HomeMy WebLinkAboutReso 2024-3768RESOLUTION NO. 2024 - 3 7�b A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AWARDING REQUEST FOR PROPOSAL ("RFP") NO. 24-08-01 TO DOLPHIN TOWING AND RECOVERY, INC., AND MIDTOWN TOWING, TO PROVIDE POLICE TOWING SERVICES; AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE SAID AGREEMENTS, PROVIDED SAID AGREEMENTS ARE FIRST APPROVED AS TO FORM AND LEGAL SUFFICIENCY BY THE CITY ATTORNEY; FURTHER AUTHORIZING THE CITY MANAGER DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City of Sunny Isles Beach (the "City") Police Department requires the services of towing companies on a rotational basis (the "Services"); and WHEREAS, the City issued and advertised RFP No. 24-08-01 for Professional Towing Services, for which three (3) submissions were received; and WHEREAS, City staff has determined that the submissions from Dolphin Towing and Recovery, Inc., and Midtown Towing (collectively "Contractors") were both qualified responsive bidders; and WHEREAS, the City wishes to award RFP No. 24-08-01 to, and authorize the City Manager to negotiate and execute Agreements with the Contractors to provide the desired Services, provided that said Agreements are first approved as to form and legal sufficiency by the City Attorney. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Award of Request for Proposal. The City Commission hereby awards Request for Proposal No. 24-08-01 to P Dolphin Towing and Recovery, Inc., and Midtown Towing to provide towing services to the City' Police Department, on a rotational basis. Section 2. Authorization of City Manager. The City Manager is hereby authorized to negotiate and execute the Agreements, provided that said Agreements are first approved as to form and legal sufficiency by the City Attorney. The City Manager is further authorized do all things necessary to effectuate this Resolution. Section 3. Effective Date. This Resolution will become effective upon adoption. Based upon a proven track record of service excellence, Dolphin Towing would like to provide City of Sunny Isles Beach with towing services, including, but not limited to the removal and storage of vehicles and equipment that are creating a traffic hazard, abandoned, disabled from a traffic crash, or for non-consensual removal of vehicles from public streets and areas within the City. Dolphin towing is committed to providing superior citywide towing services to the City of Sunny Isles Beach 24 hours a day, 365 days a year, from its first-class facility which includes a sizable indoor and outdoor storage facility. Since its inception, Dolphin has maintained a corporate philosophy which has attracted and allowed it to retain a roster of clients that expect and receive first class service. On the government side, Dolphin provides towing services for the City of North Miami and City of Miami Shores. Additionally, Dolphin Towing tows all disabled police and city vehicles free of charge. On the private side, among our many clients, we tow for all major automobile insurance companies, and we are one of four towing companies in the South Florida Region for the largest provider of roadside assistance in the United States (Agero, Inc.) as well as the ISD Miami Dade Government Vehicles and AAA. We are a perfect fit for many of our customer service-oriented clients by maintaining a new and immaculate fleet of environmentally sound tow trucks equipped with modern diesel engines that utilize Diesel Exhaust Fluid which reduce the emission of mono -nitrogen oxides. Also, in keeping with our corporate philosophy and the fact that we often transport our client's customers, our trucks are immaculate; our drivers are not permitted to smoke in our trucks; and they cannot show tattoos. Our indoor facility has an aluminum roll up door with safety latches on either side and an entry door in between the aluminum roll up doors. Only the owner and dispatchers are able to unlock the doors to the inside storage facility. The inside storage facility is ventilated by mobile fans and has sufficient lighting to permit the processing of vehicles. Our indoor facility is located within our towing facility and the structure enjoys complete protection from inclement weather and from unauthorized entry. Additionally, the inside storage facility is monitored from our high definition and infra -red security cameras which records 2417, 365 days a year, and has 30 days of recording time. We also always have employee(s) on site 24 hours a day to monitor our storage facility. The facility has an asphalt surface with storm drainage and is kept clean and organized by a Yard employee dedicated to insuring the cleanliness of the storage yard. Storage of junk tires and auto parts are strictly prohibited. Our facility is surrounded by an eight -foot -high chain link fence that is completely covered by a material that prevents people from peering inside our storage facility. A top the six-foot chain-link fence is barb wire which runs across the entirety of the fence. The only access to the storage area is via a mechanized gate that is controlled by our on-site dispatcher(s) 2417, 365 days a year. The outside storage facility is well lit and is monitored throughout by our high definition and infra -red security cameras which records 24/7 and has 30 days of recording time. I 639 Midtown Towing of Miami, Inc. was established as a Florida corporation on February 11, 1987. Midtown has more than thirty-seven years of hands-on experience in towing, recovery, storage and service. The company has been delivering towing and towing -related services to Law Enforcement Municipalities located in Miami -Dade County since 1987. Midtown operates under Towing License #23, employs 16 employees, staffing two locations, operating 24 hours a day, 7 days per week, 365 days per year. Midtown Towing will fulfill the needs of this RFP from the Miami Dade County location located 4.23 miles the City of Sunny Isles Beach at 15700 NW 7th Avenue, Miami, FL 33169. Midtown does have a backup location at 6230 W 21St Court, Hialeah, FL 33016. The name and telephone number for Midtown Towing its address is clearly visible from the street. The location on NW 7th avenue will be responsible for maintaining all paperwork. The location on NW 7th avenue has one warehouse with two separate holding areas which accommodate more than forty (40) vehicles requiring inside storage. One holding area of the warehouse will store more than ten vehicles and will be utilized for vehicles with investigative holds. The outside storage yard will accommodate more than 160 vehicles. The office, yard and warehouses are all on video surveillance with multiple camera angles which record 24 hours per day, 7 days per week, 365 days per year. Dispatching will also occur at the NW 7th Avenue location. A detailed log of calls will be maintained including time call received, dispatched, arrival and completion times via our automated system, TowBook. The storage areas are accessible from the office and customers are escorted to and from their vehicles. The headquarter facility has a VoIP-based phone system, two-way radio system, and secure network. All systems are redundant with back-up power supplies to ensure uptime and no interruption of service in the event of any power failure. Other office equipment includes a high-volume copy machine, digital scanner, facsimile machine and a credit card processor. The company maintains service contracts on our office equipment so that all components can be repaired or replaced in a timely manner. Midtown Towing has maintained multi-year towing contracts with multiple Police Departments including Miami -Dade County, EI Portal, Hialeah, Key Biscayne, Medley, Miami Shores, Miami Gardens, Miami, North Bay Village, Hialeah Gardens and Sunny Isles Beach. Midtown Towing also provides towing services for State and Federal Agencies such as: Florida Highway Patrol, United States Postal Service (in Miami -Dade and Broward counties), Florida Fish and Wildlife Commission, Rail -road Police and the Federal Bureau of Investigation. Midtown Towing performs approximately 3,000 Police Agency or Federal tows per year. The service facilities are licensed with Miami -Dade County. Please refer to copies of these licenses as shown in the Exhibits within this application. All Real Estate Taxes, Occupational License fees and Federal Income Taxes are paid and current. In addition, all vehicle registrations are paid and current. There are no outstanding liens which may place this property in jeopardy. SERVICES AND RESPONSIBILITIES - 1 — COMMUNICATION SYSTEM: Midtown Towing uses the Omadi and TowBook dispatch system with fully enabled GPS. Though most of our wreckers are equipped with Motorola 900 MHz Digital 2 -way radios with GPS tracking, Midtown Towing uses current smartphone two-way radio application technology to communicate more efficiently with our drivers. Midtown Towing can see the location of any truck in our fleet via computer at any given time. The system maintains a history of our fleet's travels and can be recalled for our examination at any given moment. These GPS records are retained indefinitely. The headquarter facility has a 5 -line analog phone system with Comcast Voice Edge. Our communications network is attached to a backup generator to ensure that there is no interruption of service. Midtown Towing will advise the City of Sunny Isles Beach and its Code Enforcement Department of any changes to our communication system including the addition of any new phone numbers to our existing system. 2 — PRIMARY STORAGE AREA: Our primary facility, located at 15700 NW 7th Avenue, Miami, FL 33169, is 4.23 miles from Sunny Isles and has an outside storage capacity for more than 140 vehicles. Our secondary facility, located at 6230 W 21st Court, Hialeah, FL 33016 has an outside storage capacity for more than 90 vehicles. Although not intended for use during this contract, this facility is available as needed. The yards are properly enclosed by a six-foot chain-link fence and/or concrete wall, and is maintained and kept clear of overgrown vegetation and auto parts/junk tires, etc. The yards have sufficient lighting to provide a clear view of any persons or vehicles at a distance of 150 feet as required. 3 — INDOOR STORAGE FACILITY: Midtown Towing has two warehouses at the 15700 NW 7th Avenue, Miami FL 33169 location which are secured at all times from unauthorized persons. These warehouses will accommodate all inside storage requirements for the City of Sunny Isles Beach Police Department as required by this contract. The under -roof square footage is approximately 11,775 sq ft. The warehouses will accommodate more than the vehicle requirement of your department (approximated indoor storage capacity of up to 40 vehicles). Additional details include: • The secured inside storage area is used only for the safe, secure and clean storage of evidentiary vehicles. • The floor is concrete and is clean of debris, standing water and vegetation. • The secure area is approximately 3,500 square feet. This area is lighted and has a 20 -foot ceiling height. • There are adequate electrical outlets to ensure the processing of vehicles. • There are fixed electric -powered window -mounted exhaust fans for ventilation. • Midtown Towing is the only business operating at this business address. Our digital video recorder has multiple angles and stores 30 days' worth of footage which can be extracted and stored externally, if necessary. The facility is secured and staff to ensure that unauthorized persons cannot gain access to the property without consent. The inside storage areas will, of course, be available to authorized City of Sunny Isles Beach personnel for technical processing. Midtown Towing realizes that it is our sole responsibility to safeguard all storage units from theft and vandalism. We will guarantee that the vehicles and their contents remain in the same condition that they were in at the time the Vehicle Storage Receipt was written at the time of impoundment. We recognize that it will be our obligation to replace or reimburse the owner or authorized representative for any loss which is verified by the designated investigative agency representing the City. Midtown Towing will completely weather-proof any vehicle for which this service is ordered by the impounding officer and is notated on the Vehicle Storage Receipt. There will be no cost for this service. 5 — USE OF STORAGE FACILITIES: Midtown Towing will not allow storage facilities to be used unless prior written approval is issued by the City of Sunny Isles Beach Police Department. 6. STORAGE OF INVESTIGATIVE TOWS WITH POLICE HOLD: Midtown Towing understands that vehicles in pounded with an evidence hold, investigative hold order, confiscation hold, or other "Police Hold" pursuant to Police Department instructions, shall be stored only in the primary storage facility and may be stored for a period of up to seven (7) working days, excluding Saturdays, Sundays and City observed holidays, at no charge for the first seven (7) days or until the "Police Hold" is released, whichever occurs first. Midtown Towing understands that if the Police Department has the vehicle removed from our primary storage facility, and the vehicle is subsequently released to the owner, the owner will be responsible for the initial tow and storage for the number of days the vehicle remained at Midtown's storage facility. The fees will not include the tow to or from the city storage facility. However, if the Police Department elects to have the vehicle remain at Midtown's facility, the Police Department shall be responsible for any storage charges incurred after the initial seven (7) days (excluding holidays and weekends). The towing and storage rates charged to the owner or lienholder shall not exceed the rates that would have been charged to the Police Department. Midtown Towing acknowledges that when the Police Department orders a vehicle involved in a criminal investigation to be towed to the police station, or a location other than Midtown's storage facility, the towed vehicle may be released from such location to the owner/lienholder upon arrival by a police supervisor. Under this procedure, the Police Department agrees to pay for such tows so ordered. Midtown Towing of Miami, Inc. 645 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. Midtown Towing knows that, unless otherwise instructed by the City, all vehicles towed at the request of a code enforcement officer or the Police Department are to be stored at the primary storage area. All vehicles shall be stored inside the designated storage facility and must include the following at all times: A. Name of the Law -Enforcement Agency; B. Date and time the hold is placed on the vehicle; C. A general description of the vehicle, including color, make, model, body style and year, VIN, registration plate with state and year, and validation sticker number with the state and year; D. The specific reason for placing the hold; E. The condition of the vehicle; F. The location where the vehicle is being held; G. The name, address and phone number of the tow company and storage facility. 7 - STORAGE OF IMPOUNDED VEHICLES: Midtown Towing will store all impounded vehicles in the outdoor, primary storage area, unless the impounding officer or vehicle owner gives Midtown Towing specific instructions for indoor storage. 8 - STORAGE FEES AT CITY FACILITY: Midtown Towing shall not charge storage fees for vehicles that are being stored at any city facility at the request of the City of Sunny Isles Beach. 9 - LOCATION CHANGES OF IMPOUNDED VEHICLES: Midtown Towing shall not change the indoor or outdoor storage location of any vehicle serviced pursuant to this Agreement, without written approval of the Police Department's investigative unit supervisor or authorized designee prior to any such change. 10 - ON SITE OFFICE: Midtown Towing shall maintain an on-site, permanent office at each storage facility, to be used in conjunction with the towing permit, and the office will be staffed on a 24-hour basis by at least one employee or security guard. 11 - ATTENDANT ON DUTY: Midtown Towing shall make available, on a 24-hour, 7 -days a week basis, attendance and equipment for the immediate response for calls for service from the City of Sunny Isles Beach Police Department. Midtown Towing shall also provide adequate personnel to staff our facility 24 -hours, 7 -days a week for the purpose of dispatching calls and releasing towed vehicles to owners. Midtown Towing of Miami, Inc. 646 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. 12 - DELAY: Midtown Towing shall respond to requests from the Police or Public Works Department within a reasonable amount of time. Midtown Towing recognizes that our response time shall be thirty (30) minutes from the time of receiving request for service. In the event of a delay, Midtown Towing will notify the Police Department of the estimated time of delivery as well as the reason for the delay. Midtown Towing understands that the City of Sunny Isles Beach retains the right to cancel a request for service and use the services of the next Permit Holder on the rotation list as specified in the City's Administrative Regulations. 13 - REMOVING HAZARDS: Upon arriving at an accident scene, Midtown Towing shall remove any hazards or debris from the street and impound such vehicles as designated by the City code enforcement officer or police officer. Midtown Towing understands that the officer on scene shall have the sole responsibility to determine when a vehicle should be impounded and our tow truck operator shall abide by that individual's decision. 14 - IMPOUND REPORTS/OWNER NOTIFICATION: Midtown Towing shall obtain a Vehicle Storage Receipt from the City code enforcement officer or City police officer on the scene for each vehicle to be impounded. Midtown Towing shall not remove a vehicle from the scene without receiving a copy of the Vehicle Storage Receipt. If, at the time of impoundment, the name and address of the registered owner or lienholder, if any, is not available, Midtown Towing will obtain the information from the Police Department and/or Auto Data Direct. We will notify the registered owner, its agent, any lienholder and insurance company in writing via certified mail of the location of the vehicle within seven (7) days from the date of storage, excluding Saturdays and Sundays. In instances where the driver of an impounded vehicle is arrested, Midtown Towing shall notify the registered Lessor or lienholder, via certified mail within seven (7) days from the date of storage, excluding Saturdays and Sundays, as required by Florida Statute 322.34. Upon payment of any lawful towing or storage charges and with the authorization of the Police Department, Midtown Towing shall release the vehicle to the registered Lessor or lienholder. If the state of registration is unknown, Midtown Towing shall make a good faith best effort to notify the owner and any lien holders, and such notice shall be given within a reasonable period of time from the date of storage. "Good Faith Best Effort" shall mean that the following procedure has been performed by Midtown Towing to establish the prior state of registration and title: A. Check vehicle for any type of tag, tag record, temporary tag or regular tag. B. Check law enforcement report for tag number, if vehicle was towed at the request of a law enforcement officer. C. Check trip sheet or tow ticket of tow truck operator to see if a tag was on the vehicle at the beginning of tow, if private tow; D. If owner's address is not listed on the impound report, check law-enforcement report to see if an out-of- state address is indicated from driver license information; Midtown Towing of Miami, Inc. 647 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. E. Check vehicle for inspection sticker or other stickers and decals that may indicate a state of possible registration; F. Check a vehicle interior for any papers that may be in the glove box, trunk or other areas to establish vehicle's state of registration. Written notice to all interested parties shall be by certified mail, return receipt requested, and shall be completed on mailing. Telephone notice shall also be given whenever possible. Midtown Towing shall maintain a separate log of vehicles in which the owner or lienholder cannot be determined, listing date, time and method of notification, location towed from and towing and storage charges. 15 — VIEWING OF IMPOUNDED VEHICLES: Midtown Towing shall allow every registered vehicle owner, authorized agent or insurance representative, to inspect the towed vehicle at the storage facility, with a reasonable time before payment of any charges, and upon request and receipt of proper identification. The vehicle's owner or authorized representative shall be permitted to remove from the vehicle any and all personal possessions not affixed to the vehicle, including but not limited to telephones, tapes, tools, etc. The vehicle owner or authorized representative shall acknowledge receipt of such property on a form provided by Midtown Towing of Miami, Inc. 16 — RELEASES: Midtown Towing shall directly release any vehicle which has not been marked "Police Hold" to its registered owner or authorized representative within thirty (30) minutes of receiving appropriate fees due, provided proper proof of identification and ownership is presented. Midtown Towing knows that any vehicle which is marked "Police Hold" must be released in accordance with the procedures set forth in Administrative Regulations 110-6. Midtown Towing shall release any vehicle towed at the request of a Police Department Supervisor only to the person whose name appears on the title or registration certificate as the registered owner of the vehicle, or the authorized agent of such person. Midtown Towing shall require that persons who complete the application for the release of a vehicle shall be required to produce proof of ownership by presentation of a title or registration, photo identification and, where applicable, proof of agency. A photocopy of the identification used for the release shall be attached to the yellow copy of the Vehicle Storage Receipt. This information shall be clearly legible. Midtown Towing understands that all motor vehicles that have not been claimed must be disposed of according to applicable laws. If Midtown Towing disposes of an unclaimed vehicle by sale, Midtown Towing shall be required within three (3) days after the sale, or if a title is surrendered for payment, to submit a detailed listing of the vehicle identification number, total receipt number, police case number, year, make, model, bodies received, purchasers name, address and local telephone number. In the event that the vehicle is destroyed Midtown Towing shall provide the Police Department with a copy of the Certificate of Destruction as required by Section 713.78, Florida Statutes, and shall attach it to the yellow copy of the Vehicle Storage Receipt. Midtown Towing shall record the name, address and telephone number of the person or company taking possession. In the event the registered owner of the vehicle relinquishes all claims to the Midtown Towing of Miami, Inc. 648 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. vehicle and transfers ownership of the vehicle to Midtown Towing, we shall waive all towing and service fees related to that vehicle. 17 — AUCTION OF ABANDONED / UNCLAIMED VEHICLES: All vehicles slated for auction must first be approved by the City. In cases where Midtown Towing auctions abandoned/unclaimed vehicles, the City has a right to bid on such vehicles and may obtain title to any such vehicle, provided there are no other bidders. The City shall designate a representative of the Police Department to track the auctions of abandoned/unclaimed vehicles and make the appropriate bidding. Midtown Towing shall notify the Police Department Towing Permit Coordinator of all abandoned/unclaimed vehicles prior to auctions. Midtown Towing shall not charge the City any towing charges associated with those abandoned/unclaimed vehicles where the City opts to take ownership of such vehicle(s). 18 — EQUIPMENT: Midtown Towing understands that ownership of required equipment delineated in this Agreement is not required; however, legally binding signed agreements covering leasing or cooperative use of the required equipment must be presented on the City's demand. Equipment leased or cooperative leased must be available for Midtown Towing to utilize on a priority basis and each respective lease operative equipment agreement Midtown Towing files with the Police Department shall clearly identify Midtown Towing's priority. Midtown Towing shall have available the following types of equipment: A. WRECKERS (Tow Trucks) — • Midtown Towing shall provide proof of registration and appropriate license to operate wreckers/tow trucks. • Midtown Towing's tow license number shall be displayed on the front of the vehicle in letters at least three (3) inches high. • Midtown Towing's name shall be displayed on the driver and passenger side of the vehicle in letters at least three (3) inches high. • Midtown Towing's address and telephone number shall be displayed in letters at least one (1) inch high. • Midtown Towing shall produce proof of ownership or valid 1St party lease of the required number of Class "A", Class "B", Class "C", Class "D" and slide back carriers. • All equipment shall be maintained in a state of readiness for response as delineated in this Agreement and be for the sole use of Midtown Towing. • Midtown Towing shall maintain no markings on vehicles, buildings or correspondence that indicates or tends to indicate any official relationship between Midtown Towing and the City of Sunny Isles Beach, the Police Department, Miami -Dade County or any government agency. B. MINIMUM RATINGS FOR WRECKERS: (All wreckers shall meet the following minimum ratings) 1. Class "A" Wrecker: Midtown Towing of Miami, Inc. 649 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. a. One (1) pair of jumper cables. 2. Class "A" Slide Back Car Carrier: a. Commercially manufactured unit, with a rated capacity of not less than 10,000 pounds, GVW; b. Cab to axle dimension of not less than 102 inches; c. Dual rear wheels; d. Seventeen (17) feet or longer hydraulically operated slide back or tilt bed; e. Hydraulically operated winch(es) with a minimum total winching capacity of 8,000 pounds; f. Sixty-five (65) feet of 3/8 -inch steel core cable per winch; g. Two (2) tie down chains, each ten (10) feet in length; h. Four-way lug wrench; and L One (1) pair of jumper cables. 3. Class "B" Wrecker: a. Commercially manufactured unit, with a rated capacity of not less than 18,000 pounds, GVW; b. Cab to axle dimension of not less than 84 inches; c. Commercially manufactured hydraulic boom(s) with a minimum total capacity of 16,000 pounds; d. Hydraulically operated winch(es) with a minimum total winching capacity of 16,000 pounds; e. Two hundred (200) feet of 1/2 -inch steel core cable per winch; f. Under reach with a retracted rating of not less than 10,500 pounds and an extended rating of not less than 8,500 pounds; g. Commercially manufactured unit, with a rated capacity of not less than 36,000 pounds, GVW; b. Cab to axle dimension of not less than 144 inches; c. Commercially manufactured boom(s) with a minimum total capacity of 50,000 pounds; d. Winch(es) with a minimum total winching capacity of 50,000 pounds; e. Two hundred (200) feet of 5/8 -inch steel core cable per winch; f. Under reach with a retracted rating of not less than 25,000 pounds and an extended rating of not less than 12,000 pounds; g. Rear support jacks or outriggers; h. Tow sling with a safe lift rating of 12,000 pounds; i. Two (2) 1/2 -inch alloy safety chains; j. Tow bar equipped; k. External air hookup and hoses to supply air to disabled vehicles; I. Two (2) snatch blocks, minimum 24,000 pounds capacity each; m. Two (2) scotch blocks; n. Spring brake — air lock; and o. Six (6) to eight (8) feet of extra towing chain with hooks, minimum 4,000 pound capacity Where two (2) Class "C" Wreckers are required, at least one (1) shall be under reach equipped. C. ADDITIONAL EQUIPMENT REQUIRED ON EACH VEHICLE: • Two-way Radio; • Proper Safety Lights; • Amber rotation dome lights; Midtown Towing of Miami, Inc. 1 651 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. • Two (2) flood lights to rear; • Sand (50 pounds minimum) • Heavy Duty sweeping broom (24" wide); • Two (2) safety cones (day -glow orange, 3 feet high); • One (1) set of three (3) reflectors; • Six (6() thirty -minute flares; • Flat shovel; • Axe; • Fire extinguisher 5 pounds dry chemical Underwriter approved; • First Aid Kit — minimum 16 units; and • At least one (1) mirror positioned to reflect to the driver a view for a distance of at least 200 feet to the rear of the towing vehicle. 19 — RECORDS AND FILES: Midtown Towing shall maintain, at our place of business, a file that will contain the following legible, public records: A. A Vehicle Storage Receipt (yellow and goldenrod copies) for each impounded vehicle on its premises, proof of ownership notification and invoice of charges for all vehicles released. Once the release occurs, the yellow copy is to be returned to the Police Department with appropriate information including the name, address and telephone number of the individual to whom each vehicle was released. This information must legibly appear on both the yellow and goldenrod copies. Midtown Towing shall retain the goldenrod copy and maintain all files sequentially in accordance with the police case number. B. A log of all service calls by the Police Department, Community Planning and Development Department and Public Works Department on a weekly basis. C. An Impound/Notification Log, indicating the date, time and method of notification to the registered owner of an impounded vehicle, as well as other requested information as specified in the City's Administrative Regulations 110-6. D. A log indicating the vehicles to be auctioned, date of auction, name, address of owner and lienholder, and date contacted. E. A log indicating the vehicles sold at auction, date auction notice was published, proceeds of auction and distribution of proceeds. F. Midtown Towing shall be responsible for forwarding the following items to the Police Department by 3:00 PM EST each Friday: a. Copies of all Vehicle Storage Receipts for vehicles released the previous week, together with a copy of the completed numbered invoice for each vehicle; b. Original log of all calls for service by the Police Department; c. Original log of all vehicles with Police Holds in the custody of Midtown Towing; d. Original Impound/Notification Log for the previous week; e. Original log completed prior to vehicle options; f. Copy of Public Notice of Auction (10 days prior to auction); and g. Original log completed immediately following auction. Midtown Towing of Miami, Inc. 4 652 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. All copies shall be legible, and original forms provided as requested. 20 — ETHICS AND CONDUCT: Midtown Towing shall conduct its business in an orderly, ethical and business -like manner at all times and shall use every means to obtain and keep the confidence of the motoring public. All public conduct shall be in a courteous and orderly manner. Midtown Towing shall not divulge and information which is exempt from disclosure regarding a towed vehicle when such vehicle has a "Police Hold" from the Police Department. 21 — COMPLAINTS AND CONDUCT: Complaints received by the City concerning a violation of this Agreement, including but not limited to, misconduct on the part of Midtown Towing, such as excessive charges, poor business practices, or damage to vehicles, shall be referred to the City Manager and City Attorney. The City shall notify Midtown Towing of any complaints within five (5) business days from the receipt of the complaint. Midtown Towing shall respond and provide any additional explanation for information with respect to the particular complaint within five (5) business days upon receipt of the complaint. A written disposition of the complaint will be forwarded to Midtown Towing and the complainant upon completion of the investigation. If three (3) or more substantiated complaints are filed with the City of Sunny Isles Beach within ninety (90) days, the City Manager may suspend Midtown Towing's permit for a period of not more than thirty (30) days with no reduction in the permit fee. The towing services shall be reassigned to the next Permit Holder in the rotation, as provided in the City's Administrative Regulations 110-6. 22 — EMPLOYEES OF MIDTOWN TOWING: A copy of each employee's Driver License shall be kept on file by Midtown Towing and made available to the Police Department. All personnel operating wrecker/tow trucks shall be qualified and experienced in handling equipment(s) safety on the scene and transporting the vehicles. 23 — UNDERWATER RECOVERY SALVAGE DIVERS: Midtown Towing understands that all divers must be SCUBA certified. For every diver, duty time shall be computed from the time of arrival at the scene to the time the vehicle or property is rigged and hoisted to dry land. 24 — INSPECTIONS AND AUDITS: Midtown Towing understands that our records, equipment, personnel, office and storage facilities will be subject to periodic checks and audits by properly designated representatives of the City without prior notice to Midtown Towing. All records/trucks used for towing under this agreement shall be inspected by Midtown Towing's mechanic once per month. The following check off list shall be used by our mechanic in conducting inspections: undercarriage Midtown Towing of Miami, Inc. dI 653 RFP #:24-08-01 Proposer: Midtown Towing of Miami, Inc. secure; no hydraulic leaks; cable not shared; chains, cones in place; equipped with flares, shovel, broom and sand; lights operable; and tires are safe. Empty shall deliver all reports prior to any towing for that month. If the city determines that equipment used by midtown towing to perform the services under this agreement failed any of the inspection terms in section 27, Midtown Towing shall have 30 days to cure a deficiency. Failure to cure a deficiency shall constitute a default. 25 - EMERGENCY TOWING OF CITY OF SUNNY ISLES BEACH VEHICLES: Midtown Towing shall also provide emergency towing of City vehicles. RECOMMENDATION: Staff recommends approval of this Resolution. REASONS: On August 5, 2024, the city released RFP # 24-08-01 titled Towing Services. The City of Sunny Isles Beach invited licensed and experienced towing firms to submit qualifications and proposals for the removal, impounding, and/or storage of junk vehicles, abandoned vehicles, illegally parked vehicles, non -drivable vehicles at accident scenes, the vehicles of prisoners arrested by the City of Sunny Isles Beach Police Department, confiscated vehicles, or for any other reason that arises from the streets or other areas within the City, or from other locations as directed by the Police Department. The City of Sunny Isles Beach intends to enter into agreements with one (1) or more successful proposers to provide towing services on a month-to-month rotating basis. The City may elect to contract with a total of three towing companies on a monthly rotating basis, as it is deemed in the City's best interest. The Towing Firm will provide 24-hour towing services, 365 days per year. The proposer will supply the City with priority services, especially during emergency disasters such as floods/hurricanes. The Towing Firm must charge the Non -Consent Tow Rates in accordance with Miami -Dade County Maximum rates and will only be adjusted by County revisions to these rates. Failure to service emergency calls within a reasonable time or contract fees, may result in contract termination. Item Number: 9.Y 620 On August 28, 2024, the city received three (3) electronic proposals from Dolphin Towing and Recovery, Inc., Midtown Towing of Miami, Inc, and Prestige Auto Transport Towing & Recovery. Two out of the three firms were considered responsive/responsible for further review. On Wednesday, November 13, 2024, the city held a publicly advertised sunshine evaluation committee meeting to review the two firms that were deemed responsive. In addition to the meeting, the evaluation committee meeting visited the towing yards of Dolphin Towing and Recovery, Inc. and Midtown Towing of Miami, Inc,. Following the site -visits and review of the proposals, the committee recommends the City Manager to award a contract to both towing companies on a rotating basis. ADDITIONAL INFORMATION: The RFP contained Minimum Qualification Requirements that proposals must meet in order to be determined responsive. The MQRs were: 1. Proposer must maintain an office and adequate storage facility located within a ten (10) mile radius of the Government Center located at 18070 Collins Avenue, City of Sunny Isles Beach, Florida. Proposer must provide proof of ownership or lease agreement for the storage facilities with the proposal response. 2. Proposer must provide copies of a general towing and wrecker service license. Proposer shall be fully licensed to perform the work described herein and shall comply with all applicable State statutes and local codes and ordinances. 3. Proposer and/or named parties to the response to this RFP must successfully service at least two (2) commercial clients and one (1) government agency of similar size and scope as being requested in this RFP since 2019. • The RFP Package is available upon request to the City Clerk's Office. • Verified Governmental References are available upon request to the City Clerk's Office. • Firm's Proposal available upon inspection. FUNDING SOURCE: Revenue Contract.
