REGIS RESIDENCES," F/K/A "LA PLAYA BEACH" AND "LA PLAYA VARADERO" TO DECREASE THE DENSITY FROM 490 UNITS TO 361 UNITS, TO MODIFY THE BUILDING AMENITIES TO INCLUDE 14 CABANAS AND 10 GUEST SUITES, DECREASE THE BEACH BAR AND GRILL FROM 5,200 SQ. FT. TO 4,207 SQ. FT., REDUCE THE PUBLIC RESTAURANT SPACE FROM 8,462 SQ. FT. TO 7,193 SQ. FT., CONVERT 5,170 SQ. FT. OF RESIDENTIAL AMENITY AREA TO 1,068 SQ. FT. OF COMMERCIAL USE, AND ADD ONE LEVEL OF BELOW -GRADE PARKING TO TOWER 2; PROVIDING THE CITY MANAGER WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEALER; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, La Playa Beach Associates, LLC (the "Applicant") is seeking approval of a Site Plan Modification (PZ2024-07) to modify the approved site plan for the project "St. Regis Residences" formerly known as, "La Playa Beach" and "La Playa Varadero," which was approved by the City of Sunny Isles Beach ("City") pursuant to Resolution No. 15-Z-156, passed and adopted November 19, 2015, and later modified through Resolution No. 16-Z-158, passed and adopted April 21, 2016, and through Resolution No. 22-Z-189, passed and adopted February 17, 2022; and WHEREAS, the Applicant's Site Plan Modification Application requests the following: I. Pursuant to Section §265-18 and §265-35 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is seeking a Site Plan Modification for the project "St. Regis Residences" formerly known as, "La Playa Beach" and "La Playa Varadero." The proposed modification is to decrease the density from 490 units to 361 units, to modify the building amenities to include 14 cabanas and 10 guest suites, decrease the Beach Bar and Grill from 5,200 sq. ft. to 4,207 sq. ft., reduce the public restaurant space from 8,462 sq. ft. to 7,193 sq. ft., convert 5,170 sq. ft. of residential amenity area to 1,068 sq. ft. of commercial use, and add one level of below -grade parking to Tower 2. ADDRESS: 18801 Collins Avenue, Sunny Isles Beach FOLIO: 31-2202-003-0120 WHEREAS, on January 16, 2025, the City Commission conducted a public hearing on the site plan modification application; and WHEREAS, the public hearing was duly advertised and held as required by law, all interested parties concerned with the matter were heard, and due and proper consideration was given to the matter and to the positive recommendation contained in the City's Development Review Report; and WHEREAS, the City Commission reviewed the application for site plan modification, the written and oral recommendations of the Development Services Department, including the 2 recommended conditions, and hereby finds competent substantial evidence to support a showing by the Applicant that the request for an approval for a site plan modification is in compliance with the City's Land Development Regulations and the Comprehensive Plan, and maintains the basic intent and purpose of the zoning, subdivision or other land use regulations, which is to protect the general welfare of the public, particularly as it affects the stability and appearance of the community; and further finds that the application should be granted, subject to the conditions described herein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recital paragraphs are hereby ratified and confirmed as being true and the same are hereby made part of this Resolution. Section 2. Findings and Conclusions. Based upon an analysis of the site plan application and the standards for approval of a site plan modification under the City's Land Development Regulations, the City Commission hereby finds and concludes that the Applicant's request for a site plan modification of the approved site plan under Resolution No. 15-Z-156, and as modified by Resolution No. 16-Z-158, and Resolution No. 22-Z-189: To decrease the project density from 490 to 361 residential units, decrease the number of cabanas from 17 to 14, reduce the number of guest suites from 13 to 10, decrease the size of the Beach Bar and Grill from 5,200 sq. ft. to 4,207 sq. ft., reduce the size of the public restaurant space from 8,462 sq. ft. to 7,193 sq. ft., convert 5,170 sq. ft. of residential amenity area to 1,068 sq. ft. of commercial use, and add one level of below - grade parking to Tower 2 is in compliance with the Comprehensive Plan and the Land Development Regulations of the City of Sunny Isles Beach, and there is substantial competent evidence to support approval of the application. Section 3. Approval. The Applicant's request for a site plan modification of the approved site plan approved under Resolution No. No. 15-Z-156, and as modified by Resolution No. 16-Z-158, and Resolution No. 22-Z-189, to decrease the project density from 490 to 361 residential units, decrease the number of cabanas from 17 to 14, reduce the number of guest suites from 13 to 10, decrease the size of the Beach Bar and Grill from 5,200 sq. ft. to 4,207 sq. ft., reduce the size of the public restaurant space from 8,462 sq. ft. to 7,193 sq. ft., convert 5,170 sq. ft. of residential amenity area to 1,068 sq. ft. of commercial use, and add one level of below - grade parking to Tower 2, is hereby APPROVED, subject to all conditions set forth in Section 4 below. 3 Section 4. Conditions. 1. That the plans shall be substantially in accordance with that submitted for public hearing, which are entitled "St. Regis Residences", prepared by Arquitectonica, stamped received on January 10, 2025, consisting of 82 sheets. Additionally, the landscaping plans entitled "St. Regis Sunny Isles Residences", prepared by EDSA, stamped received on December 6, 2024, consisting of 55 sheets. The civil plans entitled "St. Regis Residences", prepared by Fortin, Leavy, Skiles, Inc., stamped received on June 7, 2024, consisting of 12 sheets. 2. Upon the submittal of an application for a building permit, the plans submitted shall be approved by the Planning and Zoning Department and be consistent with the specific site plan approved by the City Commission. Plans shall include all the required elements of the site plan pursuant to the City's Land Development Regulations and recommendations. Should compliance with recommendations result in a change that would not be considered "minor" in accordance with Section 265-18 of the City Code; the Applicant shall be required to obtain another approval of the City Commission. 3. All conditions and approvals enumerated under Resolution Nos. 15-Z-156, 2015-2497, 16- Z-158, 2016-2511, 2017-2656, and 22-Z-189 shall remain in effect, unless modified or deleted as part of this application. 4. Resolution 22-Z-189, Section 4.1., Condition number 3 shall be revised to eliminate the shared parking agreement from the required Declaration of Restrictive Covenant and recognize the reduction of cabanas to 14 and guest suites to 10. 5. The Applicant shall address comments provided by the City's Landscape Architect Consultant regarding landscape plans per the memo dated 12/18/2024 prior to issuance of building permit. The City Manager or designee shall review and provide additional comments if necessary. 6. Development signage must conform to requirements of the Land Development Regulations and will be addressed prior to issuance of building permit. 7. Loading spaces shall not be located in the front yard, which is between the building and Collins Avenue. 8. All elements of the arrival features, water features, walls, development signage, and sculpture podium bases shall not encroach into the 10' landscape easement along Collins Avenue., 9. That the Applicant shall pay all fees related to the review of the application described herein and shall have paid all other fees due to the City. D 10. That the approved site plan shall remain valid for a period of 60 -months from the date of the site plan modification approval, provided that a building permit is obtained for the south tower within 24 -months. If no building permit is issued within the 24 -month time period, the site plan shall be considered null and void and of no force and effect. FAILURE BY THE CITY TO TIMELY ENFORCE ANY OF THE ABOVE CONDITIONS DOES NOT CONSTITUTE A WAIVER OF THE SAME AND IF THE APPLICANT, ITS SUCCESSORS, OR, ASSIGNS, DOES NOT PERFORM SUCH CONDITIONS WITHIN FIVE (5) DAYS AFTER WRITTEN NOTICE, THE CITY RETAINS THE RIGHT TO STOP CONSTRUCTION, IF NECESSARY, UNTIL THAT CONDITION IS MET. BY ACTING UNDER THIS APPROVAL, APPLICANT HEREBY CONSENTS TO ALL THESE TERMS AND CONDITIONS. Section 5. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 6. Severability. If any section, subsection, sentence, clause, phrase, or portion of this Resolution is, for any reason, held invalid or unconstitutional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining potions of this Resolution. Section 7. Repealer. All Resolutions or parts of Resolutions in conflict herewith shall be and are hereby repealed. Section 8. Effective Date. This Resolution shall become effective upon adoption. Folio: 31-2202-003-0120 Site Description: The property is a rectangular lot located on the east side of Collins Avenue. It was developed in 1963 with a two-story motel with 349 units, known as the La Playa Varadero Motel Condominium. Today, the property is improved with the temporary sales office (approved per Resolution 2015-2444) on the northern side and the deep soil mix is currently underway on the south side, prepping the site for development. REQUEST Pursuant to Section §265-18 and §265-35 of the City of Sunny Isles Beach Land Development Regulations, the Applicant is seeking a Site Plan Modification for the project "St. Regis Residences" formerly known as, "La Playa Beach" and "La Playa Varadero." The proposed modification is to decrease the density from 490 units to 361 units, to modify the building amenities to include 14 cabanas and 10 guest suites, decrease the Beach Bar and Grill from 5,200 sq. ft. to 4,207 sq. ft., reduce the public restaurant space from 8,462 sq. ft. to 7,193 sq. ft., convert 5,170 sq. ft. of residential amenity area to 1,068 sq. ft. of commercial use, and add one level of below -grade parking to Tower 2. IV. PLANNING REVIEW On November 19, 2015, per Resolution 15-Z-156, the Applicant received site plan approval for two 56 -story towers consisting of 431 residential condominiums, 60 hotel units and 90 apartment -hotel units with a total of 1,228,435 square feet of floor area. On April 21, 2016, per Resolution 16-Z-158, the Applicant received site plan modification approval for two 56 -story towers consisting of 490 residential condominiums, 12 cabanas, 7,781 square feet of restaurant space, 7,780 square feet office space and 1,850 square feet of retail space and 1,228,154 square feet of floor area. On February 17, 2022, per Resolution 22-Z-189, the Applicant received another site plan modification approval for two 62 -story towers consisting of 490 residential condominiums, an 8,000 square foot private members club, a 5,200 square foot beach bar and grill restaurant, an 8,462 square foot public restaurant, 17 cabanas, 13 guest suites, and a shared parking agreement between the spa and restaurant uses. The proposed modification is consistent with Future Land Use Element Policy 14B, which establishes the maximum floor area ratio and density for the Mixed Use — Resort/High Density future land use category. There is no proposed increase in the floor area ratio and the modification proposes to decrease the number of dwelling units to 361. The maximum number of dwelling units permissible by the Comprehensive Plan is 490. V. ZONING SITE PLAN REVIEW The following is an analysis of the proposed site plan with the site development standards of the MU -R, "Mixed Use - Resort" zoning district, and other applicable Land Development Regulations. The plans reviewed are on file, and may be examined, in the City Clerk's Office and are entitled "St. Regis Residences", prepared by Arquitectonica, stamped received on January 10, 2025, consisting of 82 sheets. Additionally, the landscaping plans entitled "St. Regis Sunny Isles Residences", prepared by EDSA, stamped received on December 6, 2024, consisting of 55 sheets. The civil plans entitled "St. Regis Residences", prepared by Fortin, Leavy, Skiles, Inc., stamped received on June 7, 2024, consisting of 12 sheets. ResorF(MU R) ` Site Development Standards , Code Section Required "' Previously = January 16, 2025 PZ2024-07 *** To provide more information on the floor area ratio (FAR), the approved plans per Resolution 22-Z-189 impermissibly excluded floor area from the FAR calculations that was located on levels -2 through 2. Code Section §265-35.D(9)(a)[1][e] was incorrectly applied to exclude all floor area that is located within the parking structure. This excluded floor area included amenity spaces, cabanas, corridors, elevator lobbies, the pool bar, trash rooms, and bathrooms, while the only permissible exclusions are the parking spaces themselves. The total area that was excluded was 24,369 square feet. Upon submittal of the current site plan modification, this exclusion was revealed and corrected. The current plans "grandfather" the previously excluded 24,369 square feet. All new floor area on levels -2 through 2 are included in the FAR totals, such as pet spas, office spaces, housekeeping, etc. The site plan modification approved via Resolution 22-Z-189 included a shared parking agreement between the spa and restaurant uses because there was a deficiency in parking. However, the modification currently proposed decreased the unit density by 129 residential units, which decreased the required parking. Therefore, the shared parking agreement is no longer required. The City's planning, traffic, civil, and landscape consultants have reviewed the proposed site plan modification for conformance with the applicable Land Development Regulations. All comments were addressed, except for three comments from the landscape architect, which are included as a condition of approval of this modification. These comments are regarding street tree spacing, irrigation, and an discrepancy in the quantities of native and drought tolerant plants. VI. FINAL ANALYSIS The proposed site plan modification is consistent with the Comprehensive Plan and Land Development Regulations. Staff recommends the conditions outlined in Section VII be included, should the City Commission approve the application. Staff has compiled the relevant facts of the requested site plan modification and recommends the application be presented to City Commission for consideration. VII. To accommodate these circumstances, the Applicant now seeks to amend the 2022 Approval, including the following: 1. Reduce density from 490 units to 361 units; 2. Increase FAR to the total approved FAR of 5.98 (from 1,192,039 to 1,228,435 sqft.); 3. Decrease Cabanas from 17 to 14; 4. Reduce Guest Suites from 13 to 10; 5. Decrease Beach Bar and Grill from 5,200 sqft. to 4,207 sqft. REASONS: The Applicant proposed a Site Plan Modification the St. Regis Residences project (FKA La Playa Beach) to decrease the project density from 490 to 361 residential units, decrease the number of cabanas from 17 to 14, reduce the number of guest suites from 13 to 10, decrease the size of the Beach Bar and Grill from 5,200 sq. ft. to 4,207 sq. -ft., reduce the size of the public restaurant space from 8,462 sq. ft. to 7,193 sq. ft., convert 5,170 sq. ft. of residential amenity area to 1,068 sq. ft. of commercial use, and add one level of below -grade parking to Tower 2.
