HomeMy WebLinkAboutReso 2014-2324RESOLUTION NO. 2014 - _2,,O) 2 q A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, PURSUANT TO SECTION 5.1 OF THE MUNICIPAL CHARTER, CALLING FOR A SPECIAL ELECTION TO BE HELD ON TUESDAY, FEBRUARY 17, 2015, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORATE OF THE CITY OF SUNNY ISLES BEACH THE NAMES OF ALL QUALIFIED CANDIDATES FOR ELECTION TO THE POSITION OF CITY COMMISSIONER, SEAT 03 (SOUTHERN RESIDENTIAL AREA); PROVIDING FOR A RUN -OFF ELECTION, IF NECESSARY, TO BE HELD ON TUESDAY, MARCH 17, 2015; DESIGNATING ONE REGISTERED VOTER WHO SHALL SERVE NVITH THE CITY MANAGER AND THE CITY CLERK AS THE CANVASSING BOARD FOR SAID SPECIAL ELECTION; PROVIDING FOR CONDUCTING THE ELECTIONS, POLLING PLACES, FORM OF BALLOT, VOTER REGISTRATION, NOTICE OF ELECTIONS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS. Section 5.1 of the Municipal Charter of the City of Sunny Isles Beach, provides that a special election shall be held when required; and WHEREAS, the City Commission is required to designate a registered voter to serve with the City Manager and the City Clerk as the City of Sunny Isles Beach's Canvassing Board for the Special Election and Run -Off Election. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Calling ag Special Election. In accordance with the Municipal Charter of the City of Sunny Isles Beach, Florida, and the general laws of the State of Florida; a Special Election is hereby called and directed to be held in the City of Sunny Isles Beach, Florida, from 7:00 a.m. to 7:00 p.m. on Tuesday, February 17, 2015, and a Run -Off Election, if necessary, from 7:00 a.m. to 7:00 p.m. on Tuesday, March 17, 2015, for the purpose of submitting to the electorate the names of all qualified candidates for election to the position of City Commissioner, Seat 03 (southern residential area), for the unexpired term, with the qualifying period being from 9:00 a.m. on Tuesday, December 2. 2014 until 4:00 p.m. on Friday. December 5. 2014. Section 2. Designation of One Reeistered Voter to Serve on the Canvassing Board. The City Commission of the City of Sunny Isles Beach hereby designates Emanuel Pine, as the registered voter to serve with the City Manager and the City Clerk as the City of Sunny Isles Beach's Canvassing Board for the Special Election on February 17, 2015. Section 3. Conducting the Elections. The City Clerk is authorized to utilize the services of the Miami -Dade County Supervisor of Elections and her staff of officials for assistance in 82014- Election - Special 021715 Page] of4 the conduct of said Special Election. The Miami -Dade County Election Officials shall furnish the official returns for each precinct to the City Clerk of the City of Sunny Isles Beach as soon as the ballots from all precincts have been tabulated; and the Miami -Dade County Election's Department Canvassing Board's certification of the duly accepted results of said election shall be accepted by the City Commission. Section 4. Polling Places. That said polling places in the City of Sunny Isles Beach for said General Election shall be as established by the Miami -Dade County Supervisor of Elections and her staff of officials. All electors shall vote at the polling places and the voting precincts in which the OFFICIAL REGISTRATION BOOKS show that the said electors reside. A list of the voting precincts and the polling places therein (subject to change by the Miami -Dade County Supervisor of Election, in accordance with the laws of Florida) is attached hereto as Exhibit "A ". Section 5. Form of Ballot. The ballot for said Special Election shall be printed in compliance with State law as prepared by the Miami -Dade County Supervisor of Elections, and as approved by the City Clerk as the Supervisor of Elections for the City. Section 6. Voter Registration. Registration of persons desiring to vote in said Special Election shall be in accordance with the general laws of the State of Florida governing voter registration. Qualified persons may obtain registration forms to vote at the Office of the City Clerk, Government Center, 18070 Collins Avenue, Sunny Isles Beach, Florida, 33160, Monday through Friday, except legal holidays, between the hours of 9:00 a.m. and 5:00 p.m., and at such other voter registration centers and during such times as may be provided by the Miami -Dade County Supervisor of Elections. Each person desiring to become a registered voter shall be responsible for properly filling out the registration form and returning it to the Miami -Dade County Elections Office. All completed registration forms must be received by the Miami -Dade County Elections Office and clocked in no later than Monday. January 19, 2015, at 5:00 p.m., for the Special Election (and no later than Monday, February 16, 2015. at 5:00 p.m. for a run -off election, if necessary) in order for a person to vote in said elections. All questions concerning voter registration should be directed to the Miami -Dade County Elections Office, 2700 N.W. 87`h Avenue, Doral, Florida, 33172; telephone: 305- 499 -8502. Section 7. Notice of Elections. That not less than thirty (30) days notice of said Special Election shall be given by publication in a newspaper of general circulation in Sunny Isles Beach, Miami -Dade County, Florida, the first publication to be in the fifth week prior to the Election, and the second publication to be in the third week prior to said Election. Hines, MMC, City Clerk DATE: 10/16/2014 RE: Resolution Calling a Special Election to be Held on Tuesday, February 17, 2015, and a Run -Off Election, if Necessary, on Tuesday, March 17, 2015, and Designating a Registered Voter to Serve on the Canvassing Board RECOMMENDATION: It is recommended that the City Commission adopt the attached Resolution which provides for conducting a Special Election on Tuesday, February 17, 2015, and if necessary, a Run -Off Election on Tuesday, March 17, 2015. It also designates a registered voter to serve on the Canvassing Board. REASONS: Commissioner George "Bud" Scholl resigned his seat as City Commissioner, effective November 21, 2014, in order to run in the Mayoral seat for the General Election to be held on November 4, 2014. This Resolution provides the required details regarding the conduct of the Special Election on Tuesday, February 17, 2015, and if necessary, a Run -Off Election on Tuesday, March 17, 2015, for the purpose of submitting to the electorate the names of all qualified candidates for election to the position of City Commissioner, Seat 3 (Residential Southern Area), for the unexpired term. The City Commission must designate a registered voter to serve with the City Manager and the City Clerk as the City's Canvassing Board. Emanuel Pine has served on the City's Canvassing Board for several years, and he is willing and able to serve again. He has proved to be very knowledgeable of the process, and therefore it is recommended that Mr. Pine be designated as a member of the Canvassing Board. ADDITIONAL INFORMATION: The official candidate qualifying will occur from Tuesday, December 2, 2014, until 4:00 p.m. on Friday, December 5, 2014.
