HomeMy WebLinkAboutReso 2014-2311RESOLUTION NO. 2014 -_2,S) I A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST SUBMITTED BY 18555 DEVELOPERS, LLC TO WAIVE THE LANDSCAPING AND FRONT SETBACK REQUIREMENTS FOR THE CONSTRUCTION FENCE AT THE PORSCHE PROJECT LOCATED AT 18555 COLLINS AVENUE; ESTABLISHING CONDITIONS FOR THE RELOCATION OF THE CONSTRUCTION FENCE; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION.; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about October 7; 2014, 18555 Developers; LLC ( "Applicant') submitted a request to the City of Sunny Isles Beach, Florida to waive the landscaping and front setback requirements at the construction fence for the Porsche project to facilitate the construction of the project: and WHEREAS, the City Commission wishes to approve the waiver to permit the Applicant with the flexibility to install the construction fence without the required setback and landscaping buffer. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Waiver. The City Commission hereby approves the waiver of the landscape and setback requirements set forth in Section 265 -63.3 E. of the City Code, subject to the conditions below. Section 3. Conditions of Approval. The Applicant is required to comply with the following conditions: 1. The construction fence shall be installed one (1) foot away from the front property line and maintain in good condition. 2. That the sidewalk shall be maintained clean and in good condition. Section 4. Authority of the City Manager and City Attomev. The City Manager and City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 5. We hereby submit a letter of intent to request approval of installing a temporary 8' high wooden fence to remain in place for the duration of construction on the Porsche Design Tower located at 18555 Collins Ave, Sunny Isles Beach Florida. The proposed fence will be set 1' off of the sidewalk as shown in the attached layout to avoid conflicts with the existing fire hydrant and utility pole. RECOMMENDATION: Staff has no objection to the Applicant waiver request, as long as the conditions are maintained. REASONS: 18555 Developers, LLC ( "Applicant') submitted a request to the City of Sunny Isles Beach, Florida to waive the landscaping and front setback requirements at the construction fence for the Porsche project to facilitate the construction of the project. City Commission has previously approved similar requests for other construction sites.
