RESOLUTION NO. 2025 - 3 <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, AUTHORIZING THE CHIEF OF POLICE, IN ACCORDANCE WITH THE <br />COMPREHENSIVE CRIME CONTROL ACT OF 19841 TO EXPEND FORFEITURE FUNDS <br />FROM THE DEPARTMENT OF JUSTICE ("DOJ") FEDERAL FORFEITURE ACCOUNTTO <br />PURCHASE FITNESS EQUIPMENT FOR THE POLICE DEPARTMENT, IN AN AMOUNT <br />NOTTO EXCEED ONE HUNDRED TWENTY-TWO THOUSAND TWO HUNDRED FIFTY- <br />SIX DOLLARS AND FORTY-ONE CENTS ($122,256.41), ATTACHED HERETO AS <br />EXHIBIT "A"; PROVIDING FOR AN EFFECTIVE DATE. <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984, the City of <br />Sunny Isles Beach ("City") and its Police Department are authorized to expend forfeiture funds from <br />the established Department of Justice ("DOJ") federal forfeiture account, for approved programs or <br />purchases intended to enhance law enforcement purposes; and <br />WHEREAS, in accordance with the Comprehensive Crime Control Act of 1984 and Florida <br />Statutes §932.7055(5)(b), upon the request of the Chief of Police to the governing body of a <br />municipality, liens and forfeiture funds may be expended if accompanied by written certification <br />that the request complies with the provisions of the aforementioned subsections; and <br />WHEREAS, the Chief of Police has submitted a request to expend DOJ forfeiture funds in <br />compliance with the aforementioned legal requirements to purchase fitness equipment for the <br />Police Department, in an amount not to exceed One Hundred Twenty -Two Thousand Two Hundred <br />Fifty -Six Dollars and Forty -One Cents ($122,256.41), attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Expenditure of Federally Forfeited Monies. Based on the certification, attached <br />hereto as Exhibit "A", the Chief of Police is hereby authorized to spend One Hundred Twenty -Two <br />Thousand Two Hundred Fifty -Six Dollars and Forty -One Cents ($122,256.41), from the established <br />Department of Justice federal forfeitures account to purchase fitness equipment for the Police <br />Department. <br />Section 2. Effective Date.
