HomeMy WebLinkAboutReso 2025-3804RESOLUTION NO. 2025 - 3 bC+ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE COMPREHENSIVE CRIME CONTROL ACT OF 1984, TO EXPEND FORFEITURE FUNDS FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNT TO FUND A FULL-TIME SCHOOL RESOURCE SERGEANT POSITION, IN AN AMOUNT NOT TO EXCEED ONE HUNDRED NINETY-EIGHT THOUSAND DOLLARS AND NO CENTS ($198,000.00), ATTACHED HERETO AS EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from the established Department of Justice ("DOJ") federal forfeiture account, for approved programs or purchases intended to enhance law enforcement purposes; and WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a municipality, liens and forfeiture funds may be expended if accompanied by written certification that the request complies with the provisions of the aforementioned subsections; and WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in compliance with the aforementioned legal requirements to fund the position of a full-time school resource sergeant, in an amount not to exceed One Hundred Ninety -Eight Thousand Dollars and No Cents ($198,000.00), attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Expenditure of Federally Forfeited Monies. Based on the certification, attached hereto as Exhibit "A", the Chief of Police is hereby authorized to expend One Hundred Ninety -Eight Dollars and No Cents ($198,000.00), from the established Department of Justice federal forfeitures account to fund the position of a full-time school resource sergeant. Section 2. Effective Date. This Resolution shall become effective immediately upon adoption. PASSED AND ADOPTED this 20th day of Marchr2Q25. " (305) 947-0606 City Hall (305)949-3113 Fax MEMORANDUM TO: Honorable Mayor and City Commissioners VIA: Stan Morris, City Manager FROM: Edward Santiago, Chief of Police DATE: March 20, 2025 RE: Authorize the Expenditure of DOJ Forfeiture Funds for a School Resource Sergeant RECOMMENDATION: Staff recommends approval of this Resolution. REASONS: The Police Department is seeking approval to expend Department of Justice forfeiture funds to pay for the salary and benefits of a full time school resource sergeant (SRS). The SRS position will allow our police department to continue to have an active presence at the school and will assist with supplementing the current police officer provided by Miami -Dade Schools Police. The SRS will be expected to work in conjunction with the Miami -Dade Schools Police Officer assigned to the school to serve the students, teachers, and parents as well as to participate in educational programs such as DARE. The estimated amount to include fringe benefits needed to fund this position is $198,000.00. FUNDING SOURCE: Funds have been appropriated in various accounts within fund 600.
