NE 174th Street Tree Removal and Relocation Request for Proposal No. 14-10-01 The Bid Specifications for this Request for Proposal are available from DemandStar by calling (800) 711- 1712 or by accessing their website at www.demandstar.com. The Bid Specifications may also be examined at the City of Sunny Isles Beach – Office of the City Clerk. Proposers who obtain the Bid Specifications from sources other than DemandStar or the City of Sunny Isles Beach are cautioned that their Bid response package may be incomplete. Addenda will be posted and disseminated by DemandStar at least five days prior to the submittal date to all Proposers who are listed on the official list. The City may not accept incomplete Bids. Bids shall be on a unit price basis; segregated Bids will not be accepted. Sealed Bids will be received by the City Clerk no later than 2:00 PM, on Wednesday, 12/03/14 at the Sunny Isles Beach Government Center located at 18070 Collins Avenue, 4th floor, Sunny Isles Beach, Florida, 33160. Bids received after this time will not be considered. The City is under no obligation to return Bids. Timely submitted Bids will be opened publicly and read aloud at this time. The Owner reserves the right to reject any or all Bids, with or without cause, to waive technical errors and informalities, and to accept the Bid, which best serves the interest of, and represents the best value to, the Owner in conformity with the criteria set forth in Section 62-8 of the Code of Ordinances of the City of Sunny Isles Beach. Jane Hines, MMC, City Clerk City of Sunny Isles Beach City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  4     SECTION 1 INSTRUCTIONS TO BIDDER / GENERAL TERMS AND CONDITIONS THESE INSTRUCTIONS ARE STANDARD FOR ALL BID COMMODITIES/SERVICES ISSUED BY THE CITY OF SUNNY ISLES BEACH. THE CITY OF SUNNY ISLES BEACH MAY DELETE, SUPERSEDE OR MODIFY ANY OF THESE STANDARD INSTRUCTIONS FOR A PARTICULAR CONTRACT BY INDICATING SUCH CHANGE IN SPECIAL INSTRUCTIONS TO BIDDERS OR IN THE BID SHEETS. ANY AND ALL SPECIAL CONDITIONS THAT MAY VARY FROM THE GENERAL CONDITIONS SHALL HAVE PRECEDENCE. BIDDER AGREES THAT THE PROVISIONS INCLUDED WITHIN THIS BID OR RFP SHALL PREVAIL OVER ANY CONFLICTING PROVISION WITHIN ANY STANDARD FORM CONTRACT OF THE BIDDER REGARDLESS OF ANY LANGUAGE IN BIDDER’S CONTRACT TO THE CONTRARY. 1.1 CLARIFICATION/EXPLANATION/QUESTIONS: Any questions concerning the Bid Specifications or any required need for clarification must be made to Jane A. Hines, CMC, City Clerk, at least five (5) business days prior to the date of the Bid opening. Interpretations or clarifications considered necessary by the City will be issued by addenda and posted/disseminated by DemandStar (www.demandstar.com) to all parties listed on the official plan holders’ list as having received the Bid documents. Only questions answered by written addenda shall be binding. Oral interpretations or clarifications shall be without legal effect. No plea of ignorance or delay or required need of additional information shall exempt a Proposers from submitting their Bid on the required date and time as publicly noted. 1.2 PLAN HOLDER’S LIST: As a convenience to proposers, the City of Sunny Isles Beach has made available via internet lists of all plan holders for each Request for Proposal, Request for Proposal, and request for qualifications. The information is available on-line at www.demandstar.com or by calling the Office of the City Clerk at (305) 792-1703. 1.3 ADDENDA TO SPECIFICATIONS: If any addenda are issued after the initial specifications are released, the City will post and disseminate the addenda through DemandStar. For those projects with separate plans, blue prints, or other materials that cannot be accessed through the internet, the Office of the City Clerk will make good faith effort to ensure that all registered proposers (those who have been registered as receiving a Bid package) receive the documents. It is the responsibility of the proposer prior to the submission of any Bid to check the above website or contact the Office of the City Clerk at (305) 792-1703 to verify any addenda issued. The receipt of all addenda must be acknowledged on the Bid Response Sheet. 1.4 SPECIAL ACCOMMODATIONS: Any person requiring a special accommodation at a Pre-Bid Conference or Bid/RFP/RFQ opening because of a disability should call the Office of the City Clerk at (305) 792-1703 at lease five (5) days prior to the Pre-Bid Conference or Bid/RFP/RFQ opening. If you are hearing or speech impaired, please contact the Office of the City Clerk by calling the City of Sunny Isles Beach using the Florida Relay Service which can be reached at 1(800) 955-8771 (TDD). 1.5 PUBLIC ENTITY CRIMES STATEMENT: Pursuant to the provisions of paragraph (2) (a) of section 287.133, Florida statutes -"a person or affiliate who has been placed on the convicted proposer list following a conviction for a public entity crime may not submit a Bid on a contract to provide any goods or services to a public entity, may not submit a Bid on a contract with a public entity for the construction or repair of a public building or public work, may not submit Bids on leases of real property to a public entity, may not be awarded to perform work as a Contractor, supplier, sub-Contractor, or consultant under a contract with any public entity, and may not transact business with any public entity in excess of the threshold amount provided in section 287.107, for category two for a period of 36 months from the date of being placed on the convicted Proposer list”. 1.6 BID DEADLINE: Bids must be submitted no later than the time and date shown within this document. 1.7 SEALED BID: The entire Bid Response Package shall be placed in an opaque envelope (with all items listed on the Bid checklist form and all other items required within this Request for Proposal must be executed) and submitted in a sealed envelope. 1.8 BID EXECUTION, SIGNATURES, ERASURE/CORRECTION: All Bids shall be signed in blue ink. All price quotes shall be typewritten or printed with ink. All corrections made by the proposers prior to the opening must be initialed and dated by the proposers. No changes or corrections will be allowed after Bids are opened. Bids must contain an original, manual signature of an authorized representative of the company. 1.9 WITHDRAWAL OF BIDS: Proposers may withdraw Bids only by written request and shall forward the withdrawal request via “Certified U.S. Mail – Return Receipt Requested” prior to the Bid opening time. Negligence on the part of the Proposers in preparing the Bid confers no right for the withdrawal of the Bid after it has been opened. 1.10 BID OPENING: Bids will be opened publicly at the time and place stated in the Notice to Bidder. It is the responsibility of the proposers to insure that the Bid reaches the Office of the City Clerk on or before the closing hour and date stated on the Request for Proposal. After the Bid opening, the contents of the Bid Form will be made public for the information of proposers and other interested parties who may be present either in person or by representative. Bids that are received after the Bid opening time will not be considered and will not be returned. 1.11 EVALUATION OF BIDS: The City, at its sole discretion, reserves the right to inspect any/all Proposers facilities to determine their capability of meeting the requirements for the Contract. Also, price, responsibility, and responsiveness of the Proposers, the financial position, experience, staffing, equipment, materials, references, and past history of service to the City and/or with other units of state, and/or local governments in Florida, or comparable private entities, will be taken into consideration in the Award of the Contract. 1.11.1 Hold Harmless: All Proposer’s shall hold the City, it's officials and employees harmless and covenant not to sue the City, it's officials and employees in reference to their decisions to reject, award, or not award a Bid, as applicable. 1.11.2 Cancellation: Failure on the part of the Proposers to comply with the conditions, specifications, requirements, and terms as determined by the City, shall be just cause for cancellation of the Award. City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  5     1.11.3 Disputes: If any dispute concerning a question of fact arises under the Contract, other than termination for default or convenience, the Contractor and the City department responsible for the administration of the Contract shall make a good faith effort to resolve the dispute. If the dispute cannot be resolved by agreement, then the department with the advice of the City Attorney shall resolve the dispute and send a written copy of its decision to the Contractor, which shall be binding on both parties. 1.12 AGREEMENT: After the Bid award, the City will, at its option, prepare an Agreement specifying the terms and conditions resulting from the award of this Bid. The proposer will have ten (10) calendar days after notification of the award by the City to execute the Agreement and provide the required Performance Bond. The Proposer who has the Contract awarded to them and who fails to execute the Agreement and furnish the Performance Bond and Insurance Certificates within the specified time shall forfeit the Bid Security that accompanied their Bid, and the Bid Security shall be retained as liquidated damages by the City, and it is agreed that this sum is a fair estimate of the amount of damages the City will sustain in case the Proposer fails to enter into the Contract and furnish the Bonds as herein before provided. Bid Security deposited in the form of a cashier’s check drawn on a local bank in good standing shall be subject to the same requirements as a Bid Bond. The performance of the City of Sunny Isles Beach of any of its obligations under the agreement shall be subject to and contingent upon the availability of funds lawfully expendable for the purposes of the agreement for the current and any future periods provided for within the Bid specifications. 1.13 PAYMENTS: Payment will be made after commodities/services have been received, accepted, and properly invoiced as indicated in the contract and/or purchase order. Invoices must bear the purchase order number. 1.14 BRAND NAMES: If a brand name, make, of any "or equal" manufacturer trade name, or Proposer catalog is mentioned whether or not followed by the words "approved equal" it is for the purpose of establishing a grade or quality of material only. Proposer may offer equals with appropriate identification, samples, and/or specifications on such item(s). The City shall be the sole judge concerning the merits of items Bid as equals. 1.15 MATERIAL: Material(s) delivered to the City under this Bid shall remain the property of the seller until accepted to the satisfaction of the City. In the event materials supplied to City are found to be defective or do not conform to specifications, the City reserves the right to return the product(s) to the seller at the seller’s expense. 1.16 SAMPLES: Samples of items, when required, must be furnished by the Proposers free of charge to the City. Each individual sample must be labeled with the Proposers name and manufacturer's brand name and delivered by them within ten (10) calendar days of Proposers receipt of the “Notice to Proceed”, unless schedule indicates a different time. If samples are requested subsequent to the Bid opening, they should be delivered within ten (10) calendar days of the request. The City will not be responsible for returning samples. 1.17 QUANTITY GUARANTY: No guaranty or warranty is given or implied by the City as to the total amount that may or may not be purchased from any resulting Contract or Award. These quantities are for Bid purposes only and will be used for tabulation and presentation of the Bid. The City reserves the right to increase or decrease quantities as required, even significantly. The prices offered herein and the percentage rate of discount applies to other representative items not listed in this Bid. 1.18 GOVERNMENTAL RESTRICTIONS ON MATERIALS: In the event any governmental restrictions may be imposed which would necessitate alteration of the material quality, workmanship, or performance of the items offered on this Bid prior to their delivery, it shall be the responsibility of the successful Proposers to notify the City at once, indicating in their letter the specific regulation which required an alteration. The City of Sunny Isles Beach reserves the right to accept any such alteration, including any price adjustments occasioned thereby, or to cancel at no further expense to the City. 1.19 SAFETY STANDARDS: The Proposer warrants that the product(s) supplied to the City conforms in all respects to the standards set forth in the occupational safety and health act (OSHA) and its amendments. Bids must be accompanied by a materials data safety sheet (MSDS) when applicable. 1.20 WARRANTIES: Successful Proposers shall act as agent for the City in the follow-up and compliance of all items under Warranty/Guaranty and complete all forms for Warranty/Guarantee coverage under this Contract. 1.21 COPYRIGHTS/PATENT RIGHTS: Proposer warrants that there has been no violation of copyrights or patent rights in manufacturing, producing or selling of goods shipped or ordered, as a result of this Bid. The seller agrees to indemnify City from any and all liability, loss, or expense occasioned by any such violation. 1.22 LOCAL BUSINESS TAX (OCCUPATIONAL LICENSE REGISTRATION): The contractor shall be responsible for obtaining and maintaining throughout the contract period his or her city and county local business tax receipts. Each Proposer submitting a Bid on this Request for Proposal shall include a copy of the company’s local business tax/occupational license(s) with the Bid response. For information specific to City of Sunny Isles Beach local business tax/occupational licenses, please call Code Enforcement & Licensing at (305) 792-1705. If the contractor is operating under a fictitious name as defined in Section 865.059, Florida Statutes, proof of current registration with the Florida Secretary of State shall be submitted with the Bid. A business formed by an attorney actively licensed to practice law in this state, by a person actively licensed by the Department of Business and Professional Regulations or the Department of Health for the purpose of practicing his or her licensed profession, or by any corporation, partnership, or other commercial entity that is actively organized or registered with the Department of State shall submit a copy of the current licensing from the appropriate agency and/or proof of current active status with the Division of Corporations of the State of Florida. 1.23 LIABILITY, INSURANCE, PERMITS AND LICENSES: Proposer shall assume the full duty, obligation, and expense of obtaining all necessary licenses, permits, inspections, and insurance required. The Proposer shall be liable for any damages or loss to the City occasioned by negligence of the Proposer (or their agent) or any person the Proposer has designated in the completion of their contract as a result of the Bid. Proposer shall be required to furnish a copy of all licenses, certificates of competency or other licensor requirements necessary to practice their profession as required by Florida State Statute, Miami-Dade County, and City of Sunny Isles Beach Code. Proposer shall include current Miami-Dade County City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  6     Certificates of Competency. These documents shall be furnished to the City along with the Bid response. Failure to furnish these documents or to have required licensor will be grounds for rejecting the Bid. 1.24 CERTIFICATE(S) OF INSURANCE: Proposers shall furnish to the Office of the City Clerk, City of Sunny Isles Beach, 18070 Collins Avenue, Sunny Isles Beach, Florida 33160, certificate(s) of insurance which indicate that insurance coverage has been obtained from an insurance company authorized to do business in the State of Florida or otherwise secured in a manner satisfactory to the City, for those coverage types and amounts listed in this document, in an amount equal to 100% of the requirements and shall be presented to the City prior to issuance of any Contract(s) or Award(s) Document(s). The City of Sunny Isles Beach shall be named as "additional insured" with respect to this coverage. The required certificates of insurance shall not only name the types of policies provided, but shall also refer specifically to this Bid and section. At the time of Bid submission the Proposers must submit certificates of insurance as outlined in the General Conditions section. All required insurances shall name the City of Sunny Isles Beach as additional insured and such insurance shall be issued by companies authorized to issue insurance in the State of Florida. It shall be the responsibility of the Proposers and insurer to notify the City Manager of the City of Sunny Isles Beach of cancellation, lapse, or material modification of any insurance policies insuring the Proposers, which relate to the activities of such proposer and the City of Sunny Isles Beach. Such notification shall be in writing, and shall be submitted to the City finance support service director thirty (30) days prior to cancellation of such policies. This requirement shall be reflected on the certificate of insurance. Failure to fully and satisfactorily comply with the city's insurance and bonding requirements set forth herein will authorize the City Manager to implement a rescission of the Bid award without further City Commission action. The Proposer hereby holds the City harmless and agrees to indemnify City and covenants not to sue the City by virtue of such rescission. 1.25 ASSIGNMENT: The Contractor shall not transfer or assign the performance required by this Bid without prior written consent of the City Manager. Any award issued pursuant to the Request for Proposal and monies which may be due hereunder are not assignable except with prior written approval of the City Manager. Further, in the event that the majority ownership or control of the Contractor changes hands subsequent to the award of this contract, Contractor shall promptly notify City in writing (via United States Postal Service – Certified Mail, Return Receipt Requested) of such change in ownership or control at least thirty (30) days prior to such change and City shall have the right to terminate the contract upon sixty (60) days written notice, at City’s sole discretion. 1.26 HOLD HARMLESS/INDEMNIFICATION: The Contractor shall indemnify, hold harmless, and defend the City of Sunny Isles Beach, it's officers, agents and employees from and against any claims, demands or causes of action of whatsoever kind or nature arising out of error, omission, negligent act, conduct, or misconduct of the Contractor, their agents, servants or employees in the provision of goods or the performance of services pursuant to this Bid and / or from any procurement decision of the City including without limitation, awarding the Contract to the Contractor. 1.27 NON-CONFORMANCE TO CONTRACT: The City of Sunny Isles Beach may withhold acceptance of, or reject items which are found upon examination, not to meet the specification requirements. Upon written notification of rejection, items shall be removed within (5) calendar days by the Proposer at their own expense and redelivered at their expense. Rejected goods left longer than thirty (30) calendar days will be regarded as abandoned and the City shall have the right to dispose of them as its own property. Rejection for non-conformance or failure to meet delivery schedules may result in the Contractor being found in default. 1.28 DEFAULT PROVISION: In case of default by the Proposers, the City of Sunny Isles Beach may procure the articles or services from other sources and hold the Proposers responsible for any excess costs occasioned or incurred thereby. 1.29 SECONDARY/OTHER VENDORS: The City reserves the right in the event the primary Proposer cannot provide an item(s) or service(s) in a timely manner as requested, to seek other sources without violating the intent of the Contract. 1.30 DEFINITIONS: Wherever used in these General Conditions or in the other Contract Documents, the following terms shall have the meaning indicated which shall be applicable to both the singular and plural thereof: Acceptance: Acceptance by the City of the Work as being fully complete in accordance with the Contract Documents subject to waiver of claims. Agreement: The written Agreement between the City and the Contractor covering the Work to be performed, which includes the Contract Documents. Addenda: Written or graphic instruments issued prior to the Bid Opening which modify or interpret the Contract Documents, Drawings and Specifications, by addition, deletions, clarifications or corrections. Approved: Means approved by the City. Bid: The offer of the Proposers submitted on the prescribed form setting forth the prices for the Work to be performed. Proposers: Any person, firm or corporation submitting a Bid for Work. The term is inclusive of terms vendor and contractor. Bonds: Bid, performance bond and other instruments of security, furnished by the Contractor and their surety in accordance with the Contract Documents and in accordance with the law of the State of Florida. Change Order: A written order to the Contractor signed by the City authorizing an addition, deletion or revision in the Work, or an adjustment in the Contract Price or the Contract Time issued after execution of the Agreement. City: City of Sunny Isles Beach, 18070 Collins Avenue, Sunny Isles Beach, Florida 33160. Contract Documents: Contract Documents shall include, Instructions to Proposers, Contractor's Bid, the Bonds, the Notice of Award, the Agreement between the City and Contractor as well as any addenda thereto, these General Conditions, Special Conditions, the Technical Specifications, Drawings and Modifications, Notice to Proceed, Request for Proposal, Insurance City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  7     Certificates, Change Orders and Acknowledgment of Conformance with the City of Sunny Isles Beach. Contract Price: The total monies payable to the Contractor under the Contract Documents. Contract Time: The number of calendar days stated in the Agreement for the completion of the Work. Contracting Officer: The individual who is authorized to sign the contract documents on behalf of the City’s governing body. Contractor: The person, firm or corporation with whom the City has executed this Agreement. Day: A calendar day of twenty-four hours measured from midnight to the next midnight. Field Order: A written order issued by the City which clarifies or interprets the Contract Documents or orders minor changes in the Work. Modification: Modification means any one of the following: (a) a written amendment of the Contract Documents signed by both parties, (b) a Change Order, (c) a written clarification or interpretation if issued by the City, or (d) a written order for minor change or alteration in the Work issued by the City. A modification may only be issued after execution of the Agreement. Notice of Award: The written notice by City to the apparent successful Proposers stating that upon compliance with the conditions precedent to be fulfilled by him within the time specified, City will execute and deliver the Agreement to him. Samples: Physical examples which illustrate materials, equipment or workmanship and establish standards by which the Work will be judged. Specifications: Those portions of the Contract Documents consisting of written technical descriptions of materials, equipment, construction systems, standards and workmanship as applied to the Work. Statement of Services: The form furnished by the City which is to be used by the Contractor in requesting progress payments. Supplier: Any person or organization who supplies materials or equipment for the Work, including that fabricated to a special design, but who does not perform labor at the site. Work: Any and all obligations, duties and responsibilities necessary to the successful completion of the Project assigned to or undertaken by Contractor under the Contract Documents, including all labor, materials, equipment and other incidentals, and the furnishing thereof. Written Notice: The term “Notice” as used herein shall mean and include all written notices, demands, instructions, claims, approvals and disapproval’s required to obtain compliance with Contract requirements. Written notice shall be deemed to have been duly served if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or to an authorized representative or such individual, firm, or corporation, or if delivered at or sent by registered mail to the last business address known to them who gives the notice. Unless otherwise stated in writing, any notice to or demand upon the City under this Contract shall be delivered to the City. 1.31 BID AWARD: The City reserves the right to reject any and all Bids at its sole discretion. Bids shall be awarded by the City after the City performs all necessary searches, inquiries, exploration, and analysis of the Bids. The Bid shall be awarded to the lowest responsible and responsive proposer whose Bid best serves the interests of and represents the best value to the City in conformity with the criteria set forth in Section 62-8 of the City Code. No Notice of Award will be given until the City has concluded any investigation(s) as they deem necessary to establish the Proposer’s capability to perform the Services as described in this RFP, ITB, RFQ or ITQ, as substantiated by the required professional experience, client references, technical knowledge and qualifications; and sufficient labor and equipment to comply with the City’s established standards, as well as the financial capability of the Proposer to perform the Work in accordance with the Contract Documents to the satisfaction of the City within the time prescribed. The City reserves the right to reject the Bid of any Proposers on the basis of these queries and investigations and who does not meet the City’s satisfaction, even though the firm may be the lowest dollars and cents Bid. In analyzing Bids, the City will also take into consideration client references, past work experience and work product, proven ability to satisfactorily perform. If the Contract is awarded, the City will issue the Notice of Award and give the successful Proposers a Contract for execution within ninety (90) days after opening of Bids. The City specifically reserves the right to award the contract to a proposer who is not necessarily the lowest dollars and cents proposers on the basis of the results of these queries and investigation(s). 1.32 EXECUTION OF AGREEMENT: At least four counterparts of the Agreement, the Performance Bond, the Certificates of Insurance and such other Documents as required by the Contract Documents shall be executed and delivered by Contractor to the City within ten (10) calendar days of receipt of the Notice of Award. 1.33 LAWS AND REGULATIONS: The Contractor will give all notices and comply with all laws, ordinances, rules and regulations applicable to the Work. If the Contractor observes that the Specifications are at variance therewith, they will give the City prompt written notice thereof, and any necessary changes shall be adjusted by an appropriate modification. If the Contractor performs any Work knowing it to be contrary to such laws, ordinances, rules and regulations, and without such notice to the City, they will bear all costs arising wherefrom. 1.34 TAXES: The City of Sunny Isles Beach is exempt from sales tax imposed by the State and/or Federal Government. Florida Sales Tax Exemption No. 23-00-477131-54C appears on each purchase order. Exemption certificates are available upon request. 1.35 DUTY TO DEFEND, INDEMNIFY AND SAVE HARMLESS: City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  8     In consideration of the separate sum of twenty-five dollars ($25.00) and other valuable consideration, the Contractor shall defend, indemnify and hold harmless the City, its officers, agents and employees, from or on account of any injuries or damages, received or sustained by any person or persons during or on account of any operations connected with the Work described in the Contract Documents, or by or in consequence of any negligence in connection with the same; or by use of any improper materials or by or on account of any act or omission of the said Contractor or his Sub- Contractor, agents, servants or employees. The Contractor will defend, indemnify and hold harmless the City and their agents or employees from and against all claims, damages, losses and expenses including attorneys' fees arising out of or resulting from the performance of the Work, provided that any such claim damage, loss or expense (a) is attributable to bodily injury, sickness, disease or death, or to injury to or destruction of tangible property (other than Work itself) including the loss of use resulting wherefrom and (b) is caused in whole or in part by any negligent act or omission of the Contractor, Sub-Contractor, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, regardless of whether or not it is caused by a party indemnified hereunder. In the event that a court of competent jurisdiction determines that Sec. 725.06 (2), F.S. is applicable to this Work, then in lieu of the above provisions of this section the parties agree that Contractor shall indemnify, defend and hold harmless the City, their officers and employees, to the fullest extent authorized by Sec. 725.06 (2) F.S., which statutory provisions shall be deemed to be incorporated herein by reference as if fully set forth herein. In the event that any action or proceeding is brought against City by reason of any such claim or demand, Contractor, upon written notice from City shall defend such action or proceeding by counsel satisfactory to City. The indemnification provided above shall obligate Contractor to defend at its own expense or to provide for such defense, at City’s option, any and all claims of liability and all suits and actions of every name and description that may be brought against City, excluding only those which allege that the injuries arose out of the sole negligence of City, which may result from the operations and activities under this Contract whether the Work be performed by Contractor, its Sub-Contractors, or by anyone directly or indirectly employed by either. 1.36 DECISIONS ON DISAGREEMENTS: The City will be the initial interpreter of the Technical Specifications. 1.37 CITY MAY TERMINATE: If the Contractor is adjudged bankrupt or insolvent, or if they make a general assignment for the benefit of their creditors, or if a trustee or receiver is appointed for the Contractor or for any of their property, or if they file a petition to take advantage of any debtor’s act, or to reorganize under bankruptcy or similar laws, or if they repeatedly fails to supply sufficient skilled workmen or suitable materials or equipment, or if they repeatedly fail to make prompt payments to Sub-Contractors or for labor, materials or equipment or they disregard laws, ordinances, rules, regulations or orders of any public body having jurisdiction, or if they disregard the authority of the City, of if they otherwise violate any provision of, the Contract Documents, then the City may, without prejudice to any other right or remedy and after giving the Contractor and the surety ten (10) days written notice, terminate the services of the Contractor and take possession of the Project and of all materials, equipment, tools, construction equipment and machinery thereon owned by the Contractor, and finish the Work by whatever method they may deem expedient. In such case the Contractor shall not be entitled to receive any further payment until the Work is finished. If the unpaid balance of the Contract Price exceeds the direct and indirect costs of completing the Project, including compensation for additional professional services, such excess shall be paid to the Contractor. If such costs exceed such unpaid balance, the Contractor will pay the difference to the City. Such costs incurred by the City will be determined by the City and incorporated in a Change Order. If after termination of the Contractor under this Section, it is determined by a court of competent jurisdiction for any reason that the Contractor was not in default, the rights and obligations of the City and the Contractor shall be the same as if the termination had been issued pursuant to this document. 1.37.1 Where the Contractor’s services have been so terminated by the City said termination shall not affect any rights of the City against the Contractor then existing or which may thereafter accrue. Any retention or payment of moneys by the City due the Contractor will not release the Contractor from liability. 1.37.2 Upon ten (10) days written notice to the Contractor, the City may, without cause and without prejudice to any other right or remedy, elect to terminate the Agreement. In such case, the Contractor shall be paid for all Work executed and accepted by the City as of the date of the termination. No payment shall be made for profit for Work which has not been performed. 1.38 MISCELLANEOUS: Proposers acknowledge the following miscellaneous conditions: 1.38.1 Whenever any provision of the Contract Documents requires the giving of written notice it shall be deemed to have been validly given if delivered in person to the individual or to a member of the firm or to an officer of the corporation for whom it is intended, or if delivered at or sent by registered or certified mail, postage prepaid, to the last business address known to them who gives the notice. 1.38.2 The Contract Documents shall remain the property of the City. The Contractor shall have the right to keep one record set of the Contract Documents upon completion of the Project. 1.38.3 The duties and obligations imposed by these General Conditions, Special Conditions and Supplemental Conditions and the rights and remedies available hereunder, and, in particular but without limitation, the warranties, guarantees and obligations imposed upon Contractor and those in the Special Conditions and the rights and remedies available to the City, shall be in addition to, and shall not be construed in any way as a limitation of, any rights and remedies available by law, by special guarantee or by other provisions of the Contract Documents. 1.38.4 Should the City or the Contractor suffer injury or damage to its person or property because of any error, omission, or act of the other or of any of their employees or agents or others for whose acts they are legally liable, claim shall be made in writing to the other party within a reasonable time of the first observance of such injury or damage. 1.39 WAIVER OF JURY TRIAL: City and Contractor knowingly, irrevocably voluntarily and intentionally waive any right either may have to a trial by jury in State or Federal Court proceedings in respect to any action, proceeding, lawsuit or counterclaim based upon the Contract Documents or the performance of the Work there under. 1.40 GOVERNING LAW: The Contract shall be construed in accordance with and governed by the law of the State of Florida. 1.41 VENUE: Venue of any action to enforce the Contract Documents shall be in Miami-Dade County, Florida. 1.42 ARBITRATION: City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  9     It is the intention of the parties that whenever possible, if a dispute or controversy arises hereunder then such dispute or controversy shall be settled by arbitration in accordance with the procedures, rules and regulations of the American Arbitration Association. The decision rendered by the Arbitrator shall be final and binding upon the parties and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Arbitration shall be held in Miami-Dade County, Florida. All costs of arbitration and attorneys’ fees incurred by the parties shall be paid by the non- prevailing party or, if neither party prevails on the whole, each party shall be responsible for a portion of the costs of arbitration and their respective attorneys’ fees as may be determined by the court on confirmation. 1.43 PROJECT RECORDS: City shall have right to inspect and copy during regular business hours at City’s expense, the books and records and accounts of Contractor which relate in any way to the Project, and to any claim for additional compensation made by Contractor, and to conduct an audit of the financial and accounting records of Contractor which relate to the Project. Contractor shall retain and make available to City all such books and records and accounts, financial or otherwise, which relate to the Project and to any claim for a period of three years following final completion of the Project. During the Project and the three year period following final completion of the Project, Contractor shall provide City access to its books and records upon five days written notice. 1.44 SEVERABILITY: If any provision of the Contract or the application thereof to any person or situation shall to any extent, be held invalid or unenforceable, the remainder of the Contract, and the application of such provisions to persons or situations other than those as to which it shall have been held invalid or unenforceable shall not be affected thereby, and shall continue in full force and effect, and be enforced to the fullest extent permitted by law. 1.45 INDEPENDENT CONTRACTOR: The Contractor is an independent Contractor under the Contract. Services provided by the Contractor shall be by employees of the Contractor and subject to supervision by the Contractor, and not as officers, employees, or agents of the City. Personnel policies, tax responsibilities, social security and health insurance, employee benefits, purchasing policies and other similar administrative procedures, applicable to services rendered under the Contract shall be those of the Contractor. End of Section   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  10     Section 2 Special Terms and Conditions 2.1 PURPOSE OF BID: The City of Sunny Isles Beach (the “City”) intends to secure the services of a qualified contractor to remove and relocate existing trees and palms within the NE 174th Street corridor. It is the intent of this proposal document that all work shall result in compliance with the specifications documents and all local, state and federal regulatory requirements applicable to such service. 2.2 PRE-BID CONFERENCE A Mandatory pre-bid conference will be held on 11/21/2014 at 10:00am at Sunny Isles Beach Government Center, 18070 Collins Avenue, Sunny Isles Beach, FL 33160; 1st Floor Conference Room to discuss the special conditions and specifications included within this solicitation. Those who fail to attend this mandatory pre-bid conference will not be considered by the City and their bid will rejected. Proposers are requested to bring this solicitation document to the conference, as additional copies may not be available. 2.3 TERM This contract shall commence upon the date of the Notice to Proceed and shall remain in effect until such time as the commodities, equipment and/or services acquired in conjunction with this Request for Proposal have been completed and accepted by the City’s authorized representative, all required permits are properly closed out and upon completion of the express and/or implied warranty periods. 2.4 OPTIONS TO RENEW Intentionally Omitted 2.5 METHOD OF AWARD See section 4 2.6 PRICE Prices shall remain fixed and firm through the term of the contract 2.7 PERFORMANCE BOND AND PAYMENT BOND The City of Sunny Isles Beach shall require the successful Proposer to furnish a Performance and Payment Bond in the amount of 100% of the total Proposal Price, with the City of Sunny Isles Beach as the Obligee, as security for the faithful performance of the Contract and for the payment of all persons performing labor   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  11     or furnishing materials in connection herewith within ten (10) calendar days after notification of the award by the City. The bonds shall be with a surety company authorized to do business in the State of Florida. 2.8 BID BOND The City of Sunny Isles Beach shall require that every Proposer furnish a Bid Bond in the amount of 5% of the total Proposal Price. 2.9 DELIVERY Intentionally Omitted 2.10 INSURANCE Comprehensive General Liability with minimum limits of Five One Million Dollars ($5,000,000.00) per occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. Coverage must be afforded on a form no more restrictive than the latest edition of the Comprehensive General Liability policy, without restrictive endorsements, as filed by the Insurance Services Office, and must include: o Premises and Operation o Independent Contractors o Products and/or Completed Operations Hazard o Broad Form Property Damage o Broad Form Contractual Coverage applicable to this specific Contract, including any hold Harmless and/or indemnification agreement. o Personal Injury Coverage with Employee and Contractual Exclusions removed, with minimum limits of coverage equal to those required for Bodily Injury Liability and Property Damage Liability. At the Contractor’s expense, Workers’ Compensation will be provided in accordance with Florida Statute including Employers’ Liability with separate limits of One Million Dollars (1,000,000.00). Business Automobile Liability with minimum limits of Five Million Dollars (5,000,000.00) per occurrence combined single limit for Bodily Injury Liability and Property Damage Liability. Coverage must be afforded on a form no more restrictive than the latest edition of the Business Automobile Liability policy, without restrictive endorsements, as filed by the Insurance Services Office, and must include: o Owned Vehicles; o Hired and Non-Owned Vehicles; o Employers’ Non-Ownership. Before starting the Work, the proposer will file and make sure that all certificates of insurance required by this document and by the Contract are in the City’s possession. These certificates shall contain a provision that the coverage afforded under the policies will not be canceled or materially changed until at least thirty (30) days prior written notice has been given to the City by certified mail. The City shall be named as an additional insured on the above-referenced policies.   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  12     The Proposer agrees that if any part of the Work under the Contract is sublet, they will require the Sub- contractor(s) to carry insurance as required, and that they will require the Sub- contractor (s) to furnish to them insurance certificates similar to those required by the City in this section. 2.10.1 Cancellation and Re-Insurance: If any insurance should be cancelled or changed by the insurance company or should any insurance expire during the period of this contract, the proposer shall be responsible for securing other acceptable insurance to provide the coverage specified in this section to maintain coverage during the life of this Contract. All deductibles must be declared by the proposer and must be approved by the City. At the option of the City, either the proposer shall eliminate or reduce such deductible or the proposer shall procure a Bond, in a form satisfactory to the City, covering the same. 2.11 MONTHLY INVOICES PAYMENTS Cut-off date is the close of the last business day of the month. Proposer shall submit by the 10th day of the following month proposer's completed Statement of Services/Invoice. Should the 10th fall on a weekend or holiday, proposer shall submit his application on the next workday. Proposer is advised that processing of invoices must follow this schedule, as the City has funding requirements and other payment obligations which may prevent payment of late Statement of Services for that month’s billing cycle. A late Statement of Services with a recommendation for payment will be paid in the next month’s billing cycle. 2.12 LABOR, MATERIALS, AND EQUIPMENT SHALL BE SUPPLIED BY THE PROPOSER Unless otherwise provided in Section 3 of this solicitation the proposer shall furnish the following, including but not limited to, all labor, material, equipment, barricading, Maintenance of Traffic (MOT) inclusive of any required off duty police officers, adequate supervision, and coordination for satisfactory contract performance. When not specifically identified in the technical specifications, such materials and equipment shall be of a suitable type and grade for the purpose and meeting or exceeding all permit or industry standard requirements. All material, workmanship, 100% design, testing and equipment shall be subject to the inspection and approval of the City Manager or his designated representative for this project. 2.13 CLEAN-UP All unusable materials and debris shall be removed from the premises at the end of each workday, and disposed of in an appropriate manner. No equipment, material, debris, trailers or other items may be stored in any location outside of the provided construction easements without written approval from the City and the property owner. Upon final completion, the proposer shall thoroughly clean up all areas where work has been involved as mutually agreed with the associated user department’s project manager. 2.14 FEDERAL, STATE AND LOCAL REGULATIONS   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  13     The successful Proposer shall comply with all federal, state and local ordinances, regulations, rules and permits as well as any other laws that would apply to the services being provided. The proposer’s costs associated with regulatory requirements shall be included in the project cost whether depicted specifically or not within the body of the proposal. 2.15 MATERIALS SHALL BE NEW AND WARRANTED AGAINST DEFECTS The proposer hereby acknowledges and agrees that all materials, except where recycled content is specifically requested, supplied by the proposer in conjunction with this solicitation and resultant contract shall be new, warranted for their merchantability, and fit for a particular purpose. In the event any of the materials supplied to the City by the proposer are found to be defective or do not conform to specifications: (1) the materials may be returned to the proposer at the proposer’s expense and the contract cancelled or (2) the City may require the proposer to replace the materials at the proposer’s expense. No provisions or allotments for delays or time extensions to the schedule as a result of “defective”, unacceptable material, or reused material found shall be granted. In the event that material is suspected by the City Representative of being reused or not new in original packaging, the material may be rejected. The Proposer shall remove such material and replace it at his/her cost and within the original schedule. No provisions or allotments for delays or time extensions to the schedule as a result of “defective”, unacceptable material, or reused material found shall be granted. 2.16 NOTIFICATION TO BEGIN WORK SHALL BE GIVEN THROUGH A NOTICE TO PROCEED: The proposer shall neither commence any work, nor enter a City work premise, until a written Notice to Proceed (NTP) directing the proposer to proceed with the work has been received by the proposer from any authorized City manager or his designee representative; provided however, that such notification shall be superseded by any emergency work that may be required in accordance with provisions included elsewhere in this solicitation and resultant contract. In addition to the written NTP, the Contractor must supply the City with the required insurance and bond documents. 2.17 ACCIDENT PREVENTION AND BARRICADES Barricades, cones, construction fencing, temporary construction fencing and off duty police officers, per City regulations and other relevant requirements, shall be provided by the proposer when work is performed in areas traversed by persons or when deemed necessary by the City Manager or his designee at no extra cost to the City. Proposer shall comply with regulations and permit requirements for the placement of the proper fencing. Precautions shall be exercised at all times for the protection of persons and property. All proposers performing services under this contract shall conform to all relevant OSHA, State and City regulations during the course of such effort. Any fines levied by the above mentioned authorities for failure to comply with these requirements shall be borne solely by the responsible proposer. 2.18 WARRANTY SHALL BE SUPPLIED IN WRITTEN FORM   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  14     A. Type of Warranty Coverage Required The proposer shall provide a copy of its written warranty certificates with its initial offer, or upon request from the City. Failure to meet this requirement may result in the offer being deemed non-responsive. The warranty supplied by the proposer shall remain in force for the full period identified by the proposer; regardless of whether the proposer is under contract with the City at the time of defect. Any payment by the City on behalf of the goods or services received from the proposer does not constitute a waiver of these warranty provisions. Proposer’s warranties shall be 1 (one) year from final completion, backed by a warranty bond and shall include all delivery, labor, material, and equipment for the correction, replacement, reinstallation, and/or removal of defective and/or unacceptable work. Warranties for specific components of the work shall be provided separately and on fabricators or manufacturers original letterhead with original signatures. B. Correcting Defects Covered Under Warranty The proposer shall be responsible for promptly correcting any deficiency, at no cost to the City, within seven (7) calendar days after the City notifies the proposer of such deficiency in writing. If the proposer fails to satisfy the warranty within the period specified in the notice, the City may (a) place the proposer in default of its contract, and/or (b) procure the products or services from another source and charge the proposer for any additional costs that are incurred by the City for this work or items; either through a credit memorandum or through invoicing. 2.19 DEFICIENCIES IN WORK TO BE CORRECTED BY THE PROPOSER The proposer shall promptly correct all apparent and latent deficiencies and/or defects in work, and/or any work that fails to conform to the contract documents regardless of project completion status. All corrections shall be made within seven (7) calendar days after such rejected defects, deficiencies, and/or non- conformances are verbally reported to the proposer by the City's project administrator, who may confirm all such verbal reports in writing. The proposer shall bear ALL costs of correcting such rejected work. If the proposer fails to correct the work within the period specified, the City may, at its discretion, notify the proposer, in writing, that the proposer is subject to contractual default provisions if the corrections are not completed to the satisfaction of the City within seven (7) calendar days of receipt of the notice. If the proposer fails to correct the work within the period specified in the notice, the City shall place the proposer in default. 2.20 FURNISH AND INSTALL REQUIREMENTS The specifications and/or statement of work contained within this solicitation describe the various functions and classes of work required as necessary for the completion of the work. Any omissions of inherent technical functions or classes of work within the specifications and/or statement of work shall not relieve the proposer   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  15     from furnishing, installing or performing such work where required to the satisfactory completion of the project. 2.21 LICENSES, PERMITS AND FEES The proposer shall obtain and pay for all licenses, permits and inspection fees required for this project; and shall comply with all laws, ordinances, regulations and building code requirements applicable to the work contemplated herein. Damages, penalties and or fines imposed on the City or the proposer for failure to obtain required licenses, permits or fines shall be borne by the proposer. 2.22 LIQUIDATED DAMAGES FOR INCOMPLETE PROJECTS Failure to complete the project in accordance with the specifications and to the satisfaction of the City within the time stated for substantial and/or final completion shall cause the Proposer to be subject to charges for liquidated damages in the amount of $400.00 for each and every calendar day the work remains incomplete beyond these deadlines. As compensation due to the City for loss of use and for additional costs incurred by the City due to such non-completion of the work, the City shall have the right to deduct the said liquidated damages from any amount due, or that may become due to the Proposer under this agreement, or to invoice the Proposer for such damages if the costs incurred exceed the amount due to the Proposer. 2.23 WEEKLY PROGRESS REPORTS The City shall require that the successful proposer provide weekly progress reports on the status of the project. The report shall include at the minimum the following information;  Background on the project itself  Discussion of the achievements since last reporting  Discussion of problems that have arisen  Discussion of work that lies ahead  2 week look ahead schedule  Assessment of whether you will meet the objectives in the proposed schedule and budget END OF SECTION   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  16     Section 3 Scope of Services / Technical Specifications   3.1 SCOPE OF SERVICES Proposed are relocations and removals of existing trees and palms within the roadway corridor of NE 174th Street. Bids shall include all labor and material to perform said removals/relocations, including but not limited to bed preparation and mulching at relocation sites, staking and guying, stump removals, root pruning and trimming as well as any other incidentals reasonably required to perform the work outlined in this scope of services. The successful proposer shall be required to maintain the relocated trees for a period of one (1) year after relocation. The City may endeavor to root prune the trees designated for relocation prior to the successful proposer’s start of work. In this event, the construction duration for removal and relocation of the existing plant material shall be thirty (30) days from notice to proceed to substantial completion. Final completion shall be fourteen (14) days thereafter. In the event that the root pruning activities are to be included in this scope of services, a maximum of sixty (60) days shall be allotted between root pruning and tree relocation. Construction duration shall be seventy (70) days from notice to proceed for substantial completion. Final completion shall be considered as fourteen (14) days thereafter. The Miami-Dade County tree removal permit application has been submitted to the Tree Permitting Program by the City. Regardless of root pruning, the successful contractor shall be responsible to securing any additional permits through the City or County for the scope of work described herein. If any portion of the contract documents or plans is not clear or contradictive, the proposer is to submit a question/clarification in writing prior to submitting a bid proposal. END OF SECTON   City of Sunny Isles Beach |Request for Proposal No. 14‐10‐01  17     Section 4 Evaluation Process 4.1 Review of Proposals For Responsiveness Each proposal will be reviewed to determine if the proposal is responsive to the submission requirements outlined in the solicitation. A responsive proposal is one which follows the requirements of this solicitation that includes all documentation, is submitted in the format outlined in this solicitation, is of timely submission, and has the appropriate signatures as required on each document. Failure to comply with these requirements may result in the proposal being deemed non- responsive. The contract will be awarded to the lowest responsible and responsive proposer whose proposal best serves the interest of and represents the best values to the City in conformity with the criteria set forth in Section 62-8 of the City code. 4.2 Qualifications Proposals will be evaluated on the criteria listed below. Technical Qualifications 1. Proposer’s relevant experience, qualifications and past performance 2. Relevant experience and qualifications of key personnel, including key personnel of subcontractors that will be assigned to this project and experience and qualifications of subcontractors 3. Proposer’s approach methodology to providing the services requested in this solicitation 4. Proposed solution functionality, implementation and other objectives and requirements as stated Price 5. Proposer’s proposed price 4.2.1 MINIMUM REQUIREMENTS In order to be considered responsive, Proposers shall, at a minimum, demonstrate compliance with the following Pre-Qualification Criteria in their proposal. All requested documentation and/or information shall be provided in the Proposal to confirm that the Proposer has satisfied the Prequalification Criteria in order to be properly evaluated as listed herein. Proposers failing to meet these requirements shall be deemed non responsive. The pricing evaluation is used as part of the evaluation process. The City reserves the right to negotiate the final terms, conditions and pricing of the contract as may be in the best interest of the City. Price is only one factor and the contract will be awarded in conformity with the criteria set forth in Section 62-8 of the City Code. 4.4 Negotiations The City may award a contract on the basis of initial offers received, without discussions. Therefore, each initial offer should contain the Proposer’s best terms from a monetary and technical standpoint. Notwithstanding the foregoing, if the City and said Proposer(s) cannot reach agreement on a contract, the City reserves the right to terminate negotiations and may, at the City Manager’s or designee’s discretion, begin negotiations with the next lowest responsible and responsive Proposer. This process may continue until a contact acceptable to the City has been executed or all proposals are rejected. No Proposer shall have any rights against the City arising from such negotiations or termination thereof. Any Proposer recommended for negotiations may be required to provide to the City: a) Its most recent certified business financial statements as of a date not earlier than the end of the Proposer’s preceding official tax accounting period, together with a statement in writing, signed by a duly authorized representative, stating that the present financial condition is materially the same as that shown on the balance sheet and income statement submitted, or with an explanation for material change in the financial condition. All applicable provisions of the BIDDING REQUIREMENTS, CONTRACT FORMS, CONDITIONS OF THE CONTRACT AND DIVISION 1, GENERAL REQUIREMENTS shall govern the work under this section. B. See Special Provisions Section C. Review plans and specifications for related work. Site Work- excavation, back fill, compaction, paving, and curbs. Irrigation- valve, head and line location and depth. 1.02 WORK INCLUDED: A. Provide all labor, materials, necessary equipment, services and included but not limited to all related work to complete the lawns and grasses work as shown on the drawings, as specified herein or both, except as for items specifically indicated as “NIC ITEMS”. B. Installation: All plant materials included shall be of the specific size and quality indicated on the drawings and in these specifications and shall be installed in strict accordance with sound nursery practices and shall include maintenance and watering for all work outlined on the drawings and specifications until beneficial occupancy. C. Quantities and Locations: The Architect reserves the right to adjust the number and locations of the designated types and species to be used at any of the locations shown, in order to provide for any modifications which might become necessary. 1.03 QUALITY ASSURANCE: A. All employees shall be competent and highly skilled in their particular job in order to properly perform the work assigned to them. Quality of Sod: Any nursery supplying sod that has represented the quality of the sod as being higher than the actual grade as determined under this Section shall remove from the project all sod already delivered. Contractor shall comply with all Requirements of Regulatory Agencies current restrictions in regard to movement of sod, into or within areas which are outside of quarantine boundaries for the white fringed beetle and the imported fire ant, as issued by the following agencies: 1. U.S. Department of Agriculture, Animal and Plant Health Inspection Service. 2. Florida Department of Agriculture, Division of Plant Industry. D. Standards: 1. Authority for Nomenclature Species, etc.: a. All botanical and common names for sod have been derived from Standardized Plant Names, latest Edition, prepared by the American Joint Committee on Horticultural Nomenclature. Names of varieties not included therein have been generally derived from names accepted in the landscape industry. Where local nomenclature of the common name differs, the local nomenclature has been used. 2. Grade Standards: a. All sod shall be nursery grown except where specified otherwise, and shall comply with all required inspections, grading standards and plant regulations as set forth by the Florida Department of Agriculture. b. Federal Specifications (FS) O-F-241c(1), Fertilizers, Mixed Commercial. 3. Testing Agency: Independent Testing Laboratory. E. Certificates: 1. Growers Certification: a. Grass species, and location of field from which sod is cut. 2. Manufacturer's certification of fertilizer and herbicide composition. 1.04 CUTTING, DELIVERY AND HANDLING: A. Cutting Sod: After approval of source, mow and rake as necessary to remove excessive top growth and debris. Cut sod with sod cutters, retaining native soil mat of sufficient thickness to withstand handling. B. Transporting: 1. Movement of sod shall comply with all Federal, State and Local laws and regulations. 2. Sod shall be transported on vehicles of adequate size. C. Delivery: Deliver sod on pallets with root system protected from exposure to wind and sun. Deliver sod in quantities capable of being installed within 24 hours of cutting. Protect sod against dehydration, contamination, and heating during transportation and delivery. D. Storage: Keep stored sod moist and under shade, or covered with moistened burlap. Do not pile sod more than 2 feet deep. E. Handling: Handle sod in a manner to prevent dislodging native soil mat. Tearing of sod shall be prohibited. City of Sunny Isles Beach NE 174th Street Roadway Improvements 329200 - 3 Sodding 1.05 SUBSTITUTIONS: A. Substitutions of sod types shall be permitted only upon submission of documented proof that the particular type specified is not obtainable. The Architect shall submit substitute for approval by the Architect. 1.06 GUARANTEE: A. All sod shall be guaranteed for a minimum of ninety days from the time of beneficial occupancy. B. Replacement: The guaranteeing of sod shall be construed to mean the complete and immediate replacement of sod if it is: 1. Not in a healthy growing condition. 2. There is a question to its survival ability at the end of the guarantee period. 3. It is dead. C. Quality of Replacement: Replacement of sod shall be of the same species and quality as that of the plant to be replaced. D. Guarantee, Null, and Void: The guarantee shall be null and void for sod which is damaged, unhealthy, or dies as a result of "Acts of God" limited to hail, freeze, and winds which exceed hurricane force, providing the sod was in a healthy growing condition prior to these "Acts of God". E. Repair damage to other plants during sod replacement. PART 2 - PRODUCTS 2.01 SOD: A. Sod shall be of the varieties St. Augustine 'FLORATAM' or Argentine Bahia, (as per plant list and or plans),both well matted with roots, and of a firm, tough texture, having a compact top growth and heavy root development. It shall be free of objectionable grassy and broad leaf weeds. Sod shall not be accepted if it contains Bermuda grass. Sod sections shall be strong enough to support their own weight and retain their size and shape when suspended vertically from a firm grasp on the upper 10 percent of the section. Sod shall not be harvested or transplanted when moisture content (excessively dry or wet may adversely affect its survival. Sod shall be relatively free of thatch, up to one half inch allowable (uncompressed). Sod shall be free of nut grass and other weeds. B. The soil embedded in the sod shall be clean earth; free of stones and debris. Except where another grade is specifically called for in the plans, all sod shall be no less than Florida No. 1 at the time of final inspection, immediately prior to beneficial occupancy. Sod shall be inspected and found free of diseases, nematodes, pest and pest larvae, by entomologist of the State Dept. of Agriculture. C. The sod shall have been mowed at least three times with a lawn mower with final mowing not more than seven days prior to the sod being cut for placement. The sod shall be provided in City of Sunny Isles Beach NE 174th Street Roadway Improvements 329200 - 4 Sodding commercial pad sizes measuring not less than 12 inches by 24 inches and shall be live, fresh and uninjured at the time of placement. It shall be machine cut at a uniform sort thickness or 5/8", plus or minus 1/4", at time of cutting. Measurement for thickness shall exclude top growth and thatch. The sod shall be live, fresh and uninjured at the time of planting. It shall be planted within 24 hours after being cut and shall be shaded and kept moist from the time it is cut until it is planted. 2.02 PLANTING SOIL: All sod shall be planted on 2" of planting soil. The planting soil shall be sandy loam typical of the locality and composed of 50 percent sand and 50 percent muck. The soil must be taken from ground that has never been stripped. There must be a slight acid reaction (5.5 to 6.5) to the soil with no excess of calcium or carbonate. Soil shall be delivered in a loose friable condition. 2.03 FERTILIZER: A. Fertilizer for sod shall be a fertilizer with a chemical designation of 6-6-6 or 8-8-8. It shall have at least 50 percent of the nitrogen derived from natural organic sources and shall contain the minimum minor elements of a least three units of magnesium, 1/2 to 1 unit of manganese, and one unit of iron. Potash shall be derived from sulfate of potash only. Liquid fertilizer shall not be permitted. B. Composition and Quality: All fertilizer shall be uniform in composition, and dry. Fertilizer in bags shall be free flowing in condition for application by suitable equipment, and shall also be delivered in unopened bags or containers, each fully labeled with the manufactured analysis. Any fertilizer that becomes caked or otherwise damaged making it unsuitable for use shall not be accepted. 2.04 WATER: Potable or reuse from city water supply or other sources that are approved by a public health department. Water shall meet requirements in Section 329300- Soil Preparation. 2.05 STAKES: Softwood, 3/4" by 3/4" by 8", unpainted and untreated. PART 3 - EXECUTION 3.01 INSPECTION: A. The existence and location of utilities (overhead, above ground and underground) shall be thoroughly investigated and verified by the subcontractor before the work begins in the area of said utilities. The subcontractor shall exercise care in digging and working so as not to damage utilities or endanger the safety and lives of people. Should overhead, above ground or underground obstructions be encountered which interfere with the work, the Architect shall be consulted in order for a decision to be made on the relocation of the work to clear such obstruction. The subcontractor shall be responsible for the immediate repair of any damage to utilities caused by his /her work. City of Sunny Isles Beach NE 174th Street Roadway Improvements 329200 - 5 Sodding 3.02 PREPARATION: A. Excavation, Backfilling, and Fine Grading: Areas where sod is to be planted shall have the top three inches of material removed and replaced by a two inch blanket of planting soil prior to sodding. Remove stones, sticks, rubbish, and other extraneous matter. All rough areas and voids shall be eliminated during final grading in order to have a smooth and even grade. B. Fertilizer Application: 1. The rate or application for dry fertilizer shall be 16 pounds per 1000 sq. ft. if 6-6-6 is used and 12 pounds per 1000 sq. ft. if 8-8-8 is used. Fertilizer shall be spread uniformly over areas to be sodded, by use of a distribution device calibrated to distribute the specified quantities. 2. Disc-spread the fertilizer into the soil to a depth of three inches. 3.03 INSTALLATION: A. Placement of sod: The sod shall be moist, and shall be placed on a moist bed of planting soil. Pitchforks shall not be used in handling sod, and dumping from vehicles shall not be permitted. The sod shall be carefully placed by hand, edge to edge in rows at right angles to the slope, commencing at the base of the area to be sodded and working upward. The sod shall be immediately pressed firmly into contact with a 500 pound hand roller, or any other equipment approved by the Architect that will produce a 90 pound per square inch compression grading. The rolling operation shall provide a true and even surface and insure knitting without displacement of sod or deformation of the surfaces of the sodded area. Hand tamp those areas inaccessible to the roller. The edges of the sodded area shall be staggered in a corresponding manner, providing the offset along the edge does not exceed 6 inches. All vertical edging adjacent to sodded areas shall be tamped so as to produce a featheredge. B. On slopes having a ratio of one in three or greater, peg the installed sod into place with not less than two stakes per square yard. C. Immediately after completing placement of sod, begin watering operation. Water shall be applied in the amount necessary to keep the sod moistened to the full depth of the root zone for a period of not less than two weeks. D. After the initial two week watering period, apply water as needed, to maintain rooting and growth for the duration of the Contract until beneficial occupancy. E. Clean-up: After the sodding operations have been completed, all debris, fertilizer bags, pallets and other construction debris created by the subcontractor shall be removed from the project. Any paved areas, including curbs and sidewalks which have been strewn with soil, sod waste, or fertilizer shall be thoroughly swept. F. Weeding: In the event that weeds or other undesirable vegetation become prevalent to such an extent that whether cut or uncut they threaten to smother the grass species, they shall be removed as directed by the Landscape Architect. If necessary, replace as needed. G. Sanding: If, in the opinion of the Architect the sod bed, after planting, is in need of an application of sandy top-dressing, for reasons of irregularities or shrinking joints, the subcontractor shall immediately perform this function. City of Sunny Isles Beach NE 174th Street Roadway Improvements 329200 - 6 Sodding 3.04 RESPONSIBILITY PRIOR TO BENEFICIAL OCCUPANCY: A. Maintenance Prior to Inspection for Completion and beneficial occupancy. 1. Maintenance shall begin immediately after each portion of sodding is installed and continue until beneficial occupancy. 2. Sodded Areas: The subcontractor shall be held responsible for maintenance of sod areas, including watering, weeding, mowing, trimming, edging, repair of erosion, filling, leveling, and replacement as necessary, to establish a uniform lawn until acceptance. After the sod has been laid, tamped, and top-dressed, all areas and parts of areas which fail to show uniform growth and health for any reason whatsoever, shall be resodded, repeatedly if necessary, until all sodded areas are covered with satisfactory lawn. a. Mowing: When grass reaches 3 inches in height, mow to 2 inches in height. Maintain grass between 2 inches and 2 1/2" inches in height. Do not mow off more than 40% of grass leaf in single mowing. 3. Spraying and Dusting: During the maintenance period and up to the issuance of certificate of beneficial occupancy, the subcontractor shall do all spraying and/or dusting of all plants, as needed, for control of all pests, including rodents, fungus, and diseases. The materials and methods shall be in accordance with the highest standards and nursery practices as recommended by the County Agent, and approved by the Architect prior to implementation. 4. Protection: Planting areas and plants shall be protected against trespassing and damage. If any plants become damaged or injured, they shall be treated or replaced, as directed by the Inspector, and in compliance with this specification. No work shall be done within or over planting areas, or adjacent to plants without proper safeguards and protection. 5. Keep sidewalks, curbs, and driveways, parking areas, streets, terraces, decks and pavers free of plant cuttings, debris and stains. 6. Plant material rejected during the course of construction shall be removed within five (5) working days and replaced before the inspection for completion will scheduled B. Survival and Conditions: The subcontractor shall be responsible for the proper maintenance, the survival and condition of all landscape items from the time a landscape item is installed, until beneficial occupancy. C. Replacement: Replacement of plants shall be the responsibility of the subcontractor including the possible replacement of plant material resulting from removal by theft, vandalism, acts of negligence on the part of others, or acts of providence which include hail storms, tornadoes, freezes and hurricanes. All plant material shall be alive and in good growing condition for each specific kind of plant at the time of beneficial occupancy. D. Rating: The rating of each plant according to Florida Grades and Standards shall be equal to or better than that called for on the Plans and in these specifications at the time of beneficial occupancy. 3.05 MAINTENANCE AFTER BENEFICIAL OCCUPANCY: A. After completion and beneficial occupancy, the owner shall be responsible for maintenance. Install, establish and maintain landscaping as indicated in the Contract Documents. 1.2 MATERIALS: A. Plants: 1. Grade Standards and Conformity with Type and Species: a. Only use nursery grown plant materials purchased from Florida based Nurseryman Stock that comply with all required inspection, grading standards, and plant regulations in accordance with the latest edition of the Florida Department of Agriculture’s “Grades and Standards for Nursery Plants.” b. Unless otherwise specified, minimum grade for all plants is Florida No. 1 or better. All plants must be the specified size and grade at the time of delivery to the site and the minimum grade maintained throughout the project construction period and plant establishment period. c. Use only plants that are true to type and species and ensure that the plants not specifically covered by Florida Department of Agriculture’s “Grades and Standards for Nursery Plants” conform in type and species with the standards and designations in general acceptance by Florida nurseries. d. Prior to planting, furnish certification to the Engineer that all plant materials have been purchased from Florida based Nurseryman Stock. e. A minimum of two plants of each species on each shipment must be shipped with tags stating the botanical nomenclature and common name of the plant. f. Should discrepancies between botanical nomenclature and common name arise, the botanical name will take precedence. 2. Inspection and Transporting: a. Move nursery stock in accordance with all federal and state regulations and accompany each shipment with the required inspection certificates for filing with the Engineer. B. Water: 1. The water used in the landscape irrigation operations during the establishment period may be obtained from any approved source. 2. The water shall be free of any substance which might be harmful to plant growth. Effluent water shall meet all Federal, State and local requirements. C. Mulching: 1. Source Requirements for Sod and Mulch: a. The Contractor shall comply with all current restrictions in regard to movement of sod and mulch material, as required by the Division of Plant Industry, Florida Department of Agriculture and Consumer Services (www.doacs.state.fl.us/pi/plantinsp/pi_reg_summary.html ). 2. Material: a. Mulch shall be made entirely from the above ground portion wood and bark of the Melaleuca Quinquenervia Tree. It shall not contain more than 10% (by volume) bark and shall not contain roots or root pieces. c. Shreds and chips shall not be larger than 3/4 inch diameter and 1 1/2 inch in length. d. Mulch shall be free of weed seeds, soil and on other organic or inorganic material. e. Prior to its final processing, mulch will have been inspected and certified by the Florida Department of Agriculture and Consumer Services, Division of Plant Industry, as free of burrowing nematodes f. During processing, raw materials shall be stacked and stored in curing piles for no less than 120 days. g. All proofs of delivery shall bear the official State of Florida stamp of inspection and verification. 3. Installation: a. Mulch shall be applied to a minimum depth of three inches in planting beds and around trees. b. Mulch shall taper down to soil level at a distance of 3 inches from the base of trees and shrubs. 1.3 PLANTING REQUIREMENTS: A. Delivery: 1. All materials must be available for inspection before installation and will be subject to approval or rejection. B. Layout: 1. Mark proposed planting beds and individual locations of trees and palms as shown in the Contract Documents for Engineer’s review, prior to excavation or planting. 2. The Engineer may request to review all proposed construction and maintenance practices before the start of the operations. 3. Make no changes to the layout, materials or any variations of plant materials from the Contract Documents without the Engineer’s written approval. C. Soil Drainage: 1. All planting holes and beds must drain sufficiently prior to installing any plants. Immediately notify the Engineer of drainage or percolation problems before plant installation. D. Installation of Plants: 1. For installation of the plants as identified in the Contract Documents, comply with the requirements of the FDOT Design Standards, Index No. 544. 2. Personnel performing these services are under the sole responsibility and supervision of the Contractor and must be competent, experienced, and skilled in all aspects of the required landscape installation and establishment practices. E. Contractor’s Responsibility for Condition of the Plantings: 1. Begin maintenance of all plants immediately after each planting. Keep all plants watered, fertilized, mulched, pruned, and staked and guyed as necessary to assure specified minimum grade of Florida No. 1 throughout the duration of the project construction period and establishment period. 2. During the establishment period, keep the individual planting locations and planting beds free of litter and undesirable vegetation. Ensure that the plants are maintained so that they are healthy, vigorous, and undamaged throughout the duration of the project construction period and establishment period. 4. For the duration of the establishment period, operate and maintain in good operating condition, all components of any irrigation system installed in compliance with the Contract Documents. 5. During the establishment period, replace any plants that fall below specified minimum grade. Use replacement plants of the same species, size and planting medium as the plant being replaced and as specified in the Contract Documents. F. Inspection Requirements: 1. Certify monthly on a form provided by the Engineer that the plants have been installed and are being maintained per Contract Documents. 2. A registered Landscape Architect acting as the Contractor’s Landscape Quality Control representative will oversee the establishment period. 3. The Contractor’s Landscape Quality Control representative must perform quarterly inspections of planting areas and submit findings in report form to the Engineer. Information to be included in inspection report from the Contractor’s Quality Control representative must include as a minimum the following: a. Date of inspection; b. Description of project; c. Location of inspection; d. Weather conditions; e. Condition of plants – identify by species, location, and number of plants that are no longer the specified minimum; f. Condition of planting beds (including mulching, mowing, weeding, fertilizing, watering, and staking and guying), if applicable; g. Other comments; h. Signature and seal of Contractor’s Landscape QC representative 4. Submit the certified inspection report to the Engineer within seven calendar days after performing the inspection. 5. Any corrections to the inspection report must be revised/corrected and resubmitted within three calendar days after notification by the Engineer. 6. Any deficiencies noted on the inspection report must be corrected within ten days of notification from the Engineer. 7. Periodic, random verifications will be performed by the Engineer to ensure the quality of the plants and correctness of the certified landscape inspection report. G. Disposal of Surplus Materials and Debris: 1. Remove from the jobsite any surplus excavated material from plant holes unless otherwise directed by the Engineer. 2. Surplus is defined as material not needed after installation of plants per Contract Documents. 3. Upon commencement of the plant installation, remove daily all landscape installation debris from the landscape locations described in the Contract Documents. 4. Remove all excess staking and guying materials from the jobsite. H. Plant Establishment Period and Contractor’s Warranty: 1. Take responsibility for the proper maintenance, survival and condition of all plants for a period of one year after final acceptance. Mowing as part of the landscape work will be identified in the Contract Documents. 4. Continue any mowing of the landscape areas specified in the Contract Documents throughout the establishment period. 5. Provide a Warranty/Maintenance Bond to the Engineer in the amount of the total sums bid for all landscape items as evidence of warranty during this plant establishment period. 6. The cost of the bond will not be paid separately, but will be included in the costs of other bid items. 7. In addition to satisfying the provisions of Section 287.0935, Florida Statutes, the bonding company is required to have an A.M. Best rating of “A” or better. 8. If the bonding company drops below the “A” rating during the Warranty/Maintenance Bond period, provide a new Warranty/Maintenance Bond for the balance of the establishment period from a bonding company with an “A” or better rating. In such event, all costs of the premium for the new Warranty/Maintenance Bond will be at the Contractor’s expense. 9. The Engineer may conduct interim inspections of all landscape items during the plant establishment period, as well as at the end of the plant establishment period. 10. As part of the warranty to the Department, and at no cost to the Department, replace all plants found not to meet minimum specifications as shown in 0329300 – LANDSCAPING, 1.2 MATERIALS, and 1.3 PLANTING REQUIREMENTS, within ten days after each inspection. 11. Prior to the end of the establishment period, remove all staking and guying from the project. 12. At the end of the establishment period, the Engineer will release the Contractor from further warranty work and responsibility provided all plants are established and all previous warranty and remedial work, if any, has been completed to the satisfaction of the Engineer. . END OF SECTION 329300 City of Sunny Isles Beach NE 174th Street Roadway Improvements 329301 - 1 Transplanting SECTION 329301 - TREE TRANSPLANTING PART 1 - GENERAL 1.01 RELATED DOCUMENTS: A. All applicable provisions of the BIDDING REQUIREMENTS, CONTRACT FORMS, and CONDITIONS OF THE CONTRACT AND DIVISION 1, GENERAL REQUIREMENTS shall govern the work under this section. B. See Special Provisions Section C. Review plans and specifications for related work. Site Work- excavation, backfill, compaction, paving, curbs. irrigation-valve, head and line location and depth. 1.02 SCOPE OF WORK: A. The work specified by this Section of the Specifications consists of furnishing all labor, supplies, equipment and materials necessary to complete the work as shown on the Plans as well as all other related responsibilities as described in these Specifications and accompanying plans. 1. Work shall include preparation of trees and palms for transplanting. Prune canopies and roots. Relocate plants as shown and back fill as required for new material. Erect protective barriers after root pruning and after transplanting. Fertilize, spray, prune and maintain in healthy condition until final acceptance. Fill excavated tree pits. 2. Quantities and Locations: The Design Consultant reserves the right to adjust the number and locations of the designated types and species to be used at any of the locations shown, in order to provide for any modifications which might become necessary however these should be unit priced and paid in accordance with actual usage. 1.03 QUALITY ASSURANCE: A. Responsibility for Assuring Quality Work: 1. The Landscape Subcontractor shall have on site during all phases of relocation a certified arborist and shall comply with all local municipal codes and regulations. 2. All employees shall be competent and highly skilled in their particular job in order to properly perform the work assigned to them. The Subcontractor shall be responsible for maintaining the quality of the material on the job throughout the duration of his/her responsibility. B. Protection of existing trees and palms: 1. Install protection barricades to prevent encroachment beneath canopies. 2. Replace trees which are damaged, scarred or destroyed with the same species, size and quality. 1.04 SUBMITTALS: City of Sunny Isles Beach NE 174th Street Roadway Improvements 329301 - 2 Transplanting A. Submit a list of equipment, procedure and labor force for use in transplanting work. B. Submit a schedule by day for transplanting. C. Submit manufacturer’s literature on wetting agents, fertilizers and conditioners. D. Submit copies of permits obtained from governing agencies. 1.05 EXISTING CONDITIONS: No representations are made as to subsurface conditions. 1.06 GUARANTEE: A. Remove transplanted trees or palms that die or are deemed in unacceptable condition within 1 year of completion of the work. Remove barricades and backfill the pit left from removal. Replace unacceptable plants with same species, size and quality of plants from an off site source. 2.02 PLANTING SOIL: See Section -329300- Landscape 2.03 WATER: A. Clean and potable water as specified in Section 329302-Soil Preparation. 2.04 MULCH: A. Mulch shall be as specified in Section 329300-Landscape. 2.05 FERTILIZER: A. Fertilizer mix: 1. A mixture of ureaform ammonium phosphate and soluble potash suspendable powder to be diluted in water at a rate of 40 pounds of fertilizer per 100 gallons of water. 2. Use formula 30-4-10 with 50% nitrogen immediately available for release and 50 % slow release over 12 months. 3. Products to be approved by landscape architect. B. Wetting agent: 1. Lesco Wet as manufactured by Lesco, Inc. 2. Dilute at a rate of 32 oz. of wetting agent to 100 gallons of water. C. Minor Element: 1. Micro Mix liquid as produced by Lesco. Inc. 2. Dilute in water at a rate of 1 gallon Micro Mix per 100 gallons of water. D. Time release fertilizer tablets: Agriform, 15 gram, designation 20-10-5, or approved equal. E. Use the following mixture for deep root fertilization of trees and palms: City of Sunny Isles Beach NE 174th Street Roadway Improvements 329301 - 3 Transplanting 1/3 liquid fertilizer mix 1/3 wetting agent mix 1/3 minor element mix Use injection equipment, which agitates the mixture for uniformity of application. F. All shall comply with the State of Florida fertilizer laws. Labels may be required as submittal to the Design Consultant as verification of minimum standards for fertilizer used. 2.06 STAKING AND GUYING: See section 329300-Landscape 2.07 PRUNING PAINT: A. Pruning paint is not to be used unless directly approved by the Architect. Commercial tree paint which is waterproof, antiseptic, adhesive, elastic and free of kerosene, water, creosote and any substances harmful to plant material. PART 3 - EXECUTION 3.01 INSPECTION: A. Utilities: The location and existence of utilities (overhead and underground) shall be thoroughly investigated and verified by the Landscape Subcontractor before the work begins in the area of said utilities. The Landscape Subcontractor shall exercise care in digging and work so as not to damage existing utilities in said areas, such as underground pipes, cables, wires, etc. Should such overhead or underground obstructions be encountered which interfere with planting, the Design Consultant shall be consulted immediately in order for a decision to be made on the relocation of plant material to clear such obstruction. The Landscape Subcontractor shall be responsible for the immediate repair of any damage to utilities caused by his work. 3.02 PREPARATION: A. Mark trees and palms to be transplanted with surveyor's ribbon. Obtain approval of trees to be relocated prior to root pruning and relocation. Staking Plant Locations: Plant locations must be staked or marked prior to plant hole excavation or placing on deck, by scaling the plans from existing features found on site and shown on the plans or by given dimensions if shown. Architect shall approve final location prior to relocation. B. Remove any trees, saplings, bushes, vines and undergrowth interfering with transplanting. C. Clear the root ball area of foreign material and trash to expose undisturbed soil. D. Excavation of Plant Holes: See section 329300- Landscape E. Perform crown and root prune 60 days prior to transplanting. F. Fertilization and Watering: City of Sunny Isles Beach NE 174th Street Roadway Improvements 329301 - 4 Transplanting 1. Inject the fertilizer mixture within 24 hours after crown pruning, and a minimum of 14 days prior to root pruning. 2. Inject the deep root fertilizer mixture at a rate of 50 gallons of mixture per 1,000 3. Water trees every other day for 14 days following crown pruning and until transplanting. Form an earth berm 6" high outside the proposed root ball prior to watering. Apply a minimum of 4" of water within the berm at each watering. Water application should saturate the root ball. G. Crown Pruning: 1. Trim trees to be transplanted by thinning the crown only, and not by reducing crown dimensions. Trim to conform to NAA standards, including removal of dead wood. Repair injuries to trees including cavities and machinery marks. 2. Remove seedpods from Sabal Palms, and all but 10 youngest fronds. Trim boots to a clean, regular pattern. Tie several fronds in upright position to unopened center fronds. 3. All crown pruning to be completed a minimum of 14 days prior to root pruning. 4. Grind trimmings from tree and palm pruning and deposit on site where directed by Architect. H. Root Pruning: 1. Minimum root ball diameter for broadleaf trees: Caliper Ball Diameter 3-4" 36" 4-5" 48" 5-6" 56" 6-8" 64" 8-10" 72" 10-12" 84" 12-15" 90" 16-20" 96" Caliper is measured 12 inches above the ground. 2. Minimum ball depth for broadleaf trees: Ball diameter Minimum depth 36-48" 60% of dia. 48" and up 35" minimum 3. Minimum root ball size for palms: Sabal palm: 36" diameter 4. Root prune trees by digging a square trench equal distance from the trunk on 4 sides, 24” deep by 6” wide, either by hand. Leave roots with a smooth, clean cut without tears or splits. 5. Back fill root pruning trenches with the planting soil mix specified in section 329300- Landscape and flood to remove air pockets. 6. Construct a 6" berm, 12" outside the root-pruning trench using excavated soil. 7. Spread mulch 3 inches thick within the bermed area. 3.03 TRANSPLANTING: A. Apply at a rate of 50 gallons of mixture per 1,000 s.f. of canopy into root zones of trees and palms. 2. Soak tree balls to the full depth daily for seven consecutive days prior to transplanting. 3. Locate proposed position and elevation of trees for verification by Architect. 4. Select a moving route where overhead and underground utilities, existing or proposed, do not conflict with the transplanting process. 5. Backfill pits resulting from removal of trees and palms with clean topsoil and bring grade flush with surrounding grade. Repair erosion in the reclaimed area where plants have been dug. B. Digging and Moving: 1. Notify the Architect 24 hours in advance of each relocation to allow for observation of procedures. 2. Determine line of previous root pruning and excavate 12" outside the root mass to leave root pruning and new root growth undisturbed. 3. Dig pits a minimum of 42" deep with vertical sides and flat bottom. 4. Handle trees to avoid damage to bark and limbs. Attach support straps, cables, or chains at multiple points for weight distribution. Tree trunks may not be drilled and. 5. Do not force tree from ground prior to undercutting root balls. Determine final ball depth upon assessing conditions at time of trenching. Notify Architect if ball depth varies from specified depth. 6. Sabal palms may be relocated by means of tree spade at the discretion of the Contractor. Otherwise, lift similarly to canopy trees. C. Planting and backfilling: Apply all requirements of section 329300 – Landscape which apply. D. STAKING AND GUYING: In accordance with details & section 2.06 E. WATERING: 1. Initial Watering: Initially, water the plant material to develop uniform coverage and deep- water penetration of at least twelve inches on all sides of the plant ball. Proper watering shall aid in removing air pockets that occur in the planting operation. Avoid erosion, puddling, and washing soil away from plant roots. 2. Hand Watering: Provide hand watering of plant material for a period of 30 days subject to weather conditions, to maintain healthy growing conditions until final acceptance. This shall be in addition to water received from irrigation system, if any. 3. Tree wells maybe constructed to effectively control and contain water until plants are established. F. WEEDING: 1. In the event that weeds or other undesirable vegetation becomes prevalent to such an extent that they threaten plant material, they shall be removed as directed by the Design Consultant. 2. If necessary, the plant material and/or planting soil shall be replaced as needed to eliminate weeds at the expense of the Subcontractor. 3.04 CLEANING AND PROTECTION: City of Sunny Isles Beach NE 174th Street Roadway Improvements 329301 - 6 Transplanting A. Disposal of Trash: All debris and other objectionable material created through planting operations and landscape from the job or as directed by the Design Consultant. Excess soil shall be disposed of as directed by the Design Consultant. B. Responsibility for Protection and Restoration of Property: The Landscape Subcontractor shall be responsible for all damage to property whether it be accidental or necessary for the completion of the contract. C. Protection Against Mechanical Damage: The Subcontractor's responsibility for protection against mechanical damage shall include providing protection from vehicles and providing warning signs and barricades as might be necessary and he/she shall repair, restore and replace any planting areas which become damaged as a result of any negligence of the Subcontractor or his/her employees in complying with these requirements. Coordination shall be with the Owner and the Design Consultant. D. Responsibility Prior to Final Acceptance: 1. Maintenance Prior to Inspection for Completion: a. Maintenance shall begin immediately after each plant is planted and continue until final acceptance. b. Plants shall be soaked thoroughly by hose each day for the first two weeks (14 calendar days) and every other day for the following two-week period. Soaking then shall continue on a twice weekly basis or until irrigation system is operational and signed off on by Landscape Architect and irrigation contractor. c. Plant maintenance shall include watering, pruning, weeding, cultivating, mulching, tightening and repairing of guys, stakes, braces, etc., replacement of sick or dead plants, resetting plants to proper grades or upright position and maintenance of the watering saucer, and all other care needed for proper growth of the plants. Plant material rejected during the course of construction shall be removed within 5 working days and replaced before the inspection for completion will be scheduled. d. Spraying and Dusting: During the maintenance period and up to the issuance of certificate of final acceptance, the Subcontractor shall do all seasonal spraying and/or dusting of all planting. The materials and methods shall be in accordance with highest standard nursery practices and as recommended by the County Agent, and approved by the Design Consultant, through the Inspector prior to implementation. Any chemical treatments requiring a license shall be by provided and applied by a licensed Subcontractor according to State regulations. e. Protection: Planting areas and plants shall be protected against trespassing and damage according to local requirements or their plans. If any plants become damaged or injured they shall be treated or replaced, as directed by the Inspector and in compliance with these specifications. No work shall be done within or over planting areas or adjacent to plants without proper safeguards and protection. PART 4 - MEASUREMENT OF PAYMENT A.
