RESOLUTION NO. 2025 -
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH,
FLORIDA, DIRECTING THE CITY MANAGER TO INITIATE PUBLIC ENGAGEMENT
ACTIVITIES AND DEVELOP A COMPREHENSIVE PLAN OF ACTION UNDER NEW
STATE REGULATIONS GOVERNING MOTORIZED SCOOTERS AND ELECTRIC
BICYCLES; PROVIDING FOR IMPLEMENTATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, through Ordinance No. 2023-609, the City Commission of Sunny Isles Beach
(the "City") established local regulations governing the use and operation of motorized scooters
and similar wheeled devices to protect the health, safety, and welfare of all city residents and
visitors; and
WHEREAS, following an educational implementation period, the City has registered
more than 1,008 motorized scooters, issued 2,240 violations, and issued 10 Uniform Traffic
Citations for the most egregious behavior; and
WHEREAS, the State of Florida enacted Senate Bill 462, now codified as Chapter 2025-
149, Laws of Florida, which expands the authority of municipalities to regulate the operation of
motorized scooters and electric bicycles; and
WHEREAS, while the City's existing regulations have received mixed reactions, the City
Commission recognizes the need for broader public input, thorough enforcement research, and
budgetary consideration; and
WHEREAS, the City seeks to ensure that all regulatory decisions promote the public
interest and improve safety on City streets and sidewalks.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY
ISLES BEACH, FLORIDA:
Section 1. Direction to the City Manager. The City Commission hereby directs the City
Manager to organize and facilitate public engagement activities, including but not limited to
town hall meetings and surveys to collect public input regarding the regulation of motorized
scooters and electric bicycles. The City Manager is further directed to analyze budgetary
impacts and enforcement strategies related to the implementation of updated scooter
regulations under Chapter 2025-149, Laws of Florida.
Section 2. Comprehensive Plan of Action. The City Manager shall develop a viable and
comprehensive plan of action to be presented to the City Commission.
Section 3. Authorization of the City Manager. The City Manager is hereby authorized to do
all things necessary to effectuate the terms of this Resolution.

Section 4. Effective Date. This Resolution will become effective upon adoption.

RE: Directing City Manager to Develop Comprehensive Plan of Action to Address
the Usage of Micromobility Devices
RECOMMENDATION:
This item is presented for your consideration.
REASONS:
Earlier this month Governor Ron Desantis signed into law Senate Bill 462, now codified as Chapter 2025-
149, Laws of Florida. This amendment to Florida State Statute provides local governments with
authority to regulate the operation of motorized scooters and electric bicycles. Understanding the
City's desire to prioritize public safety, coupled with the mixed reactions received over our existing
regulations, city staff will host public engagement events and activities, while researching all aspects of
enforcement, to bring a comprehensive plan of action to address the usage of micromobility devices
within our jurisdiction for your consideration at a future meeting.
ADDITIONAL INFORMATION:
As of July 10, 2025, 1,008 scooters have been registered in our existing scooter program. 2,240
violations have been issued and 10 Uniform Traffic Citations have been issued for the most egregious
behavior.
