A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, APPROVING AN AMENDMENT TO THE LEASE AGREEMENT BETWEEN
THE CITY OF SUNNY ISLES BEACH, FLORIDA, AND THE UNITED STATES POSTAL
SERVICE, _ATTACHED HERETO AS EXHIBIT "A"; AUTHORIZING THE CITY
MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION;
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Sunny Isles Beach, Florida (the "City"), leases a portion of its
Government Center, located at 18070 Collins Avenue, to the United States Postal Service ("Postal
Service") for a post office branch location; and
WHEREAS, the previous lease agreement expired on March 31, 2025; and
WHEREAS, the City wishes to continue to lease office space to the Postal Service for a
branch location in the Government Center; and
WHEREAS, the City Commission wishes to renew the lease and approve an amendment to
the Lease Agreement with the Postal Service, effective April 1, 2025, through March 31, 2030, in
an annual amount of Sixty -Five Thousand Four Hundred Dollars and No Cents ($65,400.00),
attached hereto as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Approval of Amendment. The City Commission hereby approves an amendment
to the Lease Agreement between the City of Sunny Isles Beach and the United States Postal
Service, effective April 1, 2025, through March 31, 2030, in an annual amount of Sixty -Five
Thousand Four Hundred Dollars and No Cents ($65,400.00), attached hereto as Exhibit "A".
Section 2. Authorization of City Manager. The City Manager is hereby authorized to do all
things necessary to effectuate the terms of this Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

This refers to the Lease accepted by the United States Postal Service, hereinafter called the Postal Service, under date
of 04/02/2020, whereby there is leased to the Postal Service the above-described facility.
WHEREAS, the Postal Service desires and Landlord is willing to amend the Lease as specified below;
NOW THEREFORE, in consideration of the mutual covenants and agreements herein set forth, and for other good and
valuable consideration, the sufficiency of which is hereby acknowledged, the parties do hereby agree as follows,
effective on the date this document is executed by the Postal Service.
In all other respects, the Lease shall remain the same and is hereby confirmed.

1.) The Lease at Paragraph 4. Renewal Options, as it relates to the First Renewal Option, is hereby
amended as follows:

The parties agree that notwithstanding any notice requirements to the contrary, for the purposes of
exercising the First Renewal Option, the Postal Service's execution of this Lease Amendment shall be
a legally sufficient exercise of the First Renewal Option.
2.) With respect to the First Renewal Option term, commencing 4/1/2025 and expiring 3/31/2030 as described
in the Lease at Paragraph 4, and the Renewal Option Rider (Market Value), the parties agree as follows:
The parties agree to waive all notice and appraisal requirements set forth in the Lease with respect to the
Postal Service's exercise of the First Renewal Option. In lieu of the process set forth in Renewal
Option Rider (Market Value) to the Lease, the parties agree to negotiate the annual rental rate for
the First Renewal Option in good faith, and to document their agreement by the execution of an Amendment
(001) to the Lease setting forth the agreed-upon annual rental amount
3.) The parties agree that if the signature(s) of either Landlord or the Postal Service on this Lease
or any amendments, addendums, assignments, or other records associated with this Lease is not an original
but is an electronic signature, scanned signature or a digitally encrypted signature, then such electronic
signature, scanned signature or digitally encrypted signature shall be as enforceable, valid and binding
as, and the legal equivalent to, an authentic original wet signature penned manually by its signatory.
Signatures required under this Lease, or any amendments, addendums, assignments, or other records associated
therewith, may be transmitted by email or by fax and, once received by the party to whom such signatures were
transmitted, shall be binding on the party transmitting its signatures as though they were an original
signature of such party.

RE: Approval of a Lease Agreement with the United States Post Office
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
The City of Sunny Isles Beach entered into a lease agreement with the United States Postal Service
("Postal Service") in April 2020. The lease agreement is set to expire in March 2025. The Postal Service
has agreed to the first renewal option, effective April 1, 2025 through March 31, 2030, for a per annum
rental amount of $65,400.
ADDITIONAL INFORMATION:
This will be the 4th lease agreement with the US Postal Service to operate the post office at the
Government Center. A market analysis for rent was conducted to establish the rate for this renewal. It
represents and increase of $26,400. Previous rent revenue for this space is as follows:
2005 - 2010 = $8,400
2010 - 2015 = $21,000
2015 - 2020 = $25,200
2020 - 2025 = $39,000
