Home My WebLink AboutReso 2014-2340RESOLUTION NO. 2014 - _Z!P)_q0 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, APPROVING A REQUEST SUBMITTED BY DEZER BLUEGRASS, LLC TO NAIVE THE LANDSCAPING AND FRONT SETBACK REQUIREMENTS FOR THE CONSTRUCTION FENCE KITH GRAPHICS AT THE BLUEGRASS SITE LOCATED AT 18325 COLLINS AVENUE; ESTABLISHING CONDITIONS FOR THE RELOCATION OF THE CONSTRUCTION FENCE; APPROVING THE MURALS AND GRAPHICS; PROVIDING THE CITY MANAGER AND CITY ATTORNEY WITH THE AUTHORITY TO DO ALL THINGS NECESSARY TO EFFECTUATE THIS RESOLUTION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on or about November 4, 2014. Dezer Bluegrass. LLC. ( "Applicant ") submitted a request to the City of Sunny Isles Beach; Florida to waive the landscaping and front setback requirements and approval of graphics at the construction fence for the Bluegrass site to facilitate the construction of the future project; and WHEREAS. the City Commission wishes to approve the waiver to permit the Applicant with the flexibility to install the construction fence with graphics without the required setback and landscaping buffer. NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF SUNNY ISLES BEACH, FLORIDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are true and correct and are incorporated herein by reference as if they are fully set forth herein. Section 2. Waiver. The City Commission hereby approves the waiver of the landscape and setback requirements set forth in Section 265 -63.3 E. of the City Code; subject to the conditions below. Section 3. Murals and Graphics Approval. The City Commission hereby approves the graphics proposed by the Applicant as set forth in Section 265 -63 -3 G. of the City Code. Section 4. Conditions of Approval. The Applicant is required to comply with the following conditions: 1. The construction fence shall be maintained in good condition at all times. 2. That the sidewalk shall be maintained clean and in good condition at all times. 3. That the site plan application for a sales center at the site be submitted no later than 90 days from this approval, if not site plan is received within this timeframe, all graphics and murals shall be removed from the fence and the Applicant shall install the proper fencing for the property. Section 5. Authority of the City Manager and Citv Attorney. The City Manager and City Attorney are hereby authorized to do all things necessary to effectuate this Resolution. Section 6. At the meeting, Dezer Bluegrass will be requesting the approval of the Commission for the signage and graphics package that is to be installed for a temporary 8 foot high structural steel fence. Color renderings of the proposed graphics /signage package will be submitted to the Commission at the time of the meeting. The new fence and graphics will be installed along Collins Avenue on our Bluegrass Beach Club property, located at 18325 Collins Avenue, Sunny Isles Beach, FL, 33160. The plans for a future sales center to be constructed on the south portion of the Bluegrass site are nearing completion and are expected to be submitted to the City, for permit within the next 15 -30 days. In addition to the above, Dezer Bluegrass will also be requesting approval of the Commission for a variance request to allow the fence to be installed directly behind the existing sidewalk, eliminating the six (6) foot setback and landscape barrier requirements. This is consistent with other construction fencing installations located in Sunny Isles Beach such as the Jade Signature project and will provide additional safety features for pedestrians. The 112 foot long, 8 foot high fence will consist of a welded structure with 4 foot x 8 foot x 1/8" thick aluminum panels welded to horizontal steel members. The 10' -61" structural steel posts will be installed at 4 foot centers and be imbedded in the ground 30 inches in a pound concrete post footer. The 4 foot aluminum fence panels will have a graphic lamination applied as per the attached color renderings included with the application package. The temporary structure permit application has also been completed and notarized and is submitted along with this request.
