RESOLUTION NO. 2025 - 88S� <br />A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, <br />FLORIDA, APPROVING A FIRST AMENDMENT TO THE AGREEMENT WITH KONE <br />INC. FOR ELEVATOR SERVICE AND MAINTENANCE FOR THE ELEVATORS <br />LOCATED AT GATEWAY CENTER, IN AN AMOUNT NOT TO EXCEED FIFTY <br />THOUSAND DOLLARS AND NO CENTS ($50,000.00), ATTACHED HERETO AS <br />EXHIBIT "A"; AUTHORIZING THE MAYOR TO EXECUTE SAID AMENDMENT; <br />AUTHORIZING THE CITY MANAGER TO DO ALL THINGS NECESSARY TO <br />EFFECTUATE THE TERMS OF THIS AGREEMENT; PROVIDING FOR AN EFFECTIVE <br />DATE. <br />WHEREAS, on April 17th, 2025, via Resolution No. 2025-3821, the City Commission <br />approved an Agreement with Kone, Inc. (the "Contractor") to provide elevator service and <br />maintenance for the elevators located at Gateway Center (the "Services"), in an amount not to <br />exceed $103,350.00; and <br />WHEREAS, the Agreement with the Contractor included a contingency in the amount of <br />$50,000.00 (the "Contingency Amount") for any unforeseen repairs; and <br />WHEREAS, one of the elevators located at Gateway Center was in need of unexpected <br />repairs and was put out -of -service; and <br />WHEREAS, the Contractor provided the City with a quote to perform the repairs, in an <br />amount not to exceed $73,261.97; and <br />WHEREAS, the City Manager is recommending allocating an additional $50,000.00, as <br />contingency (the "Supplemental Contingency") for any unforeseen repairs; and <br />WHEREAS, the City Commission wishes to approve a First Amendment to the Agreement <br />with the Contractor to add the Supplemental Contingency, in an amount not to exceed Fifty <br />Thousand Dollars and No Cents ($50,000.00), bringing the total contract amount not to exceed <br />One Hundred Fifty -Three Thousand Three Hundred Fifty Dollars and No Cents ($153,350.00), <br />attached hereto as Exhibit "A". <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY <br />ISLES BEACH, FLORIDA, AS FOLLOWS: <br />Section 1. Approval an Agreement. The City Commission hereby approves a First <br />Amendment to the Agreement with the Contractor to add the Supplemental Contingency, in an <br />amount not to exceed Fifty Thousand Dollars and No Cents ($50,000.00), bringing the total <br />contract amount not to exceed One Hundred Fifty -Three Thousand Three Hundred Fifty Dollars <br />and No Cents ($153,350.00), attached hereto as Exhibit "A". <br />Section 2.
