HomeMy WebLinkAboutReso 2025-3826RESOLUTION NO. 2025 - A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING AN INTERLOCAL AGREEMENT WITH MIAMI-DADE COUNTY TO PERFORM TRAFFIC ENGINEERING FUNCTIONS FOR SIGNING AND MARKING; AUTHORIZING THE MAYOR TO EXECUTE SAID INTERLOCAL AGREEMENT; AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, pursuant to Section 2-96.1 of the Miami -Dade County (the "County") Code of Ordinances, all traffic control and traffic engineering services in the County are under their exclusive jurisdiction; and WHEREAS, the City of Sunny Isles Beach (the "City") desires to assume the installation and maintenance responsibilities of certain traffic engineering functions pertaining to its municipal streets and rights-of-way; and WHEREAS, the City wishes to install and maintain branded street name signs and poles (the "Street Name Signs"), existing striping and marking, new striping and marking, new in - pavement lighted crosswalks and Stop Signs and poles; and WHEREAS, all new striping and marking will be based on prior County approval; and WHEREAS, the City Commission finds that it is in the best interest of its residents, visitors, and stakeholders to approve an Interlocal Agreement with the County to perform traffic engineering functions for signing and marking, attached hereto as Exhibit "A". NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Approval of Interlocal Agreement. The City Commission hereby approves an Interlocal Agreement with Miami -Dade County to perform traffic engineering functions for signing and marking, attached hereto as Exhibit "A". Section 2. Authorization of Mayor. The Mayor is hereby authorized to execute said Interlocal Agreement. Section 3. Authorization of City Manager. The City Manager is hereby authorized to do all things necessary to effectuate this Resolution. Section 4. Effective Date. Boileau, for Nabors, Giblin & Nickerson, P.A., City Attorney Vote: Mayor Svechin (Xes) (No) Vice Mayor Lama (Yes) (No) Commissioner Joseph (Yes) (No) Commissioner Stuyvesant ✓; (Yes) (No) Commissioner Viscarra (Yes) (No) @BCL@4COE65FC.doc Page 2 of 2 565 INTERGOVERMENTAL AGENCY AGREEMENT TO PERFORM TRAFFIC ENGINEERING FUNCTIONS FOR SIGNING AND MARKING This Intergovernmental Agency Agreement to Perform Traffic Engineering Functions (this "Agreement") is made and entered into this day of , 2025, by and between Sunny Isles Beach, Florida, a municipal corporation of the State of Florida, (the "City") and Miami -Dade County, a political subdivision of the State of Florida (the "County") WITNFRRFTH WHEREAS, pursuant to Section 2-96.1 of the Miami -Dade County Code, all traffic control and traffic engineering services in Miami -Dade County are under the exclusive jurisdiction of the County; and WHEREAS, the City desires to assume the installation and maintenance responsibilities of certain traffic engineering functions pertaining to its municipal streets and right-of-ways only and has requested the County to allow it to perform the installation and maintenance of branded street name signs and poles (the "Street Name Signs"), existing striping and marking, new striping and marking, new in -pavement lighted crosswalks and Stop Signs and poles, all new striping and marking will be based on prior County approval; and WHEREAS the City has, by proper resolution, which is attached hereto as Exhibit "A" and made a part hereof by reference, authorized its officer(s) to enter into this Agreement. NOW THEREFORE, the City and the County agree as follows: 1. The recitals set forth above are incorporated herein and made a part hereof by reference. 2. The City will only install and maintain the Street Name Signs, striping and marking, new in -pavement lighted crosswalks and Stop Signs within municipal streets within its boundaries. A copy of the City's Street Name Signs and Stop Signs standard design detail is attached hereto as Exhibit "B." 566 3. The City shall attach a decal to the back of the sign panels indicating ownership and date of installation. 4. The City assumes sole and complete responsibility for the maintenance of all Street Name Signs, striping and marking, new in -pavement lighted crosswalks and Stop Signs that are installed by the City within its boundaries. 5. The City assumes sole and complete liability for any accidents and/or injuries which may or are alleged to occur or arise out of the installation, operation or maintenance of said traffic - control devices, and hereby indemnifies and saves harmless the County from any and all claims of negligence as a result of the installation, operation or maintenance of said signs, striping and marking. Neither the City nor the County in any way waives its rights and immunities under Section 768.28 of Florida Statues. 6. All Street Name Signs, striping and marking, new in -pavement lighted crosswalks and Stop Signs installed by the City accordance with this Agreement shall conform to the applicable requirements established by the following publications: A. Florida Department of Transportation Standard Specifications for Road and Bridge Construction. B. Manual on Uniform Traffic Control Devices for Streets and Highways, U.S. Department of Transportation Federal Highway Administration (ANSI D6.le-1989), including latest revisions; C. Standard Highway Signs, U.S. Department of Transportation, Federal Highway Administration; and D. Miami -Dade County Public Works Manual (available from the Public Works Department, Reproduction Services, 111 N.W. 1 Street, Suite 1604, Miami, FL 33128). 7. For installation of Street Name Signs, striping and marking, new in -pavement lighted crosswalks and Stop Signs, the City shall hire a County licensed contractor or perform the work in-house by the City Public Works Department. 8. The City shall be responsible for keeping records of any and all installations and repairs, and furnishing pertinent documents as and when said records may be requested. 2 567 9. Failure to carry out any of the duties and responsibilities assumed herein by the City may result in termination of this Agreement, at the sole discretion of the County. 10. The City assumes sole and complete responsibility for the maintenance of all such Street Name Signs, striping and marking, new in -pavement lighted crosswalks and Stop Signs. 11. REASONS: The City of Sunny Isles Beach wants to take control of the decorative street name signage, striping and pavement markings throughout the City local streets and has entered into an Interlocal Agreement with Miami -Dade County to do so. The attached agreement for execution by the City, will allow the City more control over the signage, striping and marking of the City streets. ADDITIONAL INFORMATION: This resolution does not include the state roads through our City such as Collins Avenue, Sunny Isles Boulevard and the William Lehman Causeway, nor any private roads such as Poinciana Island, Arlen House and the Ocean Reserve/Oceanview complex.
