a State of Local Emergency as a result of Hurricane Milton. On October 10, 2024, the City Manager terminated the State of Local Emergency.
