RESOLUTION NO. 2025 - S
<br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
<br />FLORIDA, RATIFYING A FIFTH AMENDMENT TO THE AGREEMENT WITH JORDA
<br />ENTERPRISES, INC., FOR INSPECTION AND PREVENTATIVE MAINTENANCE
<br />SERVICES FOR THE HVAC EQUIPMENT LOCATED IN THE GOVERNMENT CENTER;
<br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO
<br />EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE.
<br />WHEREAS, on September 15, 2016, the City Commission of the City of Sunny Isles Beach
<br />(the "City") issued and advertised Invitation to Bid No. 16-09-02 (the "ITB") for New HVAC
<br />Chiller Systems for the Government Center (the "Services"), and received six (6) bids;
<br />WHEREAS, the City Manager, based on information provided by staff, determined that
<br />Jorda Enterprises, Inc. (the "Contractor") submitted the lowest responsible, responsive bid; and
<br />WHEREAS, on March 16, 2017, via Resolution No. 2017-2675 the City Commission
<br />awarded the ITB to, and authorize the City Manager to negotiate and enter into an Agreement
<br />with, the Contractor for the Services, in an amount not to exceed $774,050.00; and
<br />WHEREAS, on April 15, 2021, via Resolution No. 2021-3186, the City Commission
<br />executed a First Amendment to the Agreement with the Contractor, thereby exercising its first
<br />of four (4) renewal options, in an amount not exceed $62,960.00; and
<br />WHEREAS, on April 12, 2022, via Resolution No. 2022-3313, the City Commission
<br />executed a Second Amendment to the Agreement with the Contractor, thereby exercising its
<br />second of four (4) renewal options, in an amount not exceed $31,480.00; and
<br />WHEREAS, on April 20, 2023, via Resolution No. 2023-3492, the City Commission
<br />executed a Third Amendment to the Agreement with the Contractor, thereby exercising its third
<br />of four (4) renewal options, in an amount not exceed $31,480.00 bringing the total contract
<br />amount not to exceed $125,920.00; and
<br />WHEREAS, on April 18, 2024, via Resolution No. 2024-3651, the City Commission
<br />executed a Fourth Amendment to the Agreement with the Contractor, thereby exercising its
<br />fourth and final renewal option, in an amount not exceed $31,480.00, bringing the total
<br />contract in an amount not to exceed $157,400.00; and
<br />WHEREAS, in April 2025, the City Manager determined that it was in the best interest of
<br />the City to execute a Fifth Amendment to the Agreement with the Contractor to extend the
<br />term of the fourth renewal option for an additional three (3) months ("Term Extension"),
<br />provided said Amendment was subsequently ratified by the City Commission; and
<br />WHEREAS, the City Commission now wishes to ratify a Fifth Amendment to the
<br />Agreement with the Contractor for the Term Extension through July 28, 2025, attached hereto
<br />as Exhibit "A".
