RESOLUTION NO. 2025 - 3 bC+ <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 1984, TO EXPEND FORFEITURE FUNDS <br />FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT TO <br />FUND A FULL-TIME SCHOOL RESOURCE SERGEANT POSITION, IN AN AMOUNT NOT <br />TO EXCEED ONE HUNDRED NINETY-EIGHT THOUSAND DOLLARS AND NO CENTS <br />($198,000.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds <br />from the established Department of Justice ("DOJ") federal forfeiture account, for approved <br />programs or purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements to fund the position of a full-time school <br />resource sergeant, in an amount not to exceed One Hundred Ninety -Eight Thousand Dollars and <br />No Cents ($198,000.00), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Federally Forfeited Monies. Based on the certification, attached <br />hereto as Exhibit "A", the Chief of Police is hereby authorized to expend One Hundred Ninety -Eight <br />Dollars and No Cents ($198,000.00), from the established Department of Justice federal forfeitures <br />account to fund the position of a full-time school resource sergeant. <br />Section 2. Effective Date.
