A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND EXECUTE A
FIFTH AMENDMENT TO THE AGREEMENT WITH LIGHT ER UP LLC, TO INSTALL
HOLIDAY LIGHTS AND DECORATIONS AT VARIOUS LOCATIONS THROUGHOUT
THE CITY, PROVIDED SAID AMENDMENT IS FIRST APPROVED AS TO LEGAL
FORM AND SUFFICIENCY BY THE CITY ATTORNEY; FURTHER AUTHORIZING THE
CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS
RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, on July 15, 2021, via Resolution No. 2021-3218, the City Commission of the
City of Sunny Isles Beach ("City") awarded Request for Proposals No. 21-03-01 to, and approved
an agreement with, Light Er Up LLC ("Vendor"), in an amount not to exceed $407,000.00 (the
"Agreement"), to install holiday lights and decorations at various locations throughout the City
("Decorations"); and
WHEREAS, on February 7, 2022, the City Manager exercised his authority and executed
a First Amendment with the Vendor for the installation, removal, maintenance, and storage of
City owned decor at no additional cost to the City; and
WHEREAS, on September 13, 2021, the City Manager authorized the issuance of a
purchase order to the Vendor for additional Decorations at Heritage Park for the 2021 Holiday
Season, in an amount not to exceed $2,750.00, subsequently ratified by the City Commission on
July 21, 2022, via Resolution No. 2022-3363 ("Resolution"); and
WHEREAS, via the Resolution, the City Commission also approved a Second Amendment
to the Agreement with the Vendor for additional Decorations for the 2022 Holiday Seasons in
an amount not to exceed $31,444.55; and
WHEREAS, on August 17, 2023, via Resolution 2023-3530, the City Commission
approved a Third Amendment to the Agreement with the Vendor for additional Decorations for
the 2023 Holiday Seasons in an amount not to exceed $28,000.00; and
WHEREAS, on June 20, 2024, via Resolution 2024-3675, the City Commission approved a
Fourth Amendment to the Agreement with the Vendor for additional Decorations for the 2024
Holiday Seasons in an amount not to exceed $169,080.00; and
WHEREAS, the City being satisfied with the services of the Vendor wishes to exercise its
second and final renewal option; and
WHEREAS, the City Commission wishes to authorize the City Manager to negotiate and
execute a Fifth Amendment to the Agreement with the Vendor to install holiday lights and
decorations at various locations throughout the City, provided said amendment is first
approved as to form and legal sufficiency by the City Attorney.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA, AS FOLLOWS:
Section 1. Authority to Negotiate and Execute the Fifth Amendment. The City Commission
hereby authorizes the City Manager to negotiate and execute a Fifth Amendment to the
Agreement with the Vendor to install holiday lights and decorations at various locations
throughout the City, provided said amendment is first approved as to form and legal sufficiency
by the City Attorney.
Section 2. Authorization of City Manager and City Attorney. The City Manager and City
Attorney are hereby authorized to do all things necessary to effectuate this Resolution.
Section 3. Effective Date. This Resolution shall become effective upon adoption.

We are thrilled at the opportunity to bid on the Rental and Installation of Holiday Decor.
Light Er Up began as a design firm seeking to change the way you see holiday decor. Our
previous experience in turnkey holiday lighting led our team to seek out innovative and unique
decor options.
Whether a commercial client looking for non -denominational illuminations or a city art district
looking for abstract illuminations, we were typically stuck with ordinary, traditional decor.
Changing the typical landscape of Christmas lights to dynamic, modem, and interactive
displays.
Our goal on every illumination project is to make a destination that creates and captures an
audience For the city of Sunny Isles, we plan to create impressive displays that accentuates the
City's vibrance while benefiting local community and visitors. Our team understands the project
specifications include rental of product, design, installation, maintenance, removal, and
transport.
We are able to meet this goal by providing innovative decor, reliable technical products,
exceptional service, and a revolutionary team of individuals focused on achieving magical
lighting experiences.

Light Er Up has been in existence for at least (8) years under this name, providing
assembly and disassembly of large-scale holiday decorations in good standing with a

- Nicholas Caine, Founder and current president overseas all aspects of projects from design to
implementation. Overseeing full operations, hands- on and passionate. Nicholas has the
knowledge and experience to bring individuals together to create one -of -a -kind holidays
displays. Nicholas' main goal is our rigorous training which starts in August and runs
throughout the season. Service is our number one priority. Nicholas Caine will be the main
point of contact on this project. Nicholas has spent countless hours working with the entire team
to create this proposal. Nick has been installing Lights for over 10 Years. Providing training and
overseeing operations of installations daily for a safe environment and impeccable result for
customers. Specialized in animated light displays and RBG lighting.

Kevin Truy - Install Manager
- Kevin Truy, Creating a safe and efficient installation. Managing
operation for efficient and high-quality installation of lights and decoration. From the time our
pieces get approved, his role comes into play ensuring all d6cor pieces have been maintained,
manufactured and ready for install. Our Install Manager is responsible for pre -installation
inspections, creating installation plans, overseeing the installs and all quality control inspections
We have countless install crews that are all run by our install manager, after each project is
complete, he works directly with our maintenance manager Eliezer to ensure everything is up
and running, directly communicating with city/airport officials of any updates. Kevin Truy is on
call 24/7 to answer any of our clients' questions and or concerns. He then provides a final green
light and final install checklist once each project is complete.
Junier Lara — Director of Operations
- Junier is responsible to make sure all aspects of our company are running to allow us to create
these one -of -a -kind displays. Junier has managed crews of up to 150 employees at a time
bringing everyone together and becoming a team player to meet deadlines. Light Er Up runs 3
eight hour shifts to ensure we always have crews ready to meet any last-minute deadlines.

RE: Approval of Fifth Amendment with Light'Er Up Miami, LLC for Holiday Lights
and Decorations
RECOMMENDATION:
Staff recommends approval of this Resolution.
REASONS:
In 2021, the City awarded Request for Proposals No. 21-03-01 to Light 'Er Up Miami, LLC to install
holiday lights and decorations at various locations throughout the City. At that time, the City entered
into an agreement with Light 'Er Up Miami, LLC with an initial term of three (3) years, with two (2)
additional one (1) renewal periods, for a maximum of five (5) years.
Although the reviews of last year's holiday lights design was extremely positive, there were areas
identified that could be improved upon. Additions for this year would include the following:
Samson Oceanfront Park:
• One tree (gold, silver, and red ornament package)
• One menorah
• Two stars
• Date palm fronds wrapped in green lights
Gateway Park:
• Willowtree
• Snowflakes on the fagade of the stage
• Additional Jewish decor
• Date palm fronds wrapped in green lights

ADDITIONAL INFORMATION:
The City has been satisfied with the services provided by Light'Er Up Miami, LLC, and therefore, wishes
to exercise our second and final renewal option for a cost of $279,180.00. This will bring the contract
total not -to -exceed amount to $917,454.55. This amount includes $85,808.40 in contingency funds.
These contingency funds will only be used if the City Commission directs additional decorations or in the
event of justified price increases due to tariffs.
Based on the discussion and consensus of the Commission at the afternoon workshop, approval of this
resolution will give the City Manager the authority to finalize and enter into the agreement with Light
'Er Up Miami, LLC to avoid any further price increases.
FUNDING SOURCE:
Funding will be budgeted for in next fiscal year (FY25-26) under account number 001-6-5730-431000-
60850 (Contracted Services - Holiday Lights).
